SUBJECT: Change Order One - Hook Community Center Flooring Installation- Project CC26-061
Summary:
Approval is requested for a construction change order associated with the Hook Community Center Flooring Installation, Project CC26-061. The City of Victorville entered into a construction agreement with Lawrence W. Rosine Co. for the Hook Community Center Flooring Installation in the amount of $40,700.00, which includes removal of existing flooring and installation of new flooring materials meeting City standards.
During construction, unforeseen site conditions were identified that require additional work beyond the original contract scope to ensure proper flooring installation and long-term performance. This additional work is also necessary to maintain compliance with the manufacturer's ten (10) year warranty.
As part of standard flooring installation procedure, the contractor conducted moisture testing of the existing concrete substrate. Test results indicated elevated moisture levels exceeding acceptable tolerances for the specified flooring materials. This condition was not visible or reasonably identifiable prior to demolition and was discovered only after the substrate was exposed.
To properly address the elevated moisture condition, a moisture mitigation system must be applied. This requires additional work beyond the original contract scope, including moisture mitigation treatment, additional materials and labor, and extended preparation and curing time.
This condition must be addressed to avoid moisture rising from the concrete substrate causing issues such as mold, mildew, tile cupping, and adhesive failure. Although the vinyl tiles themselves are waterproof, moisture trapped in the porous concrete below may still cause these problems. Additionally, the manufacturer cannot honor the ten (10) year warranty, unless the moisture issue is properly mitigated to manufacturer's specification.
Fiscal Impact:
The cost for proposed Change Order 1 is $36,217.74, which includes labor and material to install the epoxy moisture barrier to 5800 square feet of substrate. This brings the project total to $76,917.74. Funding for this change order will be provided from Account No. 105611-55060- 80104. As the original bid was well under budget, sufficient funds are available to cover this expense.
Procurement Process:
The original Hook Community Center Flooring Installation contract was procured in accordance with the City of Victorville's informal bidding procedures and executed following Deputy City Manager approval. This change order does not modify the original procurement method or contractor selection and is limited solely to additional work required due to unforeseen site conditions encountered during construction.
Signing Authority:
Victorville Municipal Code Section 2.28.1 S0(b) - Construction Contract Change Orders states, Provided the funding for the public works project contract has been previously approved and the expenditure of funds authorized by the city council, the city manager shall have the authority to execute change orders; provided however, that if a single contract change order ( or the cumulative amount of change orders on a given public project) exceeds fifteen percent of the total contract price or two hundred thousand dollars (whichever amount is less), the city manager shall obtain city council approval prior to executing the change order. lo emergency situations where stopping the work will result in severe repair or replacement delays and subject the city to additional excessive costs due to project delay, the City Manager is authorized to approve a change order that exceeds these limits. In this instance, the existing flooring has been removed as part of construction activities, leaving exposed substrate areas that constitute a tripping hazard and present an immediate safety concern. Pending City Manager approval, the change order will be presented to the City Council at the January 20, 2026, City Council meeting for ratification.
To ensure the safety of patrons during construction, the Hook Community Center is temporarily closed, which impacts preschool and basketball programming. To avoid further postponement of these programs, staff request that Change Order No. 1 be approved pursuant to the emergency conditions set forth in Victorville Municipal Code Section 2.28.1 S0(b).
