Strategic Plan Goal:

The City of Victorville Strategic Plan 2023–2026 identifies multi-year strategic goals and corresponding strategies to guide the City’s efforts towards achieving its long-term objectives. Goal B, Public Safety, focuses on implementing public safety strategies to support a thriving and growing community. Background:

At its October 8, 2025 meeting, the Victorville Planning Commission recommended City Council approval of the subject Title 16 Victorville Municipal Code (VMC) amendment (Case No. PLAN25-00015), in order to adopt the state mandated building codes and update various articles in Chapter 5 of the VMC.

Discussion:

The State of California triennially adopts updated editions of all parts of Title 24 of the California Code of Regulations, including the California Building, Residential, Electrical, Plumbing, Mechanical, Energy, and Green Building Codes. The majority of the amendments proposed by Ordinance No. 2458 (Attachment A) consist of updates to the 2022 editions of codes which are mandated by the State of California to be enforced by the Building Department. In addition, the proposed Ordinance includes clarifying revisions to various sections of the VMC.

Adoption of the following updated codes will bring the City of Victorville into compliance with State-mandated regulations, thereby ensuring consistency with the 2025 California Building Standards Code. These 2025 State mandated codes, which the State requires cities and local jurisdictions to adopt prior to their effective date of January 1, 2026, will replace the 2022 editions currently contained in Title 16, Chapter 5 of the VMC. The updated codes are identified below, with the full text of each code available at http://www.dgs.ca.gov/BSC/Codes and available for review with the Building Department.

Part 1: 2025 California Administrative Code
Part 2: 2025 California Building Code
Part 2.5: 2025 California Residential Code
Part 3: 2025 California Electrical Code
Part 4: 2025 California Mechanical Code
Part 5: 2025 California Plumbing Code
Part 6: 2025 California Energy Code
Part 11: 2025 California Green Building Standards Code (CALGreen)

The proposed Ordinance includes adoption of the 2025 California Building Standards Codes (Title 24) to align with the State’s current triennial cycle, as well as revisions which simplify language, clarify enforcement authority, and remove unused appendices. The removed appendices, which are voluntary and are not required to be adopted by the State, have been removed to eliminate provisions that are not relevant to local practice.

Additionally, Ordinance No. 2458 removes the VMC exception for issuing certificates of occupancy for private residential dwellings to establish a uniform requirement for all structures. This change ensures consistency with surrounding jurisdictions and improves documentation for both property owners and the City. These revisions will not impose or change any fee and are limited to simplifying language and improving clarity.

Environmental Assessment
Proposed Ordinance No. 2458 primarily includes text updates, relocations, and administration revisions to Title 16 of the VMC. The ordinance does not expand land use allowances or modify existing standards in a way that could result in environmental impacts. Therefore, it can be stated with certainty that the code amendments will not have a significant effect on the environment. Accordingly, adoption of the ordinance is exempt 4 3

from the California Environmental Quality Act (“CEQA”) pursuant to Section 15061(b)(3) of the CEQA guidelines.

In accordance with the Planning Commission’s recommendation (see material in Attachment B), staff respectfully recommends that the City Council adopt Ordinance No. 2458 to amend Chapter 5 of Title 16 of the VMC and find the Municipal Code Amendment exempt from CEQA Guidelines section 15061(b)(3),
Staff remains available for any questions the Council may have.
