Recommendation:
That the Honorable City Council/Board of Directors:
(1) Approve the execution of a Consultant/Professional Services Provider Agreement in the amount of $60,000 by and between the City as Housing Assets Successor (“CHAS”) and Ninyo & Moore for remediation services at the former Nuway Dry Cleaners as required by the Lahontan Regional Water Quality Control Board (“LRWQCB”); and

Fiscal Impact:
An amount of $60,000 was approved by the City Council on June 3, 2025, as part of the FY 2025-2026 CHAS budget approval process (Fund 2053080-52300-89001) to record expenditures related to remediation services at the former Nuway Dry Cleaners as required by the LRWQCB. These expenses are not related to the new SCAP Grant Agreement.
An additional revenue appropriation in the amount of $483,353 in Fund 2707501E-43110- 89043 (Revenue) and Fund 2707501E-52300-89043 (Expenditure) was approved by the City Council on April 15, 2025 for Fiscal Year 2024-2025 to record expenditures and 4 2

revenues related to the carrying out of the scope of work defined in the new SCAP Grant Agreement application and award for a period of three years.
Strategic Plan Goal:
This item aligns with Strategic Plan Goal A, Financial Sustainability by controlling costs and increasing revenue through the administration of the new SCAP Grant as well as Goal C, Community and Economic Development by supporting the economic vitality and preservation of the community for all its members.
Background:
In February 2007, the former Victorville Redevelopment Agency (“RDA”) funded the acquisition of the former Nuway Dry Cleaners site located at 8th and C Street (“Site”) through a property tax lien sale conducted by the County of San Bernardino. The Site previously had been identified as a catalyst for redevelopment in the Strategic Action Plan for the Old Town/Midtown Project Area. Although the former RDA purchased the property with RDA funds, the property was vested in the name of the City of Victorville. After the acquisition, the City/RDA became aware of site contamination with PCE and TCE concentrations that exceeded the California and U.S. maximum contaminant levels. Since that time, the City has completed extensive site assessment and remediation work and reporting to various federal and state environmental agencies.
In 2016, staff worked with its environmental consultant, Ninyo & Moore, and applied for the CSWRCB SCAP Grant as a funding source to help with assessment and remediation of groundwater contamination at the Site. The City was awarded the amount of $1,457,598 from the CSWRCB and entered into a SCAP Grant Agreement in August 2019. The City was successful in carrying out an extensive amount of remediation work until the Grant expired in March 2024. Currently all wells are reporting non-detect for PCE and TCE except one monitoring point located within the footprint of the former Tailor Shop that requires further treatment. As such, the City applied for a new SCAP Grant to fund the remaining remediation work and reporting and was awarded $483,353. On April 15, 2025, the City Council accepted the Grant funding and approved the SCAP Grant Agreement with the CSWRCB for a three-year term.
Discussion:
To continue the remaining remediation work and reporting at the Site, staff is presenting two (2) separate agreements with Ninyo & Moore for your approval. The first agreement (Attachment A) is by and between CHAS and Ninyo & Moore, which was approved by the Council on June 3, 2025, as part of the CHAS Fiscal Year 2025-2026 budget. This agreement covers remediation expenditures that are not included within the new SCAP Grant scope and, therefore, these expenditures cannot be reimbursed by the Grant.
The second agreement (Attachment B) is by and between the City of Victorville and Ninyo & Moore and covers all remediation expenditures related to the scope of the new SCAP Grant Agreement. These expenditures are eligible for reimbursement by the Grant. Staff remains available for any questions you may have.
