Strategic Plan Goal:
This item aligns with “Goal E - Invest in Infrastructure” in the City of Victorville Strategic Plan 2023-2026. Although this is not a Capital Improvement Project, the same strategy is applied to private development projects as they are essential in meeting the community’s needs.
Background:
Tract Map No. 16720 (“Tract 16720”) is a 117-lot single-family subdivision, located at the southeast corner of Eucalyptus Street and Mesa Linda Street. On July 7, 2020, the City 4 6

Council approved a Subdivision Improvement Agreement (SIA), with Victorville 105 Lots, LP., the project owner, an entity that serves as a limited partner in the development.
Securities were accepted as a cash deposit from the project lender, WMMC, LLC. The conditions of approval for the tract required the developer to complete various infrastructure components, including water, drainage, sewer, street, Landscaping Assessment Maintenance District (“LMAD”), and monumentation improvements. The developer has made significant progress in tract development, and at the regular City Council meeting held on March 4, 2025, the City Council approved and accepted the completed public improvements.
Discussion:
In accordance with Victorville Municipal Code Section 17.64.070(4) and the recorded SIA, the remaining 20 percent of the Faithful Performance Securities were held for a one-year warranty period, and the Labor and Materials Securities were held for a six-month period.
Therefore, staff recommends the full release of the Street Improvement Faithful Performance Security for Tract Map No. 16720, as the acceptance of the street public improvements took place at the regular City Council meeting on March 4, 2025 and there are no open warranty items.
Given that the public improvements have been completed and accepted by the City Council, staff also recommends the release of the Subdivision Agreement recorded on August 12, 2020.
Upon review of the most recent title report for Tract Map No. 16720, it was discovered that the prior Subdivision Improvement Agreement and Utility Surety Agreement, both recorded on November 16, 2005, were not released before the execution and recordation of the most recent Subdivision Improvement Agreement, recorded on August 12, 2020.
As the obligations secured under the prior agreements have been superseded by the subsequent agreement and associated securities, staff recommends that the previously recorded agreements be formally released as well.
Staff is available to answer any questions the Council may have.
