(2) The release of the Subdivision Improvement Agreement for Tract Map No. 14741; and

Fiscal Impact:

There is no fiscal impact as a result of this action.

Strategic Plan Goal:

This item aligns with “Goal E Invest in Infrastructure” in the City of Victorville Strategic Plan 2023-2026. Although this is not a Capital Improvement Project, we apply the same strategy to private development projects as they are essential in meeting the community’s needs.

Tract Map No. 14741 (Tract 14741) is a 159-lot single family residential subdivision located at the northeast corner of Topaz Road and Luna Road. On May 1, 2018, the City Council approved a Subdivision Improvement Agreement (SIA) secured by improvement bonds with K. Hovnanian Ca Land Holding, LLC, as known as “KHOV”, for tract development. The conditions of approval for the tract required the developer to finalize various infrastructure components; those components being water, storm drain, sewer, street, Landscaping Maintenance Assessment District (LMAD) and monumentation improvements. KHOV has diligently completed all the required public improvements, which have all been accepted by the City Council.

Discussion:

In accordance with Victorville Municipal Code Section 17.64.070(3), the remaining 20- percent of the Faithful Performance Securities were held for a one-year warranty period.

Therefore, staff recommends the full release of the Water, Drainage, Sewer, and Street Improvement Faithful Performance Securities, as the acceptance of the water, drainage, sewer, and street public improvements took place at the regular City Council meeting on July 16, 2024, and there are no open warranty items.

Staff appreciates KHOV being a great development partner. In addition to completing the undeveloped tract, KHOV complied with the City’s punch list, including the resurfacing of Luna Road along the southerly tract boundary.

Given that the public improvements have been completed and accepted by the City Council, staff also recommends the release of the Subdivision Improvement Agreement and the Utility Surety Agreement for Tract 14741.

Staff is available for any questions Council may have.
