Fiscal Impact:

There is no fiscal impact associated with this item.

Strategic Plan Goal:

This item aligns with “Goal E Invest in Infrastructure” in the City of Victorville Strategic Plan 2023-2026. Although this is not a Capital Improvement Project, we apply the same strategy to private development projects as they are essential in meeting the community’s needs.

Background:

A final tract map is required to subdivide five or more parcels of land for a residential subdivision in accordance with Victorville Municipal Code (VMC) §17.32.010. The Subdivider is required to install public improvements in accordance with VMC §17.64.010.

These improvements include, but are not limited to; grading, drainage, streets, street lighting, road signs and markings, sewer, water, landscaping along master planned roads 3 8

and other improvements as required. Improvement plans prepared by a registered civil engineer are submitted to the Engineering Department for review and approval to assure that City standards and the conditions of approval placed on the subdivision are satisfied.

A Subdivision Improvement Agreement (SIA) and improvement security, to assure the completion of these public improvements, is also required in accordance with VMC §17.64.050 and 17.64.060. An engineer’s cost estimate of the public improvements is used to determine the dollar amount of the improvement security required and must also be submitted to the Engineering Department for review and approval.

Discussion:

The subdivider (SLPR LLC) has now requested the approval of Tract Map No. 14525, the subdivision provides for of total of 312 residential lots between Phases 1, 2, and 3. Please see Attachment A, a vicinity map and Attachment B, the final tract maps.

The subject tract map was conditioned by the Planning Commission to fund the maintenance of certain public improvements (e.g., required landscaping on public property) in perpetuity. The subdivider has elected to utilize the formation of Community Facilities District No. CFD 2024-01 to accomplish this maintenance responsibility. The approval of this CFD has been placed as a separate item on the same December 19, 2024 City Council agenda for consideration. In the event the City Council approves said CFD, the City Council may proceed with approving this agenda item. However, should the City Council fail to approve the CFD, no action on this agenda item shall occur until the maintenance requirement has been fulfilled by other means, such as annexing the subject tract map into existing assessment districts.

All other conditions of approval have been satisfied and all documents have been received by the City that are required to approve the final tract map. These documents include:
1) Final tract map signed by the owner, surveyor of record, San Bernardino County Auditor, and the San Bernardino County Board of Supervisors (Attachment B) 2) Approved improvement plans (on file with the Engineering Dept.) 3) Approved Engineer’s cost estimate (on file with the Engineering Dept.) 4) Subdivision Improvement Agreement (Attachment C)
5) Improvement security (Attachment D) In accordance with VMC §17.64.065, the Subdivider has agreed to enter into a SIA with a lien agreement as improvement security.
6) Land Division Construction Improvement Agreement (Attachment E) 7) Satisfaction and Release of Land Division Construction Improvement Agreement (Attachment F)
