RELEASE AND TERMINATION OF AGREEMENT CONTAINING HOME PROGRAM REQUIREMENTS, COVENANTS, CONDITIONS, AND RESTRICTIONS (24 CFR § 92.504) PLEASE TAKE NOTICE THAT the Apple Valley/Victorville HOME Consortium (“Consortium”) administers funds provided by the United States Department of Housing and Urban Development (“HUD”) under the HOME Investment Partnerships Program (“HOME Program”). To provide safe, decent, and affordable housing for low-income households, the City of Victorville, on behalf of the Consortium, entered into a First Amended and Restated Agreement with National Community Renaissance of California, a California nonprofit public benefit corporation (“National CORE”), dated August 18, 2015 (the “CHDO Agreement”).
The CHDO Agreement provided HOME Program funds for roof rehabilitation at Northgate Village Apartments, consisting of 18 buildings with 138 units serving very- low and low -income households. In connection therewith, the City of Victorville recorded an Agreement Containing HOME Program Requirements, Covenants, Conditions, and Restrictions (the “Covenant Agreement”) on July 24, 2017, as Instrument No. 2017-0412590, Instrument No. 2017-0412591 and Instrument No. 2017-0412592 in the Official Records of San Bernardino County, California, encumbering the real property described in Exhibit A (the “Property”).
Pursuant to 24 CFR 92.254(a), the Covenant Agreement was to remain in effect for a five (5) year period following recordation. That term has now expired, and the rehabilitation has been completed. National CORE has requested release of the Covenant Agreement, and the City of Victorville has determined that the conditions for release have been satisfied.
NOW, THEREFORE, the City of Victorville, Economic Development Department, hereby terminates the Covenant Agreement and forever releases and discharges the Property from all encumbrances created thereunder.
