Subject:

Reduction of Securities for Tract Map No. 17090
Recommendation:

That the Honorable City Council:
(1) Approve an 80 percent release in Water, Sewer, Drainage and Street Faithful Performance Securities for Tract Map No. 17090; and
(2) Accept the completed Water, Sewer, Drainage, and Street Improvements.

Fiscal Impact:

There is no fiscal impact as a result of this action.

Strategic Plan Goal:

This item aligns with Goal E Invest in Infrastructure in the City of Victorville Strategic Plan 2023-2026. Although this is not a Capital Improvement Project, we apply the same strategy to private development projects as they are essential in meeting the community’s needs.

Background:

Tract Map No. 17090 (Tract 17090) was originally a 150-lot single-family subdivision located at the southwest corner of Mesa View Drive and La Mesa Road. Tract 17090 was partially completed, with only 36 lots developed. In September 2010, the then-owner reverted a portion of the tract back to acreage, eliminating 60 lots. Since the subdivision was recorded on March 15, 2007, it has been sold multiple times. On September 15, 2020, the current owner, Richmond American Homes of Maryland, Inc. (Richmond), entered into a Subdivision Improvement Agreement (SIA) and provided substitute securities. The conditions of approval for the tract required the developer to complete several infrastructure components, including Water, Sewer, Drainage, Landscape Maintenance Assessment District (LMAD), Monumentation, and Street Improvements. 3 8

Discussion:

Richmond has completed the Water, Sewer, Drainage, and Street Improvements for Tract 17090. Therefore, staff recommends that the City Council approve an 80 percent reduction in the Faithful Performance Securities, in accordance with Victorville Municipal Code (VMC) Section 17.64.070(1), and accept the completed Water, Sewer, Drainage, and Street Improvements. The remaining 20 percent of the Faithful Performance Securities will be held for the one-year warranty period, as stipulated in VMC Section

17.64.070(4).

Staff is available for any questions Council may have.
