That the Honorable City Council:
(1) Approve the Fifty-Fourth Amendment to Law Enforcement Contract #94-909-A-54 for the period of July 1, 2025, through June 30, 2026, and authorize the Mayor or her designee to process all documents required for this agreement; (2) Approve the Memorandum of Understanding (MOU) by and between the City of Victorville and the Victor Elementary School District (VESD) for the same period to fund School Resource Officers and authorize the City Manager or his designee to process all documents required for the agreement; and (3) Approve the agreement by and between the City of Victorville and Macerich Victor Valley, LP (Macerich) for one Deputy and authorize the City Manager or his designee to process all documents required for the agreement.
Fiscal Impact:

Sufficient funds will be budgeted in the FY 2025- 2026 budget (1002001-52300) to cover the contract amount expense along with a reimbursable from the VESD for their respective shares of costs for the School Resource Officers (SROs) and Macerich for one Deputy. Additionally, the cost for dispatch services for Code Compliance and Animal Control totals $40,892 and will be funded from the following accounts:

Strategic Plan Goal:
This item aligns with Goal B, Public Safety, implementing public safety strategies to support a thriving and growing community.
Background:
Since 1963, Victorville has contracted with the San Bernardino County Sheriff for law enforcement services. On April 15, 2025, San Bernardino County Sheriff Shannon Dicus held an annual meeting with contracting agencies and their respective City Manager’s to discuss the upcoming contract changes and cost projections as outlined in the Schedule A for FY 2025-2026.
Discussion:
The Fifty-Fourth Amendment to Law Enforcement Contract #94-909-A-54 replaces the Schedule A, providing law enforcement services to the City of Victorville for the period of July 1, 2025, through June 30, 2026.
This Schedule A Amendment includes a decrease from the previous contract in the amount of $1,353,412 or 3.6%. The decrease is partially related to the removal of four (4) SROs that were assigned to the Victor Valley Union High School District (VVUHSD) as outlined in the MOU approved by the City Council on May 21, 2024. The VVUHSD informed the City that they started their own police department and no longer require an MOU with the City for said SROs. Included in the four (4) SROs assigned to the VVUHSD, one (1) SRO was specifically identified as a K-9 Officer. This K-9 Officer will now be assigned to the City and add to the K-9 program, increasing the existing program from one to two K-9s. The other three (3) SROs assigned to the VVUHSD will fill current vacancies within the City. Furthermore, the Sheriff’s Employees’ Benefit Association (SEBA) is currently in negotiations with San Bernardino County and the increase for next year’s contract is undetermined. Once the San Bernardino County Board of Supervisors approve the MOU with SEBA, an item will be brought to the Council, should there be an increase in the Schedule A.
Accordingly, police staffing includes the following:
Sworn Officers 103.00
General Support Staff 43.33
Total 146.33
These staffing levels also include four (4) SROs assigned to VESD. The attached MOU represents those officers working in and around the schools to provide a safer learning environment. The MOU serves as the mechanism to gain reimbursement for the use of said services and effectively offsets the San Bernardino County Sheriff’s Contract.
The MOU with VESD will pay 75% of the cost of two (2) deputies, 100% of the cost of two (2) deputies, and include fuel and maintenance of three and one half (3.5) marked police vehicles, which amount to $1,104,195.82.
The Deputy assigned to the Mall of Victor Valley was added in May 2022 at the request of Macerich. The Deputy is assigned to the Mall full-time and is responsible for the enforcement of all criminal law violations on and in proximity to the Mall and all traffic laws on and in proximity to the Mall. This additional Deputy supplements the security services currently offered by Macerich and does not have any reduction in said services.
The attached agreement with Macerich represents the Deputy working in and around the Mall to provide a safer community environment. The agreement serves as the mechanism to gain reimbursement for the use of said services and effectively offsets the San Bernardino County Sheriff’s Contract. The agreement with Macerich will pay 100% of the cost to provide one (1) San Bernardino County Sheriff’s Deputy and the cost of one (1) Marked Unit in the amount of $314,838.84 for the next fiscal year.
Staff recommends that the Honorable City Council approve the Fifty-Fourth Amendment to Law Enforcement Contract #94-909-A-54, authorize the Mayor or her designee to process all documents required for this agreement, approve the MOU with the VESD as listed above, and authorize the City Manager or his designee to process all documents required for the agreement with Macerich Victor Valley, LP. Staff remains available for any questions or comments you may have.
