Meeting of: June 4, 2024
Submitted By:

Fredy Bonilla, City Engineer

Subject:

Vacation/Abandonment of Offers of Dedication at the Southern California Logistics Airport Recommendation:

That the Honorable City Council:
(1) Open and conduct a public hearing to consider the vacation of easements on Southern California Logistics Airport (SCLA) property;
(2) Hear evidence offered by persons interested in the vacation; (3) Find the dedication vacation not subject to environmental review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Sections 15060(c)(2) and 15060(c)(3); and
(4) Adopt Resolution No. 24-039 vacating the dedications, as described and depicted by the exhibits attached thereto, and ordering the recordation of the same.

Fiscal Impact:

There is no impact as a result of this action.

Strategic Plan Goal:

This item aligns with “Goal C: Community and Economic Development” in the City of Victorville Strategic Plan 2023-2026. The vacation of the road easements will allow for future development of SCLA owned property.

Background:

The SCLA acquired a number of vacant land parcels located immediately north of the approach end of Runway 17 circa 2002 and 2003 as a function of its runway extension project. Despite these parcels being clouded with roadway easements, the runway and the airfield fencing was extended across some of the pre-established easements.

Although these easements were dedicated for local roads, none have been improved and are not in the current SCLA Specific Plan Circulation Element. Table 1 below summarizes when the easements were originally dedicated:

Discussion:

At the request of the Airport Director of the SCLA, Engineering staff researched the above-mentioned easements and have determined that they can be vacated/abandoned.

The roadway easements were never improved, receive no traffic, and do not contain any existing utilities. Given that the Southern California Logistics Airport Authority owns all the property upon which these easements are located, no other property owners would be impacted. Moreover, some of the easements can’t be accessed due to being located within the SCLA fenced airfield.

The City Council can summarily vacate an excess right-of-way of a street or highway not required for street or highway purposes pursuant to and in accordance with the provisions of Sections 8334 and 8334.5 of Chapter 4 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, if the following findings are made:

1. The right of way of a street or highway is found to be in be excess by the easement holder and not needed for street and highway purposes, and

2. There are no in-place public utility facilities that are in use and would be affected by the vacation.

The parcels to which the originally contemplated roads were to provide access have been merged for purposes of development, and since the roadway easements were never improved and are no longer needed for street or highway purposes, the easements can be summarily vacated (abandoned).

Staff remains available for any questions the Council may have.
