RELEASE OF LIEN
SUBDIVISION IMPROVEMENT AGREEMENT FOR
MASTER TRACT MAP NOS. 17110 and 17308
WHEREAS, the City of Victorville, hereinafter called “CITY” entered into a Subdivision Improvement Agreement with WALTON CALIFORNIA, LLC, A CALIFORNIA LIMITED LIABILITY COMPANY, AS TO AN UNDIVIDED 5% INTEREST, AND WUSF 4 WEST CREEK, LLC, A CALIFORNIA LIMITED LIABILITY COMPANY, AS TO AN UNDIVIDED 95%, INTEREST, AS TENANTS IN COMMON, hereinafter collectively “DEVELOPER”, for the development of Tract Map Nos. 17110, 17111, 17112, 17113, 17114, 17115, 17116, 17986-1, 17986-2, 17308, 17309, 17310, and 17311 hereinafter collectively called “PROPERTY”; and
WHEREAS, said Subdivision Improvement Agreement imposed duties, obligations, and requirements on CITY and DEVELOPER; and
WHEREAS, such Subdivision Improvement Agreement was recorded on April 15, 2021 as Document No. 2021- 0174652 in the office of the County Recorder of the County of San Bernardino; and WHEREAS, DEVELOPER has entered into agreements with D.R. Horton Los Angeles Holding Company, Inc. (“D.R. HORTON”) for the purchase and development of the PROPERTY, and as result, DEVELOPER and D.R. HORTON have executed new Subdivision Improvement Agreements with the CITY pursuant to Victorville Municipal Code Sections
17.64.050 and 17.64.065; and
WHEREAS, the new Subdivision Improvement Agreement between DEVELOPER, D.R. HORTON, and the CITY (for Tract Map. Nos. 17110, 17111, 17112, 17113, 17114, 17115, 17116, 17986-1 and 17986-2) was recorded on , 2024 as Document No. in the office of the County Recorder of the County of San Bernardino; and the new Subdivision Improvement Agreement between DEVELOPER and the CITY (for Tract Map.
Nos. 17308, 17309, 17310 and 17311) was recorded on , 2024 as Document No. in the office of the County Recorder of the County of San Bernardino.
NOW, THEREFORE, in consideration of the recordation of the new Subdivision Improvement Agreements with DEVELOPER and D.R. HORTON as hereinabove stated, the CITY hereby releases DEVELOPER and its heirs, assignees, or successors in interest from any further duty, obligation, or requirement imposed pursuant to the above indicated Document No. 2021-0174652 only, and the same is hereby deemed to be of no further force and effect and shall cease to exist as a lien, duty, obligation, or cloud on the title to the PROPERTY described as follows:

I hereby state that the Subdivision Improvement Agreement herein identified is being released in accordance with Title 17 of the Victorville Municipal Code due to a change in ownership of the PROPERTY and recordation of new Subdivision Improvement Agreements with DEVELOPER and D.R. HORTON.
