Background:
On the July 18, 2017, regular meeting the Board of Directors (Board) approved a Professional Services Agreement with Civiltec Engineering, Inc. for the design of the Mojave Water Agency’s (MWA) Turnout No. 5 Amethyst Road Water Pipeline and the associated metering facility.
The project includes the design of a 1.25-mile, 24-inch diameter steel pipeline along Amethyst Road from Mesa Street to the VWD reservoir site, and a reinforced masonry metering facility Zone 3290 reservoir site, located at the southwest corner of the Amethyst Road and Sycamore Road.
This pipeline will convey water from MWA’s existing 30-inch main at Turnout No. 5 (Mesa Street) to VWD’s reservoirs and the Amethyst Booster Pump Station. The water is part of MWA’s Regional Recharge and Recovery Project (R-Cubed), which stores imported State Water Project (SWP) water seasonally to recharge Mojave Basin groundwater.
The project will provide VWD with an alternative water supply, reducing groundwater pumping, arsenic treatment costs, and helping maintain local aquifer levels.
On January 18, 2021, the VWD Board approved a Consultant/Professional Services Provider Agreement with Civiltec Engineering, Inc., in an amount not to exceed $176,318.40. The scope of services under this agreement includes providing bidding and design support during construction, as well as additional effort related to the Mitigation and Monitoring Reporting Program required by the environmental permitting agencies.
To date, two amendments to the original contract have been approved.
Amendment No. 1, with a fiscal impact of $75,250.00, increased total compensation under the agreement from $176,318.40 to $251,568.40. This amendment addressed new requirements stemming from the 2020 listing of 40 Western Joshua Trees (WJT) near the project area as candidate species under the California Endangered Species Act. As a result, the California Department of Fish and Wildlife (CDFW) required an Incidental Take Permit (ITP) and impact analysis on the WJT and their seedbank, per the Streambed Alteration Agreement (SAA) dated August 9, 2021. These requirements were unforeseen and not included in the original project scope.
Amendment No. 2, with a fiscal impact of $45,000.00, increased total compensation under the agreement from $251,568.40 to $296,568.40. This amendment was necessary to complete the environmental permitting process related to the ITP. Initially, it was expected that this additional work might not be necessary, pending a potential reversal of the WJT’s candidate status. However, when that did not occur, an amendment to the Consultant/Professional Services Agreement was required. Civiltec Engineering, Inc. submitted a scope and fee to cover the remaining environmental permitting services. 4 3

Discussion:
Staff are requesting that the Board of Directors approve Amendment No. 3 to the Consultant/Professional Services Provider Agreement with Civiltec Engineering, Inc., increasing the total compensation by $83,225.00 for a revised not to exceed amount of $379,793.40. This amendment will provide for the additional engineering services necessary to finalize the project for public bidding and support it through the construction phase. The scope includes revisions to the plans and specifications in response to recent MWA comments on the pipeline and metering facility, preparation of a minor amendment to the Streambed Alteration Agreement with the CDFW, and updates to the Revegetation and Restoration Plan to meet CDFW’s final approval requirements.
Additional scope items include a supplemental survey, pipeline depth modifications, cathodic protection design, and updates to the electrical, controls, and communications systems at the metering facility per MWA's direction. MWA has also requested a scour analysis for the pipeline crossing at Oro Grande Wash.
Engineering Staff is also requesting a two-year extension of the contract term, revising the expiration date to February 6, 2028, to accommodate the additional services and ensure completion of project construction. The California Department of Water Resources and MWA have advised that the construction grant funding will expire at the end of September 2027, requiring project completion and closeout prior to that date.
