Fredy Bonilla, City Engineer

Subject:

Approval of Final Parcel Map No. 20450
Recommendation:

That the Honorable City Council Approve Final Parcel Map No. 20450 Including the Abandonment of Public Right-of-Way.

Fiscal Impact:

There is no fiscal impact associated with this item.

Strategic Plan Goal:

This item aligns with “Goal E - Invest in Infrastructure” in the City of Victorville Strategic Plan 2023-2026. Although this is not a Capital Improvement Project, we apply the same strategy to private development projects as they are essential in meeting the community’s needs.

Background:

A final parcel map is a legal document used to subdivide property into four or fewer parcels of land. According to Victorville Municipal Code (VMC) Section 16-4.04.050 a subdivider must meet specific requirements for final map approval, including compliance with applicable surveying and engineering standards.

On December 14, 2022, the Planning Commission approved Planning Case No. PLAN21- 00031, which included an entitlement for the development of an approximately 1-million square-foot warehouse distribution building as well as a Tentative Parcel Map to merge 17 existing parcels into a single parcel. Since that time, the developer and subdivider, Link Logistics, has been working through the plan check process with the Building, Fire, Engineering, and Planning Departments to acquire the necessary permits for construction. The developer anticipates recording the final parcel map and obtaining construction permits prior to the entitlement’s expiration in December 2025. 4 3

Discussion:

The approval of a final parcel map does not typically require City Council approval as it is done administratively once the City Surveyor has deemed the map technically correct and the subdivider has complied with VMC Section 16-4.04.050. However, due to the need to abandon the previously dedicated right-of-way, including a portion of Ottawa Street, Apatite Street, Shabonee Road and an unnamed road, which requires City Council approval pursuant to Section 66499.20.2 of the Subdivision Map Act, this final parcel map is being presented for City Council approval to streamline the approval process and eliminate the need for a separate review to abandon the noted right-of-way. Section 66499.20.2 of the CA Subdivision Map Act states the following:

After approval of the merger and resubdivision by the governing body or advisory agency the map shall be delivered to the county recorder. The filing of the map shall constitute legal merger and resubdivision of the land affected thereby, and shall also constitute abandonment of all public streets and public easements not shown on the map, provided that a written notation of each abandonment is listed by reference to the recording data creating these public streets or public easements, and certified to on the map by the clerk of the legislative body or the designee of the legislative body approving the map.

To expedite the recordation of the final parcel map and ensure construction permits can be issued prior to the entitlement’s December 2025 expiration, the developer has now requested the approval of Parcel Map No. 20450 and the concurrent abandonment of portions of Apatite Avenue and Shabonee Road in order to consolidate 17 existing parcels into one development ready parcel.

The entitlement’s conditions of approval relating to the final parcel map have been satisfied and all documents have been received by the City that are required for approval, including the final parcel map (Attachment B).

The parcel map conditions of approval require that the developer record a Subdivision Improvement Agreement (SIA) for the required public improvements within six-months of the recordation of the parcel map. Since the developer anticipates acquiring construction permits in December 2025, one of the requirements for the issuance of associated construction permits is the execution of an Improvement Agreement (IA) secured by improvement bonds. Therefore, the condition to record an SIA will be satisfied prior to the commencement of construction.

Staff recommends that the Honorable City Council approve Final Parcel Map No. 20450 and the abandonment of the public right-of-way denoted in the map.
