Fredy Bonilla, City Engineer

Subject:

Reduction of Securities for Tract Map No. 16720
Recommendation:

That the Honorable City Council:
(1) Approve a 20-percent release of the Street Faithful Performance Security for Tract Map No. 16720; and
(2) Accept the completed Street Improvements.

Fiscal Impact:

If approved, a reimbursement of $201,542.95 will be issued from the Engineering’s Deposit Trust Account No. 600-23130. Since it is a trust account, there will be no net fiscal impact to the budgeted Engineering Department accounts.

Strategic Plan Goal:

This item aligns with “Goal E Invest in Infrastructure” in the City of Victorville Strategic Plan 2023-2026. Although this is not a Capital Improvement Project, we apply the same strategy to private development projects as they are essential in meeting the community’s needs.

Background:

Tract Map No. 16720 (Tract 16720) is a 117-lot, single family subdivision, located at the southeast corner of Eucalyptus Street and Mesa Linda Street. On July 7, 2020, the City Council approved a Subdivision Improvement Agreement (SIA) secured by cash with Victorville 105 Lots, LP, a California limited partnership managed by MHP Builders and known as Legacy Homes, for tract development. The conditions of approval for the tract required that the developer finalize various infrastructure components; those components being Water, Drainage, Sewer, Street, Landscaping Maintenance Assessment District (LMAD) and Monumentation Improvements.

Discussion:

At the regularly scheduled City Council meeting held on December 1, 2020, the City Council approved a 60-percent reduction of the Street Faithful Performance Security. The developer has met the conditions of approval and has successfully completed all requirements for Street Improvements.

Therefore, staff recommends that the City Council approve a 20-percent reduction of the Street Faithful Performance Security in accordance with Victorville Municipal Code (VMC) Section 17.64.070(1), as well as accept the completed Street Improvements. The remaining 20-percent of the Faithful Performance Security will be held for the one-year warranty period, in accordance with VMC Section 17.64.070(4).

Staff is available for any questions Council may have.
