CITY OF VICTORVILLE

COUNCIL POLICY
SUBJECT:

City Council Policies
POLICY NO: CP-24-04
SUPERCEDES:

N/A
DATE: November 19, 2024
I. PURPOSE
To m
aintain a system of City Council policies which provide broad, general guidelines to the City Manager for the administration, operation, or general health, safety and welfare of the City of Victorville; and to establish procedures for the preparation, distribution and maintenance of Council Policies.

II. BACKGROUND
In order to effectively carry out the day -to-day operations of the City, the City Manager and staff depend on an extensive body of laws, regulations, ordinances, codes and policies for direction. Many of the policies developed by the City Council, such as those dealing with land use and zoning issues, have been codified by ordinance or adopted by resolution into the Municipal Code, General Plan, etc.

M
any times, however, the City Council may establish a policy which is simply an expression of its desire to see certain outcomes achieved relative to particular situations, or issues. These policies may not contain specific legal language and may not prescribe specific actions and/or measures. From these broad policies, the City Manager and staff develop administrative procedures designed to achieve the Council’s goals and objectives.

III. POLICY
The City of Victorville shall maintain documentation of City Council policies which are typically not codified into the various legal documents maintained by the City.

The purpose of these policies is to provide general direction to the City Manager and staff to develop administrative procedures which are consistent with the City Council’s goals and objectives.

IV. PROCEDURES
The City Manager shall utilize the following process for developing and maintaining the appropriate documentation of City Council Policies:

1. New policies, communicated by the City Council, will be prepared in written form and submitted to the Council at a subsequent meeting for review and content approval.

2. Alternatively, the City Manager may propose City Council policies , and present to the City Council for its approval, that may be in the interest of the effective administration, operation, or general health, safety and welfare of the City.

3. Existing policies may be recommended for deletion or modification by any member of the City Council or the City Manager. Any such deletion or modification shall be placed on the City Council agenda.

4. The policy shall be generally in the format attached as ‘Exhibit A’ and shall include the Council Policy number as assigned by the City Clerk, subject, adoption date, any policy superseded, purpose, background, policy statement, and procedures, as applicable.

5. If an existing Council Policy is to be updated, or otherwise amended, the originator shall request a new Council Policy number from the City Clerk to utilize for the updated or amended policy and shall request for the City Council to rescind the existing policy upon adoption of the updated or amended policy.

6. Council Policy originators should determine whether the issue is best addressed as an addition to a comprehensive policy document (such as the General Plan), whether an ordinance to create or amend municipal law is best, or whether a new Council Policy is warranted.

7. Council Policy originators should also research administrative procedures or any other relative City documents that may be in need of updating or revision should the new Council Policy be adopted and coordinate such revisions to prevent conflicts among various City policy documents.

8. The Council Policies shall be reviewed at least every two (2) years to ensure that subsequent Council actions or changes in law do not render a Council Policy unnecessary or in need of an update.

9. New council members will be provided with Council Policies as part of their orientation.

10. The City Clerk shall be responsible for the distribution of newly approved Council Policies to the City Council, and City staff to bring awareness of the new policy.

11. Copies of Council Policies shall be kept in the City Clerk’s office.
