Reduction of Securities for Tract Map No. 15396
Recommendation:
That the Honorable City Council:
(1) Approve a 20-percent release of the Street Public Improvement Faithful Performance Security for Tract Map No. 15396; and
(2) Accept the completed street improvements.
Fiscal Impact:
If approved, a reimbursement of $159,711.69 will be issued from the Engineering’s Deposit Trust Account No. 600-23130. Since it is a trust account, there will be no net fiscal impact.

Strategic Plan Goal:
This item aligns with “Goal E - Invest in Infrastructure” in the City of Victorville Strategic Plan 2023-2026. Although this is not a Capital Improvement Project, we apply the same strategy to private development projects as they are essential in meeting the community’s needs.
Background:
Tract Map No. 15396 (Tract 15396) is a 95-lot, single family subdivision, located at the northeast corner of Mesa Linda Avenue and Ava Loma Street. On September 1, 2020, the City Council approved a Subdivision Improvement Agreement (SIA), with Victorville 115-Lots, LP, the project owner and the entity that serves as limited partner in the development. Securities were accepted as a cash deposit from the acting lender in the project, WMMC, LLC. The conditions of approval for the tract required the developer to 4 3

finalize various infrastructure components, including water, drainage, sewer, street, landscaping maintenance assessment district (LMAD), and monumentation improvements. The developer has made significant progress in the development, and at the regular City Council meeting on July 6, 2021, 60-percent of the Street Public Improvement Faithful Performance Security was released.
Discussion:
The developer has met the conditions of approval and has successfully completed all the requirements for street improvements for Tract 15396. Therefore, staff recommends that the City Council approve an additional 20-percent reduction for an overall reduction of 80- percent of the Street Faithful Performance Security in accordance with Victorville Municipal Code (VMC) Section 17.64.070(1), as well as accept the completed street improvements. The remaining 20-percent of the Faithful Performance Security will be held for the one-year warranty period, in accordance with VMC Section 17.64.070(4).
