RELEASE OF UTILITY SURETY AGREEMENT
WHEREAS, the City of Victorville, (hereinafter called “CITY”, entered into a Utility Surety Agreement with Crossings at Victorville, L.P., a California limited partnership, hereinafter called “DEVELOPER”, pursuant to the provisions of the Subdivision Map Act of the State of California, for the development of the land associated with Tract Map No. 17701, which map subdivided the land described in the attached Exhibit “A”, hereinafter called “PROPERTY”; and
WHEREAS, said Utility Surety Agreement imposed duties, obligations, and requirements on DEVELOPER; and
WHEREAS , said Utility Surety Agreement was recorded on November 4th, 2011, as Document No. 2011-0459961 in the office of the County Recorder of the County of San Bernardino; and
WHEREAS, DEVELOPER has entered into a Subdivision Improvement Agreement and a Lien Agreement with the CITY with respect to development of the PROPERTY; and
WHEREAS , the Subdivision Improvement Agreement and Lien Agreement between the CITY and DEVELOPER, were recorded on ________________, 2026 as Document Nos. __________________ and ______________, respectively, in the office of the County Recorder of the County of San Bernardino.
NOW, THEREFORE, in consideration of the recordation of the Subdivision Improvement Agreement and Lien Agreement between CITY and DEVELOPER, CITY hereby releases Crossings at Victorville, L.P. (DEVELOPER) and its heirs, assignees, or successors in interest from any further duty, obligation, or requirement imposed by the Utility Surety Agreement recorded as Document No. 2011-0459961, and the same is hereby deemed to be of no further force and effect and shall cease to exist as a lien, duty, obligation, or cloud on the title to the PROPERTY described as follows:

I hereby state that the Utility Surety Agreement herein identified is being released in accordance with Title 17 of the Victorville Municipal Code due to the recordation of a new Subdivision Improvement Agreement and Lien Agreement between the CITY and DEVELOPER.
