Subject:
CAL ID Annual Services
Recommendation:
That the Honorable City Council:
(1) Adopt Resolution 25-078 Amending the Annual Budget for Fiscal Year 2025-2026 Approving an Additional Appropriation for CAL ID Annual Assessment Services; and
(2) Approve the payment of $163,078.36 to San Bernardino County Sheriff’s Bureau of Administration for CAL ID Annual Assessment Services.
Fiscal Impact:
The recommended action will result in a fiscal impact of $163,078.36. This item was not included in the Fiscal Year 2025-2026 budget, therefore, staff is requesting an additional appropriation in said amount. If approved, this expense will be paid from account 1002001-52300 (Police – Contract Services).
Strategic Plan Goal:
This item aligns with Strategic Goal B – Public Safety – by investing in technology that assists with efficient and effective police operations.
Background:
4 4
1 9
The CAL ID Telecommunications Network was established in 1985 as a statewide system to transmit and access fingerprint data between local agencies and the California Department of Justice. San Bernardino CAL ID was established soon after to utilize the state network and provide fingerprint services to San Bernardino County and its municipalities. Budgeting and oversight of San Bernardino CAL ID is through the San Bernardino County Remote Access Network (RAN) Board. Composition of the RAN Board is determined by Penal Code 11112.4. Member Agencies of CAL ID (also known as the San Bernardino Biometric Identification Network) not only receive fingerprint enrollment and searching services, but they also receive additional identification services such as live scan, mobile ID, facial recognition, iris enrollment and DNA. Each year, member agencies of San Bernardino CAL ID / Biometric Identification Network are invoiced for their portion of the City Assessment Fees that help fund CAL ID. City Assessment Fees are calculated on a per capita basis and based upon population estimates published annually by the California Department of Finance (Attachment B).
Municipalities are billed annually by the San Bernardino County Sheriff’s Department’s Bureau of Administration, which manages fiscal operations for San Bernardino CAL ID.
Discussion:
The CAL ID annual fees have historically been included as a part of the budgeting process; however, it was identified that it was not included for Fiscal Year 2025-2026.
This service is essential to support ongoing law enforcement operations. Inclusion in CAL ID enables the police department to access statewide fingerprint and photo identification systems in real time, aiding in identifying arrestees, processing prints from crime scenes, matching mug shots, and more.
Therefore, staff recommends that the City Council adopt Resolution No. 25-078, amending the Fiscal Year 2025-2026 budget with an additional appropriation of $163,078.36 and approve payment for CAL ID annual assessment services in this amount.

Southern California Edison Easement on Mesa Street
Recommendation:
That the Honorable City Council:
(1) Grant an exclusive utility easement to Southern California Edison on Assessor Parcel Number 3136-451-08 as described in the attached documents; and (2) Authorize the City Manager to execute the easement on the City's behalf.
Fiscal Impact:
There will be no fiscal impact resulting from this action.
Strategic Plan Goal:
This item aligns with “Goal E Invest in Infrastructure” in the City of Victorville Strategic Plan 2023-2026. Approval of the easements will enable Southern California Edison to install the necessary infrastructure needed by LGI Homes for continued development of Tract No. 17584.
Background:
The Lane’s Crossing Tracts comprise Tract Map Nos. 17585, 17586, 17587, 17588, (which overlay Master Tract Map No. 17584) as well as Tract Map Nos. 17582 and 17583.
Together, these tracts include a total of 550 single family residential lots, located in the general vicinity of Mesa Street and Mesa Linda Street as shown in the attached Vicinity Map (Attachment A). These lots were subdivided by the previous developer, Joshua Tree Fund 589 VIC, LLC, a Nevada Limited Liability Company (“Joshua Tree”). The final tract maps were approved at the December 7, 2021, City Council meeting. At that time these tracts were known as Vista del Valle. As required by Section 17.64.065 of the Victorville Municipal Code, Joshua Tree entered into a Subdivision Improvement Agreement (SIA) with a Lien Agreement as security upon receiving final map approval. 4 4
3 8
In 2022, LGI Homes (“LGI”) acquired the tract maps and renamed the community as Lane’s Crossing as a way of celebrating Victorville’s history. Lane’s Crossing was a ranch and store for travelers in the late 1800s that was established by Captain Aaron G. Lane, the first pioneer settler on the Mojave River.
At the August 16, 2022, City Council Meeting, the City Council approved a new subdivision improvement agreement with LGI secured by improvement bonds for Phase 1 and a new lien agreement for Phases 2 and 3. Phase 1 includes the development of Tract Map Nos. 17585 and 17586 as well as the extension of Topaz Road from Mesa Street to Eucalyptus Street. Phase 2 includes the development of Tract Map Nos. 17587 and 17588. Lastly, Phase 3 includes the development of Tract Map Nos. 17582 and 17583. The Approved Phasing Plan (Attachment B) illustrates the development of each phase of the project.
On January 11, 2024, the Engineering Department issued a Right-of-Way Subdivision permit to LGI for the development of Phase 1 after LGI acquired the jurisdictional permits necessary for development. LGI has made significant progress on Phase 1 development, with grading and onsite water and sewer systems nearly complete. LGI is now ready for Southern California Edison (“SCE”) to install the necessary electrical infrastructure required for Phase 1.
Discussion:
Though the required underground conduits and vault structures will be mostly constructed on the Mesa Linda Street and Mesa Street dedicated right-of-way, SCE has requested an easement on the City’s lettered lot along the Mesa Street frontage. The lettered lot was dedicated in-fee to the City for the required landscaping & irrigation improvements (LMAD) on Mesa Street that LGI will ultimately construct. For safety and access purposes, SCE requires that transformers have an eight-foot clearance around the structures, which prompts the need for the additional space from the lettered lot along Mesa Street. Without the easements in place, SCE will not energize the electrical lines which will ultimately result in delays to the development of the tract. Therefore, staff recommends that the City Council grant SCE the requested easements and authorize the City Manager to execute the easement on the City's behalf. This will enable KB Homes to continue tract development without delays.
Staff is available for any questions Council may have.

Subject:
Consideration of Resolution No. 25-079, Accepting the Unanimous Approval of the Property Owner and Annexing the Raising Cane’s Development into Community Facilities District No. 2024-01 (Annexation No. 1)
Recommendation:
That the Honorable City Council:
Adopt Resolution No. 25-079, to accept the unanimous approval of the landowners and make the findings necessary to annex portions of Parcel Nos 3106-201-24-0000, 3106- 201-25-0000, and 3106-201-27-0000 to Community Facilities District No. 2024-01 of the City of Victorville (Municipal Services) and to order the levy of Special Taxes to pay for municipal services and maintenance of certain facilities associated with the Raising Cane’s Development (Annexation No. 1).
Fiscal Impact:
The adoption of Resolution No. 25-079 will offset the financial impact necessary for the operations, maintenance, and improvement of public infrastructure and public safety associated with the Raising Cane’s Development.
This annexation is occurring after the property tax levy deadline for FY25-26. This establishment will be levied the rates listed in Resolution No. 25-079 as part of the FY26- 27 tax year. Funds received will be deposited into Fund 380 – CFD Tax A, Public Safety and Fund 381 – CFD Tax B, Municipal Services.
Pursuant to the Rate and method of apportionment (RMA), the current Maximum Special Tax A for Commercial Property is $0.058 per Building Square Footage. The current Maximum Special Tax B for Tax Zone 2 will be $1,199.51 per acre. On each July 1, commencing on July 1, 2026, the Maximum Special Tax A and Maximum Special Tax B for the prior Fiscal Year shall be adjusted by the greater of (i) an amount equal to the 4 4
3 7
percentage change in the Consumer Price Index for the Calendar Year ending in December for the prior Fiscal Year or (ii) five percent (5%). Special Tax A will be used for Public Safety services including Police, Fire and Code Compliance. Special Tax B will be used for road maintenance and graffiti abatement, as well as administrative expenses.
Strategic Plan Goal:
This item aligns with Goal A Financial Sustainability, Goal B Public Safety, and Goal E Invest in Infrastructure in the City of Victorville Strategic Plan 2023-2026. The proposed annual levy will support the expenses for operations, maintenance, and improvement of the public infrastructure and public safety associated with the Raising Cane’s Development.
Background:
The City’s Strategic Plan was last updated in August 2023, outlining goals for the next three years. Among them, Goal A - Financial Sustainability, was carried forward from the 2020 Strategic Plan and intended to ensure fiscal health through disciplined long-term planning, cost control, increased revenues, and cost recovery. In evaluating the City’s needs and expense obligations for each of the funds it manages, City staff analyzed unique funding mechanisms to provide for long-term municipal services.
The current options for mitigating the cost of additional municipal services for new development include, annexing into or forming a Landscape Maintenance Assessment District (LMAD), Drainage Facilities Assessment District (DFAD), Maintenance Assessment District (MAD), Street Light Assessment District (SLAD), or the development may form its own Homeowners Association (HOA). However, the maintenance districts allowed under the Landscape and Lighting Act of 1972 do not cover such items as road maintenance and graffiti abatement, two maintenance items that are allowable under a Community Facilities Districts (CFD).
In December 2021, staff began exploring CFDs and the possibility of forming a district within the City as one means to require new development to mitigate the costs associated with the provision of additional municipal services attributable to such development. A CFD is governed by the Mello-Roos Community Facilities Act of 1982, California Government Code Section 53311 et seq (the “Mello-Roos Act” or the “Act”) and is a special tax district formed when property owner(s) within a geographic area agree to impose a tax to fund infrastructure improvements and/or services.
The Mello-Roos Act authorizes the City to establish a CFD to finance certain public services through the levy of a special tax. With the help of the City’s CFD Consultant, Webb Municipal Finance, LLC (Webb), the City developed and applied a new condition of approval to all applicable project entitlements beginning in August of 2022, requiring such projects to mitigate their ongoing economic impacts that require the City to provide additional municipal services, either through annexation into a citywide services CFD if one was formed, or by an alternate, comparable funding mechanism. 4 4
3 7
In May 2024, Webb and City staff provided an overview of what a Citywide CFD would look like, what the tax rate might be given the estimated property values in the City, and the next steps required to move forward in establishing a Citywide CFD. The Citywide CFD would be annexable, and all future developments (with some limited exceptions) would be required to annex into such Citywide CFD or provide another comparable funding mechanism to pay for certain City services.
The proposed Citywide CFD would be structured to have two special taxes components:
Special Tax A for Public Safety and Special Tax B for Maintenance Services. Special Tax A would be based on the land use and current amount as adopted by the City Council, and Special Tax B would be the Maintenance Service rate that would vary depending on the improvements associated with each development that the City would be required to maintain (resulting in the creation of a unique tax zone number designation for each).
These tax rates would help offset the cost the City incurs as a result of new development.
After holding the requisite public hearings and landowner election, adopting resolutions of intention and formation, approving a boundary map, and conducting other proceedings required by the Mello Roos Act, on December 17, 2024, the City Council formed the City of Victorville Community Facilities District No. 2024-01 (Municipal Services) (“CFD No. 2024-01”) and adopted Ordinance No. 2453, allowing for the levy of the Special Taxes.
In addition, Resolution of Formation No. 24-102 outlined the proposed boundary map for TM 14525 (as the initial project) and the Future Annexation Area, as allowed by Act. The Future Annexation Area includes the entire City, and therefore allows future development parcels to annex into CFD No. 2024-01 (Citywide CFD), but only upon receipt of the written Unanimous Approval of the owner(s) of such parcel(s) at the time of annexation.
Discussion:
On October 9, 2024, the Victorville Planning Commission unanimously approved Planning Case No. PLAN24-00001, which included an entitlement for the development of an approximately 2,900 square foot Raising Cane’s restaurant on Roy Rogers Drive, just west of Civic Drive (Attachment B – Vicinity Map). One of the Conditions of Approval for the project was to annex into the Citywide CFD or otherwise mitigate the economic impacts of the development.
On November 10, 2025, the owner of the Raising Cane’s property (AMROYCIV LCC), submitted its signed petition to the City, constituting its Unanimous Approval to annex into the Citywide CFD and agreement to the levy of the Special Taxes. Said petition is Exhibit B to Resolution No. 25-079 (Attachment A).
To ensure a transparent and well-documented annexation process, staff will bring forth to the City Council for adoption a resolution for each annexation (or group of annexations) to CFD No. 2024-01. Said resolution(s) and accompanying staff report(s), will outline the project(s) initiating the annexation(s) and contain all other pertinent information needed for the City Council to approve the annexation.
4 4
3 7
To complete this first annexation (Annexation No. 1), the City Council will need to consider approval of attached Resolution No. 25-079 and adopt a boundary (Annexation Map), Exhibit C of said Resolution. Resolution No. 25-079 outlines the following:
Identity of the property owner and legal description of parcels being annexed; Receipt and acceptance of the property owner’s Unanimous Approval (petition); Findings that the public convenience and necessity require the annexation; Adoption of the boundary map (Annexation Map);
Types of services that will be funded through the special taxes; Rate and method of apportionment (RMA);
Creation of a new Tax Zone 2 (See Appendix A of the RMA); Authorization/direction to staff to record the Annexation Map and an amendment to the Notice of Special Tax Lien.
Should the City Council move forward with adoption of Resolution No. 25-079, staff will record the Annexation Map and the Amendment to the Notice of Special Tax Lien with the County, and the annexation will be complete.
Moving forward, CFD Annexations will be considered routine in nature and brought forth as Consent Calendar items. Given that this was the first Annexation into CFD No. 2024- 01, and the CFD was first formed nearly a year ago, staff thought it prudent to bring this Resolution as a Written Communication item. In addition to these routine Annexation items, staff will present the annual CFD report prior to June of each year, which report will include a summary of all annexations and proposed rates for the annual levy process, as outlined in the CFD Administrative Policy adopted last year.
Staff respectfully recommends that the Honorable City Council adopt Resolution No. 25- 079 to annex territory to Community Facilities District No. 2024-01 of the City of Victorville (Municipal Services) and to levy the Special Taxes to pay for municipal services and maintenance of certain facilities associated with the Raising Cane’s Development (Annexation No. 1).
Staff is available for any questions Council may have.

Rejection of all bids for Sewer Main Lining Project 2025 - Project No. CC26-018 Recommendation:
That the Honorable City Council reject all bids received for the Sewer Main Lining Project 2025 and authorize staff to reevaluate the scope and readvertise the project.
Fiscal Impact:
There is no fiscal impact associated with rejecting all bids for the Sewer Main Lining Project 2025 as no contract will be awarded at this time, and therefore no expenditures will be incurred. This project is funded entirely from Fund No. 425, Sewer Fund. The budget account number, account description, and amount available in the approved budget are shown below.
Budget Account No. Account Description Amount Available 4254500 - 55315 - 77447 Infrastructure –
Roadway/Pavement
$1,576,514.41
Strategic Plan Goal:
This item aligns with “Goal E Invest in Infrastructure” in the City of Victorville Strategic Plan 2023-2026 by maintaining and rehabilitating critical sewer collection system assets.
Proactively investing in infrastructure helps to extend the life of existing facilities, reduce maintenance costs, and ensure reliable wastewater service to the community.
Background:
Engineering staff recently solicited bids for the Sewer Main Lining Project 2025, which is part of the City’s ongoing wastewater infrastructure rehabilitation program. The project’s purpose is to extend the service life of aging sewer mains through cured-in-place pipe (CIPP) lining and related improvements.

The Notice Inviting Bids was published in the Daily Press on September 3, 2025, and September 10, 2025, and posted on the City’s OpenGov Purchasing Portal. On October 14, 2025, the City received three (3) bids for the project, summarized as follows:
Contractor Location Bid Amount
Southwest Pipeline &
Trenchless Corp
Torrance, CA $2,189,258
Vortex Services, LLC Huntington Beach, CA $2,319,143
Insituform Technologies,
LLC
Chesterfield, MO $2,766,704
Discussion:
The lowest responsive bid received was by Southwest Pipeline in the amount of $2,189,258, which exceeds the available project budget by more than $612,000. An additional appropriation is not currently possible, therefore Engineering and Public Works staff recommend that all bids be rejected at this time.
Staff has identified opportunities to refine the project scope to better align with available funding and operational needs. The project scope and bid schedules will be revised to provide greater flexibility and cost efficiency. Once these revisions are complete, the project will be re-advertised.
Staff recommends that the Honorable City Council reject all bids received for the Sewer Main Lining Project 2025 and authorize staff to reevaluate the scope and readvertise the project as soon as practicable.
Staff is available for any questions Council may have.

Subject:
Discussion and possible action regarding the possibility of a General Transaction and Use Tax measure
Recommendation:
Any action is at the discretion of Your Honorable City Council.
Fiscal Impact:
There is no fiscal impact associated with this item.
Background:
At the City Council meeting of November 4, 2025, it was moved by Mayor Becerra, with unanimous approval, to agendize an item for discussion and possible action, at the soonest Council meeting recommended by staff, to discuss the possibility of a General Transaction and Use Tax measure to support infrastructure and other general municipal services.
Discussion:
This item is being presented to Council so that Council can further discuss the possibility of a General Transaction and Use Tax measure to support infrastructure and other general municipal services.
So that the Council is aware, a General Transaction and Use Tax is what Measure P was approved as at the 2020 general election. As additional information, the current sales tax rate in Victorville is 8.75%. This consists of a Sales and Use Tax (“SUT”) of 7.25%, of which the City receives 1%, a local add-on Transactions and Use Tax (“TUT”) of one-half percent (0.5%) levied by the San Bernardino County Transportation Authority through Measure I and the 1% TUT approved by the Victorville voters as Measure P. 4 0
1 7
While the aggregate TUT currently amounts to 1.5%, the local TUT generally can’t exceed a 2% cap. However, legislation authored by Assembly Member Carrillo and approved by the State Legislature in 2024, authorizes Victorville to increase the cap by 1% until January 1, 2029. Victorville has the ability to advance a new TUT up to an additional
1.5%. Without the special legislation, Victorville could only consider an additional one- half percent (0.5%). Finally, TUT’s must be levied in 0.125% increments.
The general requirements associated with implementing a General Tax are:
An ordinance or resolution, approved by a two-thirds vote of the governing body, which includes a description of the type of tax, tax rate, method of calculation, effective date and date of election. Placement on the ballot for a regularly scheduled general election at which members of the governing body are elected, unless the governing body unanimously votes and declares an emergency justifying the need to place the item before the voters in a special election; and
Approval by a majority of the voters voting in an election on the tax.
If the City Council decides to move forward with the General Tax option, the measure would be submitted to the Elections Office of the Registrar of Voters in accordance with the schedule that is ultimately established for the next general election in November 2026.
Costs associated with a general election are shared with other participating agencies across the county.
Staff remains available for any questions or comments you might have.

Appointment to the vacant seat on the Victorville Planning Commission Recommendation:
That Your Honorable City Council consider appointing Terrance Stone to the Victorville Planning Commission as recommended by Mayor Becerra.
Fiscal Impact:
There is no fiscal impact associated with this item.
Background:
At the City Council meeting of September 2, 2025, it was moved by Mayor Becerra, with unanimous approval to agendize an item for discussion and possible action to appoint a representative to the Planning Commission as we had been notified that Commissioner Kurth would be resigning from the Planning Commission due to him moving out of Victorville.
On September 5, 2025, Rob Kurth submitted his formal letter of resignation for his seat on the Victorville Planning Commission. As required by Government Code Section 54974, a notice of unscheduled vacancy was posted on September 8, 2025. That posting allows the City Council to take action to fill this vacancy 10-days after posting of the notice.
Pursuant to Victorville Municipal Code Section 2.12.030 vacancies shall be filled by appointment for the unexpired portion of the term. Being that Mr. Kurth was Mayor Becerra’s appointee, the unexpired term would be through December 2028.
On October 7, 2025, the City Council considered the appointment of Kenneth Lutz to the vacant position on the Victorville Planning Commission. At that time, Council denied the request to appoint Mr. Lutz to the Planning Commission. At the meeting of November 4, 2025, it was moved by Mayor Becerra, with unanimous approval to agendize an item for discussion and possible action to appoint a representative to the Planning Commission. 4 3
