Subject:

Release of Securities for Tract Map No. 14933
Recommendation:

That the Honorable City Council:
(1) Approve the full release of the Water, Drainage, and Sewer Faithful Performance Securities for Tract Map No. 14933; and
(2) Approve the full release of the Monumentation Faithful Performance Security for Tract Map No. 14933.

Fiscal Impact:

There is no fiscal impact as a result of this action.

Strategic Plan Goal:

This item aligns with "Goal E Invest in Infrastructure" in the City of Victorville Strategic Plan 2023-2026. Although this is not a Capital Improvements Project, we apply the same strategy to private development projects as they are essential in meeting the community's needs.

Background:

Tract Map No. 14933 (hereinafter referred to as "Tract 14933") is a subdivision of 84 single-family lots located at the northwest corner of Pinos Verde Lane and Mesa Linda Avenue. In 2006, Victor Investments, LLC, as the developer of Tract 14933, recorded the map after entering into a Subdivision Agreement and posting securities for the required public improvements. Victor Investments, LLC, began installing the public improvements; however, due to the economic downturn of 2008, development came to a halt. At the regularly scheduled City Council meeting on November 16, 2021, the City entered into a Subdivision Improvement Agreement with Richmond American Homes of Maryland, Inc. (developer). The conditions of approval for the tract required the developer to complete various infrastructure components, including water, drainage, sewer, street and 4 6
1 7
monumentation improvements. The developer has since made significant progress in the development of the tract and at the Regular City Council meeting held on March 18, 2025, the City Council accepted the water, drainage, and sewer public improvements.

Discussion:

In accordance with Victorville Municipal Code Section17.64.070(3), the remaining 20- percent of the Faithful Performance Securities were held for a one-year warranty period, and Labor and Materials Securities was held for a six-month period and was released on November 4, 2025. Therefore, staff recommends the full release, of the Water, Drainage, and Sewer Public Improvement Faithful Performance Securities for Tract Map No. 14933, as the acceptance of the water, drainage, and sewer improvements took place at the Regular City Council meeting held on March 18, 2025 and there are no open warranty items.

Additionally, the required monumentation for the entire tract has been completed.

Monumentation of a tract is the process of placing markers on a surveyed area of land to determine the boundaries of the tract. Monumentation also includes points of streets centerline and right-of-way intersections, the beginning and end of curves, and lot/parcel corners. The engineer of record for Tract 14933 has completed the required monumentation and has received full payment from Richmond American. Therefore, it is recommended that the monumentation security be released in its entirety.

Staff is available to answer any questions Council may have.
