Sufficient funds are available within the identified account to cover the cost of Change Order No. 1. As the original construction contract was awarded well under budget, no additional appropriations are required.

Strategic Plan Goal:

This item aligns with Strategic Plan Goal E – Invest in Infrastructure, supporting the maintenance and long-term durability of City facilities that provide essential recreational and community services.

Background:

On November 19, 2025, the City of Victorville entered into a construction agreement with Lawrence W. Rosine Co. in the amount of $40,700.00 for the removal of existing flooring and the installation of new flooring materials at the Hook Community Center.

As part of standard flooring installation procedures, the contractor conducted moisture testing of the concrete substrate after demolition of the existing flooring. The test results revealed elevated moisture levels exceeding acceptable tolerances for the specified flooring materials being installed. This condition was not visible or reasonably identifiable prior to demolition and was discovered only after the substrate was exposed.

Discussion:

To properly address the elevated moisture condition, installation of an epoxy moisture mitigation system was required over approximately 5,800 square feet of concrete substrate. This additional work includes specialized materials, labor, surface preparation, and curing time beyond the original contract scope.

If left uncorrected, moisture migrating through the porous concrete could result in flooring failure, including adhesive breakdown, tile cupping, and potential mold or mildew growth.

While the vinyl flooring itself is waterproof, the flooring manufacturer cannot honor the ten (10)-year warranty unless moisture levels are mitigated in accordance with manufacturer specifications.

At the time this condition was identified, the existing flooring had already been removed, leaving exposed substrate areas that constituted a tripping hazard and presented an immediate safety concern. As a result, the Hook Community Center was temporarily closed, impacting preschool and basketball programming.

Pursuant to Victorville Municipal Code Section 2.28.180(b), the City Manager is authorized to approve emergency construction change orders when stopping work would result in severe delays, safety risks, or additional excessive costs. Given the safety concerns, facility closure, and service impacts, the City Manager approved Change Order No. 1 on an emergency basis to allow the project to proceed without further delay.

In accordance with Municipal Code requirements, this item is now being presented to the City Council for ratification of the emergency action taken. 4 5
