AND RESTRICTIONS
This TERMINATION OF NOTICE OF AFFORDABILITY RESTRICTIONS ON
TRANSFER OF PROPERTY AND CANCELLATION OF DECLARATION OF
COVENANTS, CONDITIONS AND RESTRICTIONS FOR THE SUCCESSOR TO THE HOUSING ASSETS OF THE VICTORVILLE REDEVELOPMENT AGENCY (“together, Termination Agreement”) is made by the CITY OF VICTORVILLE acting in its capacity as the SUCCESSOR HOUSING AGENCY TO THE REDEVELOPMENT AGENCY OF THE CITY OF VICTORVILLE , (the “Successor Housing Agency”), and dated June 2, 2026, which relates to certain real property as hereinafter defined and described.
RECITALS
A. On August 11, 2010, as the original homebuyer, Melissa McIntyre (“Homebuyer”), purchased a single-family residence located at 14619 Corey Way, Victorville, CA 92394, as such real property is more particularly described in Exhibit A, Legal Description, attached hereto and incorporated herein (“Property”).
B. Homebuyer and the Redevelopment Agency of the City of Victorville entered into that certain Declaration of Covenants, Conditions and Restrictions for the Redevelopment Agency of the City of Victorville Mortgage Assistance Program (“Covenants, Conditions and Restrictions”) dated August 18, 2010, and recorded on August 20, 2010, as Instrument No. 2010-0340629, of the Official Records, County of San Bernardino, State of California (“Official Records”).
C. Homebuyer and the Redevelopment Agency of the City of Victorville entered into that certain Notice of Affordability Restrictions on Transfer of Property (“Notice of Affordability Restrictions”) dated August 18, 2010, and recorded on August 20, 2010, as Instrument No. 2010- 0340630, of the Official Records, County of San Bernardino, State of California (“Official Records”).
D. The Economic Development Department (“Economic Development”) administered the Mortgage Assistance Program (“MAP”), under which said Covenants, Conditions and Restrictions and Notice of Affordability Restrictions on Transfer of Property were recorded.
E. Pursuant to the terms of the Covenants, Conditions and Restrictions , Economic Development shall execute a release of the encumbrances provided that the homeowner has repaid the MAP loan in full and remitted the equity share payment to Economic Development.
PLEASE TAKE NOTICE THAT as the preceding conditions have now been met, Economic Development hereby terminates the Conditions, Covenants and Restrictions and forever releases the encumbrances of the Covenants, Conditions and Restrictions from the Property. Accordingly, the Notice of Affordability Restrictions on Transfer of Property is also terminated and released.
