RESOLUTION NO. 24-055

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VICTORVILLE, CALIFORNIA, AMENDING RESOLUTION N O. 23-102

AND EXTENDING THE SUNSET DATE OF CERTAIN TEMPORARY FEE

AND PENALTY WAIVERS ASSOCIATED WITH THE LICENSING AND

IMPOUNDMENT OF DOGS AND CATS IN THE CITY THROUGH
DECEMBER 31, 2024, PURSUANT TO SECTION 7.04.055 OF CHAPTER

7.04, TITLE 7 OF THE VICTORVILLE MUNICIPAL CODE
WHEREAS, on June 6, 2023, the City Council of the City of Victorville (“City Council”) passed, approved, and adopted Urgency Ordinance No. 2439 to address an imminent lack of animal sheltering capacity and facilities in the City of Victorville (“City”) created by the unexpected closing of the Victor Valley Animal Protective League’s animal shelter in the City on April 30, 2023; and
WHEREAS, Urgency Ordinance No. 2439 was later reinforced by the passage of regular Ordinance No. 2440, which became effective on July 20, 2023; and WHEREAS, among other things, the aforementioned ordinances added provisions to Chapter 7.04 of Title 7 of the Victorville Municipal Code (“ VMC”) providing for the temporary waiver of certain fees and penalties associated with the licensing and impoundment of cats and dogs in the City (“Waivers”) to ensure that the City’s newly established Emergency Shelter was not stretched beyond its current capacity or overloaded to the point that sheltering conditions could endanger the health and welfare of the animals being sheltered, as well as those persons providing for their care; and
WHEREAS, while City staff have made significant progress in alleviating the shelter capacity/facility conditions by finalizing a lease for premises to serve as a larger and more permanent animal shelter in the City and designing same, the City still must complete construction of improvements to the premises before sheltering operations can fully commence; and WHEREAS, Section 7.04.055 of Chapter 7.04 of Title 7 of the VMC states that the Waivers provided for therein automatically expire on December 31, 2023 unless the City Council takes action by ordinance or resolution to extend said Waivers beyond the end of 2023; and WHEREAS, on December 19, 2023, the City Council extended the Waivers through June 30, 2024 by adopting Resolution No. 23-102; and
WHEREAS, the Waivers currently in place have and continue to aid the City in alleviating overcrowding at the Emergency Shelter and led to an increase in the number of pet owners seeking licensing and microchipping of their pets; and
WHEREAS, while the City diligently continues in its efforts to complete the process of constructing the new shelter, the premises are not yet ready for use and the City continues to experience a high-level of stray animals; and
WHEREAS, based upon the above recitals, the City Council has determined that extending Waivers through December 31, 2024 by adopting this Resolution is necessary to preserve the health, safety, and welfare of the residents and pets of the City.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF VICTORVILLE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:

Section 1. That the recitals and findings set forth above are true and correct and are hereby incorporated and made part of this Resolution by this reference.

Section 2. That all of the temporary fee and penalty waivers currently specified in Section

7.04.055 of Chapter 7.04 of Title 7 of the Victorville Municipal Code shall be extended through December 31, 2024 and shall automatically expire as of that date, unless the City Council takes action by resolution or ordinance to further extend them beyond December 31, 2024.

Section 3. That this Resolution shall be effective as of the date of adoption.

Section 4. That the City Clerk shall certify to the passage and adoption of this Resolution.
