RESOLUTION 25-001
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VICTORVILLE
APPROVING THE ESTABLISHMENT OF A RETIREE HEALTH PREMIUM
REIMBURSEMENT PLAN
WHEREAS, the City of Victorville values the service and contributions of its retired employees and seeks to support their continued access to health insurance coverage; and WHEREAS, the City Council desires to establish a Retiree Health Premium Reimbursement Plan to provide financial assistance to eligible retirees for the purpose of offsetting the cost of health insurance premiums; and
WHEREAS, the proposed plan will provide reimbursements for health insurance premiums to eligible retirees, with eligibility determined by City policy based on factors such as years of service, retirement status, and enrollments in a qualifying health insurance plan, as defined in the plan guidelines; and
WHEREAS, the proposed plan is intended to qualify as an accident and health plan, a group health plan and as a health reimbursement arrangement, thereby making the benefits paid to eligible retirees eligible for exclusion from their gross income under IRS Code Section 105(b); and
WHEREAS, the plan will be administered by the City Manager, or designee, and will be subject to annual budget appropriations and eligibility criteria as defined by City policy; and WHEREAS, the administration of the plan may require obtaining and disclosing certain information that is considered protected under the Health Insurance Portability and Accountability Act (HIPPA), and a HIPPA Privacy Policy has been developed and included as Exhibit A to the Retiree Health Premium Reimbursement Plan to ensure proper safeguards are in place. The Cafeteria Plan, in conjunction with this policy, requires the designation of a Plan/Privacy Official, as determined by the City Manager; and
WHEREAS, the City Council determines that adoption of this Retiree Health Premium Reimbursement Plan serves as a recruitment and retention tool, and will provide cost savings to, and is in the best interest of, both the City and its employees.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF VICTORVILLE, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The City Council hereby adopts the Retiree Health Premium Reimbursement Plan effective as of the date of this Resolution.
SECTION 2. The City Council authorizes the City Manager, or designee, to execute the plans and related documents, and to make any designations, minor modifications or non-substantive changes deemed necessary for plan administration.
SECTION 3. This Resolution shall take effect immediately upon adoption.
SECTION 4. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the Office of the City Clerk.
