A RESOLUTION OF THE CITY COUNCIL OF T HE CITY OF
VICTORVILLE ACTING IN ITS CAPACITY AS THE GOVERNING
BODY OF VICTORVILLE LANDSCAPE MAINTENANCE
ASSESSMENT DISTRICT NOS. 1, 2, 3, 4, 5, 6, 7, AND 8, APPROVING THE CONSOLIDATED ENGINEER’S REPORT, CONFIRMING THE
DIAGRAM , AND ORDERING THE ANNUAL ASSESSMENTS FOR
FISCAL YEAR 2026/2027
WHEREAS, the City Council (hereinafter the “City Council”) of the City of Victorville (hereinafter the “ City”) has previously formed and levied annual assessments for Victorville Landscape Maintenance Assessment District Nos. 1, 2, 3, 4, 5, 6, 7, a nd 8 ( hereinafter the “Districts”), pursuant to t he provisions of the Landscaping a nd Lighting Act of 1972, Part 2 of Division 15 of the California Streets and Highways Code, Sections 22500 through 22679 (hereinafter the “Act”); and
WHEREAS, the City Council has by adopt ion of Resolution No. 26-033 initiated proceedings to establish the proposed annual assessments for Fiscal Year 2026/2027 (July 1, 2026 – June 30, 2027) and order ed the preparation a Consolidated Engineer’s Annual Levy Report (hereinafter the “Report”) for the Districts pursuant to Chapter 3, Section 22622 of the Act, and has by adoption of Resolution No. 26-033 ( the “Resolution of Intention”) declared its intent to levy and collect assessments within the Districts for Fiscal Year 2026/2027 and set the Public Hearing for June 16, 2026 at 6:00 p.m., in the Victorville City Hall Council Chambers; and
WHEREAS, the City Council has received the Report prepared in connection with the Districts for Fiscal Year 2026/2027; and
WHEREAS, after notice duly given, at the time and place fixed in such notice, a hearing was duly held by the City Council at which all appeals, protests or objections, if any, were duly presented and all persons desiring to be heard thereon were heard, and this City Council gave all persons present an opportunity to be heard in respect to any matter relating to such assessments; and
WHEREAS, all proposed assessments comply with the provisions of Proposition 218 (Article XIIIC and XIIID of the California State Constitution).
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF VICTORVILLE DOES HEREBY FIND, RESOLVE, DETERMINE, AND ORDER AS FOLLOWS:
Section 1. Recitals.
That the recitals set forth above are t rue and correct, and together with the definitions set forth therein, are hereby made part of this Resolution by this reference.
Section 2. Public Hearing and Related Proceedings.
That said public hearing was duly opened on June 16, 2026; that each and every step in the proceedings prior to and including the public hearing has been duly a nd regularly taken; that the City Council is satisfied with the correctness of the diagram and the assessments, the proceedings and all matters relating t hereto and all protests, objections or appeals are hereby overruled a nd denied; and the City Council does hereby confirm said proceedings and said assessments.
Section 3. Final Approval of Consolidated Engineer’s Report.
That the City Council hereby approves the Report (as submitted or amended per Section 22631 of the Act) and the estimated costs of the improvements, the assessment diagram, the assessments, and all other matters contained therein.
Section 4. Improvements Ordered.
That the maintenance work and improvements contemplated by the Resolution of Intention and the Report shall be performed pursuant to law.
Section 5. Levy of Assessments for Fiscal Year 2026/2027.
That pursuant to Chapter 3, Section 22631 of the Act, the adoption of this Resolution shall constitute the levy of assessments for Fiscal Year 2026/2027; that pursuant to Chapter 4, Article 2, Sections 22645 through 22647 of the Act, the San Bernardino County Auditor-Controller shall enter on the County Assessment Roll opposite each eligible parcel of land the amount of assessment so apportioned by the formula and method outlined in the Report, and such assessments shall be collected at the same time and in the same manner as the County taxes are collected, and after collection by the County, the net amount of the levy shall be paid to the City Treasurer of the City of Victorville.
Further, the City hereby authorizes the recovery of applicable County administrative and processing charges associated with placement of the assessments on the tax roll (ATC fees). The amount levied upon each parcel shall include such charges, as permitted by law, in addition to the assessment amounts determined pursuant to the Report.
Section 6. Filing of the Report by City Clerk.
That the City Clerk is hereby ordered and directed to file a certified copy of the diagram and assessment with the San Bernardino County Auditor-Controller, together with a certified copy of this Resolution upon its adoption.
Section 7. Effective Date.
That this Resolution shall be effective immediately upon its adoption.
Section 8. Certification.
That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of the City; and shall make a minute of passage and adoption thereof in the records of the proceedings of the City Council, in the minutes of the meeting at which the Resolution is passed and adopted.
