Subject:

Reduction of Securities for Tract Map Nos. 16808-1 through 7 Recommendation:

That the Honorable City Council:
(1) Approve the 80-percent release of the Water and Sewer Faithful Performance Securities;
(2) Approve the full release of the Monumentation Faithful Performance Improvement Security; and
(3) Accept the completed water and sewer improvements.

Fiscal Impact:

There is no fiscal impact as a result of this action.

Strategic Plan Goal:

This item aligns with “Goal E- Invest in Infrastructure” in the City of Victorville Strategic Plan 2023-2026. Although this is not a Capital Improvement Project, the City applies the same strategy to private development projects as they are essential in meeting the community’s needs.

Background:

Tract Map No. 16808-1 through 7 (hereinafter “Tract 16808”) constitute a residential subdivision of 241 single-family lots, located at the southeast corner of Nyack Road and Mesa View Drive. On September 7, 2021, the City entered into a Subdivision Improvement Agreement (SIA), secured by improvement bonds, with Richmond American Homes of Maryland, Inc (developer). The SIA required the developer to complete the outstanding public improvements for Phases 1 through 7, as the tract was only partially developed prior to the Great Recession. The conditions of approval required that the developer complete various infrastructure components, including water, 4 6

drainage, sewer, streets, and monumentation. Since that time, the developer has made significant progress in completing the development of the tract.

Discussion:

The developer has met the conditions of approval and has successfully completed all the requirements for the water and sewer public improvements. Therefore, staff recommends that the City Council approve an 80-percent reduction of the Water and Sewer Faithful Performance Securities in accordance with Victorville Municipal Code (VMC) Section

17.64.070(1), as well as accept the completed water and sewer improvements. The remaining 20-percent of the Faithful Performance Securities will be held for the one-year warranty period, in accordance with VMC Section 17.64.070(4).

Additionally, the required monumentation for the entire tract has been completed.

Monumentation of a tract is the process of placing markers on a surveyed area of land to determine the boundaries of the tract. Monumentation also includes the points of street centerline and right-of-way intersections, the beginning and end of curves, and lot/parcel corners. The engineer of record for Tract Nos. 16808-1 through 7 has completed the required monumentation and has received full payment from the developer. Therefore, it is recommended that the monumentation security be released in its entirety.

Staff is available for any questions Council may have.
