Subject:

Approval of Final Tract Map No. 20280
Recommendation:

That the Honorable City Council:
(1) Approve Final Tract Map No. 20280;
(2) Approve the Subdivision Improvement Agreement between the Subdivider (72 Lots Victorville LLC) and the City for Final Tract Map No. 20280; and (3) Approve the Lien Agreement between the City and 72 Lots Victorville LLC as security for the public improvements for said tract.

Fiscal Impact:

There is no fiscal impact as a result of this action.

Strategic Plan Goal:

This item aligns with “Goal E Invest in Infrastructure” in the City of Victorville Strategic Plan 2023-2026. Although this is not a Capital Improvement Project, we apply the same strategy to private development projects as they are essential in meeting the community’s needs.

Background:

A final tract map is required to subdivide a lot or parcel of land into five or more individual parcels for a residential subdivision in accordance with Victorville Municipal Code (VMC) Section 17.32.010. The Subdivider is required to install public improvements in accordance with VMC Section 17.64.010. These improvements include, but are not limited to; grading, drainage, streets, street lighting, road signs and markings, sewer, water, landscaping along master planned roads and other improvements as required.

Improvement plans prepared by a registered civil engineer are submitted to the Engineering Department for review and approval to assure that City standards and the conditions of approval placed on the subdivision are satisfied. 3 6

A Subdivision Improvement Agreement (SIA) and improvement security, to assure the completion of these public improvements, is also required in accordance with VMC Sections 17.64.050 and 17.64.060. An engineer’s cost estimate of the public improvements is used to determine the dollar amount of the improvement security required and must also be submitted to the Engineering Department for review and approval.

At the December 5, 2023, City Council meeting, the City Council approved the annexation of Tract Map No. 20280 into Drainage Facilities Assessment District No. 1 and Landscape Maintenance Assessment District No. 6.

Discussion:

The Subdivider (72 Lots Victorville LLC) has now requested the approval of Tract Map No. 20280. The subdivision provides for a total of 72 residential lots. Please refer to Attachment A, a vicinity map and Attachment B, the final tract map.

The conditions of approval have been satisfied and all documents have been received by the City that are required to approve the final tract map. These documents include:
(1) Final tract map signed by the owner, surveyor of record, San Bernardino County Auditor, and the San Bernardino County Board of Supervisors (Attachment B);
(2) Approved improvement plans (on file with the Engineering Dept.); (3) Approved Engineer’s cost estimate (on file with the Engineering Dept.); (4) Subdivision Improvement Agreement (Attachment C); and (5) Improvement security (Attachment D).

In accordance with VMC Section 17.64.065, the Subdivider has agreed to enter into a SIA with a lien agreement as improvement security. Staff recommends that the City Council approve Final Tract Map No. 20280, approve the SIA between the Subdivider and the City for Final Tract Map No. 20280, and approve the Lien Agreement between the City and the Subdivider as security for the public improvements for said tract.

Staff remains available for any questions the Council may have.
