CANCELLATION OF DECLARATION OF COVENANTS, CONDITIONS AND
RESTRICTIONS AND
RELEASE OF NOTICE OF AFFORDABILITY RESTRICTIONS ON TRANSFER OF
PROPERTY
PLEASE TAKE NOTICE THAT the City of Victorville, a Municipal Corporation (the “City”) is the sole beneficiary of that certain Declaration of Covenants, Conditions, and Restrictions (CC&Rs) executed by the City of Victorville Development Department on December 2, 202 1 and recorded on June 8, 2022 as Instrument No. 2022-0208398 in the Official Records of San Bernardino County, C alifornia (the “Affordable Housing Restrictions”), upon that certain real property identified in the Affordable Housing Restrictions and described in the attached Exhibit A (the “Property”) . The Affordable Housing Restrictions were recorded concurrently with the Notice of Affordability Restrictions on Trans fer of Property, executed on December 2, 2021, by Development Department, and recorded on June 08, 2022, as Instrument No. 20 22-0208400 in the Official Records of San Bernardino County, California (the “Notice of Affordability Restrictions on Transfer of Property”).
Pursuant to the terms of the Affordable Housing Restrictions, the City shall execute a release of the encumbrances provided that the homeowner has repaid the Residential Rehabilitation Program loan in full and remitted the accrued interest payment to the City of Victorville . As the preceding conditions have now been met, the City of Victorville hereby terminates the Affordable Housing Restrictions and forever releases the encumbrances of the Affordable Housing Restrictions from the Property. Accordingly, the Notice of Affordability Restrictions on Transfer of Property is also terminated and released.
