RELEASE OF SUBDIVISION AGREEMENT
Tract Map No. 17292-1
WHEREAS, the City of Victorville, hereinafter called “CITY” entered into a Subdivision Agreement with Trimark Pacific- Olivine, LLC., hereinafter called “DEVELOPER”, for the security of Tract Map No. 17292-1, hereinafter collectively called “PROPERTY”; and
WHEREAS, said separate Subdivision Agreement imposed duties, obligations, and requirements on the City and DEVELOPER; and
WHEREAS, such Subdivision Agreement were recorded on April 13, 2007, as Document No. 2007-0227735 the office of the County Recorder of the County of San Bernardino hereinafter (“County Recorder’s Office”); and
WHEREAS, as evidenced by that certain Grant Deed recorded on October 4, 2024, as Document No. 2024-0238852 in the County Recorder’s Office, DEVELOPER subsequently sold the PROPERTY to Richmond American Homes of Maryland Inc., a Maryland Corporation, hereinafter “Richmond American”, who has now executed a new Subdivision Improvement Agreement and posted substitute securities for Tract Map No. 17292-1 pursuant to Victorville Municipal Code sections
17.64.060 and 17.64.065(k): and
WHEREAS, the Subdivision Improvement Agreement between Richmond American and CITY was recorded on _________day of _______________, _______ as Document No. ___________________________ in the County Recorder’s Office; and
NOW, THEREFORE, in consideration that the PROPERTY having substitute securities and a new Subdivision Improvement Agreement, the CITY hereby releases DEVELOPER from any further duty, obligation, or requirement imposed pursuant to Document No. 2007-0227735 only, and the same are hereby deemed of no further form and effect and shall cease to exist as a lien, duty obligation, or cloud on the title to the following described PROPERTY:

I hereby state that all performances, obligations, and requirements required by the Subdivision Agreement, herein identified, per Title 17 of the Victorville Municipal Code required for Tract Map No. 17292-1 have been complied with on the hereinabove described PROPERTY.
