Full Reduction of Faithful Performance Security for Case Nos. BLDC21-00045/EROW21- 00181
Recommendation:
That the Honorable City Council approve the full release of the Street Faithful Performance Security for Case No. BLDC21-00045/EROW21-00181.
Fiscal Impact:
There is no fiscal impact as a result of this action.
Strategic Plan Goal:
This item aligns with “Goal E Invest in Infrastructure” in the City of Victorville Strategic Plan 2023-2026. Although this is not a Capital Improvement Project, we apply the same strategy to private development projects as they are essential in meeting the community’s needs.
Background:
Case Nos. BLDC21-00045/EROW21-00181 are for a fueling station with a convenience store and car wash located at the southeast corner of Nisqualli Road and Hesperia Road.
The Developer, Boos-UP Hesperia, LLC, was required to complete street improvements per the conditions of approval. As a public improvement, the Developer provided bonds as security for the required pavement widening, curb & gutter, and sidewalk construction on Hesperia Road and Nisqualli Road and a traffic signal modification at the intersection.
At the May 16, 2023, regular City Council Meeting, an 80-percent release of the Street Faithful Performance Security was approved, and the street improvements were accepted by the City.

At the November 7, 2023, regular City Council meeting, the full release of the Street Labor & Materials Security was approved for Case Nos. BLDC21-00045/EROW21-00181, in accordance with Victorville Municipal Code Section 17.64.070(3).
Discussion:
Per Victorville Municipal Code Section 17.64.070(4), the remaining 20-percent of the Faithful Performance Security was held for a one-year warranty period that ended on May 16, 2024. Therefore, staff recommends the full release of the Street Faithful Performance Security, as there are no outstanding warranty items.
