RELEASE OF LIEN
UTILITY SURETY AGREEMENT FOR
TRACT MAP NO. 16720
WHEREAS, the City of Victorville, hereinafter called “CITY” entered into a Utility Surety Agreement with Sierra Partners Inc., a California Corporation hereinafter called “DEVELOPER”, pursuant to the provisions of the Subdivision Map Act of the State of California, for the development of Tract Map No.16720, collectively hereinafter called “PROPERTY”; and
WHEREAS, said separate Utility Surety Agreement imposed duties, obligations, and requirements on the City and DEVELOPER; and
WHEREAS, such Utility Surety Agreement was recorded on November 16, 2005, as Document No. 2005-0862154 in the office of the County Recorder of the County of San Bernardino; and
WHEREAS, the DEVELOPER sold the PROPERTY to Victorville 105 Lots L.P, a California Limited Partnership., which executed a new Subdivision Improvement Agreement with the CITY and posted surety bonds per Victorville Municipal Code Sections 17.64.050 and 17.64.060; and
WHEREAS, the new Subdivision Improvement Agreement between Victorville 105 Lots L.P, a California Limited Partnership., and the CITY was recorded on August 12, 2020, as Document No. 2020-0281190 in the office of the County Recorder of the County of San Bernardino.
NOW, THEREFORE, in consideration of the change in ownership of the PROPERTY, the posting of new securities, and the recordation of the new Subdivision Improvement Agreement with Victorville 105 Lots L.P, a California Limited Partnership., as hereinabove stated, the CITY hereby releases DEVELOPER and its heirs, assignees, or successors in interest from any further duty, obligation, or requirement imposed pursuant to the above- reference Document No. 2005- 0862154 and the same are hereby deemed of no further form and effect and shall cease to exist as a lien, duty, obligation, or cloud on the title to the PROPERTY described as follows:

I hereby state that the Utility Surety Agreements herein identified are being released in accordance with Title 17 of the Victorville Municipal Code due to a change in ownership of the PROPERTY, the posting of new securities, and the recordation of a new Subdivision Improvement Agreement with Victorville 105 Lots L.P, a California Limited Partnership.
