On August 11, 2010, a Mortgage Assistance Program (“MAP”) loan was funded in the amount of $20,000.00, and on August 20, 2010, the Deed of Trust secured by a Promissory Note, Notice of Affordability Restrictions on Transfer of Property and Declaration of Covenants, Conditions and Restrictions were recorded against the residence located at 14619 Corey Way, Victorville, CA 92394 (“Property”). 4 7

Discussion:
In March 2015, the principal and equity share had been paid in full, in the amount of $30,479.83, and the associated revenue was recognized in the proper accounts. A Substitution of Trustee and Full Reconveyance was executed and recorded on April 15, 2015.
The City of Victorville, as Housing Assets Successor of the Victorville Redevelopment Agency (“CHAS”), has received a request from Bridge Escrow, Inc. to remove the Declaration of Covenants, Conditions and Restrictions (“CC&R’s) and Notice of Affordability Restrictions on Transfer of Property against the Property. Bridge Escrow, Inc. has confirmed it will pay for any recording fees.
Pursuant to Section 5 of the CC&R’s, the release of the CC&R’s may be requested by the homeowner, or its successors, provided all amounts due and payable to CHAS under the program have been paid. Therefore, since payment has been received in full, staff have prepared the attached Termination of Notice of Affordability Restrictions on Transfer of Property and Cancellation of Declaration of Covenants, Conditions and Restrictions for MAP Case No. 10-07-06.
Staff requests that the Honorable City Council approves the Termination of Notice of Affordability Restrictions on Transfer of Property and Cancellation of Declaration of Covenants, Conditions and Restrictions, and authorizes the Deputy City Manager to execute accordingly.
Staff is available for any questions the Council may have.
