Security Substitution for Tract Map No. 17701
Recommendation:
That the Honorable City Council:
(1) Approve the execution of a Subdivision Improvement Agreement with Crossings at Victorville L.P.;
(2) Approve the execution of a Lien Agreement as improvement security with Crossings at Victorville L.P.;
(3) Release the existing Subdivision Improvement Agreement with Crossings at Victorville L.P.;
(4) Approve the execution of a Release of the existing Utility Surety Agreement with Crossings at Victorville, L.P.; and
(5) Approve the execution of a Partial Release of the existing Land Division Improvement Construction Agreement with Shirley and Charles Westover.
Fiscal Impact:
There is no fiscal impact associated with this item.
Strategic Plan Goal:
This item aligns with Goal E, invest in Infrastructure, in the City of Victorville Strategic Plan 2023-2026. Although this is not a Capital Improvement Project, we apply the same strategy to private development projects as they are essential in meeting the community's needs.
Background:
Tract Map No. 17701 (hereinafter referred to as “Tract 17701”) is located at the southwest corner of Seneca Road and Cahuenga Road. In January 2009, the City entered into a Subdivision Improvement Agreement with Crossings at Victorville, L.P., whose general partner is Investment Concepts, Inc. The developer was conditioned to complete water, 4 4

storm drain, sewer, and street public improvements; however, no improvements have been completed to date. The developer has indicated full intention to complete the required improvements later when development begins.
Discussion:
The developer and owner, Crossings at Victorville, L.P., wishes to enter into a new Subdivision Improvement Agreement with a Lien Agreement as substitute security in accordance with Victorville Municipal Code Section 17.64.060.
Therefore, staff recommends City Council approval of the execution of a Subdivision Improvement Agreement with Crossings of Victorville L.P., acceptance of the Lien Agreement as substitute security, the release of the existing Subdivision Agreement with Crossings at Victorville L.P., the release of the existing Utility Surety Agreement with Crossings at Victorville L.P., and a partial release of the existing Land Division Improvement Construction Agreement with Shirley and Charles Westover.
