Fredy Bonilla, City Engineer

Subject:

Reduction of Securities for Tract Map No. 15294
Recommendation:

That the Honorable City Council:
(1) Approve an 80-percent reduction of the Landscape Maintenance Assessment District (LMAD) Public Improvement Faithful Performance Security for Tract Map No. 15294; and
(2) Accept the completed Landscape Maintenance Assessment District (LMAD) Public Improvements for Tract Map No. 15294.

Fiscal Impact:

There is no fiscal impact as a result of this action.

Strategic Plan Goal:

This item aligns with “Goal E Invest in Infrastructure” in the City of Victorville Strategic Plan 2023-2026. Although this is not a Capital Improvement Project, we apply the same strategy to private development projects as they are essential in meeting the community’s needs.

Background:

Tract Map No. 15294 (referred to as Tract 15294) is an 84-lot single-family residential subdivision located at the northeast corner of Fresh Meadow Place and Mesa View Drive.

Savannah Collection – Victorville, LLC (Savannah Collection), the original subdivider of Tract 15294, recorded the map after entering into a Subdivision Improvement Agreement (SIA) and posting securities for the required public improvements. However, construction of the public improvements was halted due to the Great Recession that impacted the residential market. As a result, no homes or public improvements were built, and the lots remained vacant. In November 2021, D.R. Horton Los Angeles Holding Company, Inc., a California corporation (D.R. Horton), acquired the property and initiated development of 4 1
8 3
Tract 15294. The conditions of approval for the tract required D.R. Horton to complete various infrastructure components, including water, sewer, drainage, street, landscaping maintenance assessment district (LMAD), and monumentation improvements.

Discussion:

The developer has completed the Landscaping Maintenance Assessment District (LMAD) Public Improvements on Peña Road, and they were placed on a 90-day Plant Establishment maintenance period which ended on May 1, 2025. It is recommended that an 80-percent reduction of the Landscaping Maintenance Assessment District (LMAD), Faithful Performance Security be released and that the City Council accept the Landscaping Maintenance Assessment District (LMAD) Improvements for maintenance.

Per Victorville Municipal Code Section 17.64.070(4), the remaining 20-percent of the Faithful Performance Security is to be held for a one-year warranty period and the Labor and Materials Security will be held for a six-month warranty period.

Staff is available for any questions Council may have.
