Subject:

Reduction of Securities for Tract Map No. 16507
Recommendation:

That the Honorable City Council approve the full release of the Drainage, Sewer, Street, and Water Public Improvement Labor & Materials (L&M) Securities for Tract Map No. 16507.

Fiscal Impact:

There is no fiscal impact as a result of this action.

Strategic Plan Goal:

This item aligns with “Goal E Invest in Infrastructure” in the City of Victorville Strategic Plan 2023-2026. Although this is not a Capital Improvement Project, we apply the same strategy to private development projects as they are essential in meeting the community’s needs.

Background:

Richmond American Homes of Maryland, Inc. (Richmond) purchased Tract Map No. 16507 (Tract 16507) from RY Properties in 2020. Tract 16507 encompasses 119 lots within a residential subdivision located at the southwest intersection of Mesa View Drive and Luna Road. At the time of acquisition by Richmond, the tract was partially developed, with 61 lots remaining undeveloped. The conditions of approval for the tract mandated the developer to finalize various infrastructure components; those components being Monumentation, Sewer, Storm Drain Systems, Streets, and Water Public Improvements.

Subsequently, on April 7, 2020, the City Council approved a Subdivision Improvement Agreement (SIA) with Richmond. This agreement outlined the responsibilities and obligations for the completion of Tract 16507.

At the November 7, 2023, regular City Council Meeting, Council approved an 80% release of the Drainage, Sewer, Street, and Water Faithful Performance securities and accepted the Drainage, Sewer, Street, and Water Public Improvements for Tract Map 16507.

Discussion:

Per Victorville Municipal Code Section 17.64.070(3), the remaining 20-percent of the Faithful Performance security are to be held for a one-year warranty period and the Labor & Materials securities will be held for a 6-month period. Therefore, staff recommends the full release of the Drainage, Sewer, Street and Water Labor and Materials securities due to the acceptance taking place at the November 7, 2023, regular City Council Meeting.

Staff remains available for any questions the Council may have.
