Fiscal Impact:

There is no fiscal impact associated with this action.

Strategic Plan Goal:

Approval of subject amendment to the Circulation Element of the General Plan will enable the City to further fulfill the following Goals outlined in the 2023-2026 Strategic Plan:
•Goal C: Community and Economic Development – The proposed General Plan Amendment will bring the Circulation Element into consistency with the adopted Civic Center Community Sustainability Plan by reclassifying Valley Park Lane from a Collector roadway to a local roadway. This action supports orderly development and preserves the intended character of the planning area, consistent with the City’s goal to support community vitality and economic well‑being. By ensuring planning documents are aligned, the amendment promotes predictable development patterns and reinforces a cohesive commercial environment

•Goal E: Invest in Infrastructure – Reclassifying the Valley Park Lane roadway ensures that the Circulation Element accurately reflects the functional role of the roadway network within the Civic Center Community Sustainability Plan area and supports the City’s goal of creating a healthy and livable community through responsible infrastructure planning and investment. Additionally, maintaining accurate roadway classifications allows the City to accurately plan, fund, and preserve its roadway system in accordance with Goal E, which emphasizes the expansion, improvement, and preservation of transportation infrastructure.

Background:

General Plan / Circulation Element Overview
The City’s General Plan acts as the City’s long-term blueprint for future development in the City of Victorville and the Circulation Element of the General Plan (Attachment C) establishes the functional classification and general alignment of major roadways within the City and the City’s sphere of influence. While a General Plan and its various elements are designed to guide development for 20 years or more, intermittent updates are sometimes needed to reflect issues such as changing land use patterns, updated traffic analyses, current infrastructure priorities, and State mandates. In comparison to the City’s Development Code, which is intended to establish detailed land use and development standards, the General Plan guides development with broad goals and policies that are then implemented by the Development Code.

Proposed General Plan Amendment
At their regular meeting of June 10, 2026, the Planning Commission recommended that the City Council approve the subject General Plan Amendment to modify the Circulation Element (Planning Case No. PLAN26-00008) by a vote of 4-0 (with one commissioner absent). The proposed amendment to the Circulation Element would remove a segment of Valley Park Lane between Amargosa Road and Civic Drive from the Circulation Map (Attachment D) as a designated Collector roadway and reclassify existing and future improvements of Valley Park Lane as a local roadway. This update would also correct an existing inconsistency between the Circulation Element and the Civic Center Community Sustainability Plan (Attachment E), which does not identify Valley Park Lane as a master-planned Collector roadway. Additionally, the amendment aligns with recommendations from the City Engineer to ensure the Circulation Element accurately reflects current roadway function and long-term mobility needs in the area.

Discussion:

General Plan Amendment Synopsis
The proposed amendment to the Circulation Element of the Victorville General Plan would reclassify the segment of Valley Park Lane between Amargosa Road and Civic Drive from a designated Collector roadway to a local roadway, as illustrated in Attachment B. Valley Park Lane is currently designated as a Collector roadway on the City’s Circulation Map (Attachment C, Page C-5 & Attachment D); however, the Civic Center Community 4 7

Sustainability Plan or the “Specific Plan” (Attachment E), adopted after the existing Circulation Element (Attachment C), identifies a circulation network that functions appropriately without the subject roadway being designated as a Collector roadway. The Specific Plan is supported by a January 2014 traffic study prepared by the City’s Engineering Department, which concluded that Valley Park Lane is not needed to meet long-term mobility needs within the Civic Center area. The study found that the roadway network identified in the Specific Plan is capable of achieving acceptable operational performance based on the standards of the General Plan.

A recent evaluation by the City Engineer (Attachment F) further supports of reclassification of Valley Park Lane as proposed, which notes that maintaining a Collector designation in this location would introduce operational conflicts, including the need for a traffic signal at Amargosa Road and Valley Park Lane that would interfere with a planned and warranted signal at Amargosa Road and Kimberly Drive. Reclassifying Valley Park Lane as a local roadway avoids these conflicts and better reflects how the corridor functions today.

Environmental Assessment
The proposed General Plan Amendment is exempt from the California Environmental Quality Act (CEQA) under Section 15061(b)(3), as there is no possibility that the update would result in a significant environmental effect. The action is administrative in nature and consists only of removing Valley Park Lane’s Collector designation and reclassifying it as a local roadway. It does not authorize construction, change roadway capacity, or alter land use intensity.

Because Valley Park Lane is already not identified as a master-planned Collector roadway in the Civic Center Community Sustainability Specific Plan, and the supporting circulation analysis confirms it is not needed to meet long-term mobility needs, the amendment merely reconciles existing policy documents. As no physical improvements are proposed or required, it can be determined with certainty that no environmental impacts would occur.

Resulting Impacts
Given that a portion of Valley Park Lane west of Civic Drive has been constructed and currently operates as a retrofit Collector roadway, approval of the proposed General Plan Amendment would not impact existing improvements, which would remain in place under the proposed reclassification. Future development along the corridor would continue to be subject to frontage improvement requirements consistent with Victorville Municipal Code Section 9.32.040, unless an alternative design is approved that results in the roadway terminating before its intersection with Amargosa Road.

Overall, the amendment aligns the Circulation Element with adopted planning documents, reflects updated engineering analysis, and ensures the City’s roadway classifications correspond with actual and anticipated transportation needs in the Civic Center area. 4 7

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VICTORVILLE APPROVING GENERAL PLAN AMENDMENT CASE NO. PLAN26 -00008, AN

AMENDMENT TO THE CIRCULATION ELEMENT OF THE CITY OF VICTORVILLE

GENERAL PLAN WITH AN ENVIRONMENTAL EXEMPTION TO REMOVE VALLEY

PARK LANE AS A DESIGNATED COLLECTOR ROADWAY, LOCATED BETWEEN AMARGOSA ROAD AND CIVIC DRIVE AND APPROXIMATELY 1,200 FEET SOUTH

OF ROY ROGERS DRIVE

WHEREAS, the City of Victorville has initiated an amendment to the Circulation Element of the General Plan pursuant to Section 16-2.01.020 of the Victorville Municipal Code; and
WHEREAS, the Planning Commission held a public hearing on the 10th day of June, 2026, pursuant to Title 7, Division I, Chapter 3, Article 6 of the Government Code of the State of California, to hear arguments for and against the project, and after hearing all verbal and written testimony offered, and after thoroughly reviewing and considering the project, the Planning Commission approved Resolution No. P-26-011 by a vote of 4-0, which recommended to the City Council the adoption of a General Plan Amendment specified in Planning Case No. PLAN26-00008; and
WHEREAS, a public hearing was duly held before the City Council of the City of Victorville on the 21st day of July, 2026, pursuant to Title 7, Division I, Chapter 3, Article 6 of the Government Code, State of California, and Section 16-2.05.010 of the Victorville Municipal Code for the purpose of taking public input relative to the General Plan Amendment; and
WHEREAS, the City of Victorville maintains a Circulation Element within its General Plan that establishes the functional classification and general alignment of major roadways throughout the City; and
WHEREAS, Valley Park Lane is currently designated as a Collector roadway on the City’s Circulation Map; and

2 WHEREAS, the Civic Center Community Sustainability Specific Plan does not identify Valley Park Lane as a master -planned Collector roadway, resulting in an inconsistency between adopted planning documents; and
WHEREAS, the circulation analysis supporting the Civic Center Community Sustainability Specific Plan determined that Valley Park Lane is not needed to meet long-term mobility needs in the Civic Center area; and
WHEREAS, the Planning Commission found and the City Council concurs that redesignating Valley Park Lane as a Local roadway will align the General Plan with the adopted Civic Center Community Sustainability Specific Plan and more accurately reflect the roadway’s intended function within the City’s circulation network; and WHEREAS, the Planning Commission found and the City Council concurs that the proposed General Plan Amendment is consistent with the goals and objectives of the Circulation Element of the General Plan as it implements Goals 1, 2, & 3, that seek good mobility, an efficient multi -modal transportation network, and adequate infrastructure, which this amendment will continue to maintain; and WHEREAS, the City Council finds on their own independent judgment that this project is exempt from the California Environmental Quality Act (CEQA) based upon CEQA Guidelines Section 15061(b)(3), as there is no possibility that the proposed General Plan amendment will have a significant effect on the environment inasmuch as the proposed amendment to reclassify Valley Park Lane from a Collector to a local roadway serves to reconcile the General Plan with the adopted Civic Center Community Sustainability Specific Plan, does not authorize construction or increase roadway capacity, does not require physical improvements, and therefore has no potential to result in an environmental impact; and

3 WHEREAS, the City Council finds that all materials that constitute the record of proceeding upon which its decision is based shall be located with the City of Victorville Clerk, located at 14343 Civic Drive, Victorville, California; and WHEREAS, after hearing all verbal and written testimony offered, including the Planning Commission’s recommendation and minutes, and after thoroughly reviewing and considering the proposal, the City Council, in the exercise of its discretion as the final legislative and adjudicatory body of the City, p ursuant to Title 7, Division I, Chapter 3, Article 6 of the Government Code of the State of California and Section 16-2.05.010 of the Victorville Municipal Code, based on substantial evidence in the record, votes to approve General Plan Amendment Case No. PLAN26-00008.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF VICTORVILLE DOES HEREBY ORDAIN AS FOLLOWS:

Section 1. Recitals.

The recitals set forth above are true and correct and are hereby incorporated by this reference as if set forth in their entirety.

Section 2. Effective Date.

This Resolution shall take effect immediately upon passage.

Section 3. Severability.

The City Council declares that, should any provision, section, paragraph, sentence or word of this Resolution be rendered or declared invalid by any final court action in a court of competent jurisdiction or by reason of any preemptive legislation, the rem aining

4 provisions, sections, paragraphs, sentences or words of this Resolution as hereby adopted shall remain in full force and effect.

Section 4. General Plan Amendment.

The Circulation Map of the Circulation Element of the City of Victorville General Plan shall be updated to reclassify the segment of Valley Park Lane located east of Civic Drive and west of Amargosa Road from a Collector to a Local roadway.

Circulation Element

PURPOSE OF THIS ELEMENT
The Circulation Element is one of the re-
quired General Plan elements identified in
State Planning and Zoning Law. As speci-
fied in California Government Code (Section
65302(b)), a Circulation Element is required
to identify the general location and extent of
existing and proposed major thoroughfares,
transportation routes, terminals, airports
and other local public utilities and facilities
in the City’s Planning Area. This Element is
intended to provide guidance to decisions
that expand and improve the transportation
system for local and regional trips, and to
accommodate the diverse transportation
needs of the residents of the Planning Area.

Furthermore, this Element is intended to
specify the City’s policies for coordination of
transportation infrastructure planning with
planning of public utilities and facilities,
where joint benefits can be achieved.

A well-planned circulation system is an es-
sential component of the community infra-
structure that supports and can determine
the general pattern of settlement. Con-
versely, the location, type and intensity of
development determine, to a major extent,
the physical parameters of the transporta-
tion system, especially the local roadway
network. Failure to achieve an efficient
roadway network could have negative eco-
nomic consequences that could adversely
affect the quality of life for local residents
and businesses. The design, location and
constituent modes of travel can have signifi-
cant effects on air quality, plant and animal
habitat, environmental noise, energy use,
and community appearance. Both economic
and environmental considerations have
been incorporated into the development of
this Circulation Element.

RELATIONSHIP TO OTHER ELE-
MENTS
Land use policy depends upon and as-
sumes there is an integrated circulation sys-
tem to effectively move people and goods in
and through the Planning Area. A primary
purpose of this element is to correlate the
transportation network with the land use
plan, so that movement of people and
goods is maintained in an efficient manner,
with a minimum of congestion. This correla-
tion is achieved, in part, through a projec-
tion of roadway system capacity require-
ments associated with the mixture, location
and intensity of land uses envisioned in the
land use element. Those projections have
been translated into roadway design stand-
ards and the distribution of roadway classifi-
cations and transportation infrastructure
throughout the planned circulation network.

Please refer to the Circulation Plan de-
scribed later in this Element.

To the extent that the Circulation Plan
(“Plan”) is successfully implemented, traffic
will move efficiently through the Planning
Area, with minimal congestion. Minimizing
congestion will yield air quality benefits, be-
cause automobiles and trucks that flow
smoothly along roadways, as opposed to
slow/stop/start conditions, operate more
efficiently and generate lower volumes of air
pollutants through their exhaust systems.

The Plan is also designed to foster develop-
ment of mixed uses, compact development
patterns, transit-oriented development, and
to facilitate use of alternative modes of trav-
el that reduce total trips by single-
passenger automobiles. The combination
of these land use strategies, together with a
circulation network that will support those
strategies, will help reduce total vehicle
miles traveled, thereby reducing total vehic-
ular exhaust emissions. These air quality
benefits are directly correlated with goals,
policies and objectives relating to air quality
in the Resources Element.

Traffic modeling developed in support of
this updated Circulation Element was ap-
plied to the assessment of noise impacts

associated with implementation of the pro-
posed Circulation Plan. This effort has sup-
ported development of the Noise Element
policy framework to protect existing and fu-
ture residents and other noise-sensitive
land uses from the adverse effects of expo-
sure to excessive traffic noise. Results of
traffic forecast modeling were also consid-
ered in the development of air quality man-
agement strategies, in the Resources Ele-
ment.

VISION – CIRCULATION
A long-term, sustainable transportation sys-
tem serving the Victorville Planning Area is
envisioned as one that:

 Provides safe and efficient travel
modes and facilities that enhance
access for residential and business
communities, including those with
special needs;
 Satisfies the transportation infra-
structure needs of existing and fu-
ture travel demands and the move-
ment of economic goods, with con-
venient, multi-modal alternatives;
 Achieves a high level of mobility for
the movement of goods and people,
in a cost-effective manner, without
serious consequences to the envi-
ronment;
 Is coordinated with and effectively
integrated into regional transporta-
tion systems;
 Develops infrastructure systems that
are coordinated with transportation
networks and support Victorville’s
residential and business communi-
ties.

ANALYSIS OF BASELINE CONDI-
TIONS

Existing Transportation System

Regional Setting

Located in the heart of San Bernardino
County, the Planning Area for the City of
Victorville includes its sphere of influence as
illustrated in Figure Circ-1. It is located
approximately 35 miles northeast of the City
of San Bernardino and about 97 miles
northeast of the City of Los Angeles. Nes-
tled just north of the San Bernardino Moun-
tains and at the edge of the Mojave Desert,
the City is in an area known as Victor Valley
and commonly referred to as the “High De-
sert”. The City shares boundaries with the
City of Adelanto to the northwest, the Town
of Apple Valley to the east, the City of Hes-
peria to the south and unincorporated San
Bernardino County to the southwest and to
the north. There are also portions of unin-
corporated San Bernardino County nested
within the City of Victorville. The Mojave
Freeway (Interstate 15 or I-15) and United
States Federal Highway 395 (US-395)
serve as the primary regional connections
to other San Bernardino County cities, while
State Route 18 (SR-18) provides connec-
tion to San Bernardino County communities
east and west of the City. In addition, major
rail routes pass through the City and South-
ern California Logistics Airport (SCLA) is a
commercial airport in place of the decom-
missioned George Air Force Base.

the employment and retail needs of the
more than 300,000 people who call the Vic-
tor Valley area their home. Victorville is

shopping center between San Bernardino
and Las Vegas, located along the I-15 cor-
ridor. It is an emerging commercial hub
that benefits from its business-friendly envi-
ronment and central location.

Southern California Logistics Airport

Victorville is strategically situated along the
“e·Corridor” (a portion of the I-15 between
Ontario and Barstow), with global access
provided by the all-cargo. Southern Califor-
nia Logistics Airport (SCLA). SCLA is lo-
cated in the northwest corner of the City of
Victorville and is within 30-40 minutes of
driving from the Ontario International Air-
port. It is planned to be a domestic and
international air cargo facility, with a 4,740-
acre business complex integrating manu-
facturing, industrial multimodal and office
facilities. The SCLA Specific Plan was
adopted by the City to provide a planning
tool for implementing the reuse plan estab-
lished by the Victor Valley Economic Devel-
opment Authority (VVEDA) pursuant to the
Base Closure Realignment Act (BCRA),
and to implement related policies of the
General Plan Land Use, Noise and Safety
Elements. The SCLA Specific Plan is de-
signed to accommodate airport and avia-
tion uses as well as industrial and commer-
cial land uses. Its circulation plan includes
establishing a mass transit system to serve
the site; designating Phantom Road as a
minimum six-lane Super Arterial to connect
to Air Expressway; introducing a new north/
south road, ‘Perimeter Road’ which will
connect future Colusa Road from the north
to Phantom East Street to the South; and
upgrading several roads to arterials, which
will eventually connect Phantom East and
West Street to the rest of the site.

Existing Roadway Network

The City’s circulation system is comprised
of freeways and their interchanges, arterial,
collector and local streets, public transpor-
tation and non-motorized transportation. In
addition to these facilities and services, the
implementation and management of the
circulation system includes parking policies
and goods and freight movement.

Non-Motorized Transportation Plan

In 2011, the City Council of the City of Vic-
torville approved, by Resolution No. 10-
052, a non-motorized transportation plan
for bikeways and pedestrian trails. The plan
was initiated by the City’s Public Works De-
partment when they applied for and were
awarded a grant from the Southern Califor-
nia Association of Governments (SCAG).

The plan utilizes existing and future road-
ways, paseos, washes, utility corridors, the
California Aqueduct and the Mojave River
Walk to form an interconnecting network of
trail and bikeways. This non-motorized
transportation plan helps in meeting the
goals and objectives of the General Plan
and guides the future, orderly development
of trails and bikeways, by requiring devel-
opers to install the segments adjoining their
projects.

Complete Streets

The term complete streets describes a
comprehensive, integrated transportation
network with infrastructure and design that
allows safe and convenient travel along
and across streets for all users, including
pedestrians, bicyclists, persons of disabili-
ties, motorist, trucks, emergency services
and public transportation. The Circulation
Element will balance the needs of automo-
biles with the needs of pedestrians, bicy-
clists, and public transit services.

The City of Victorville recognizes the im-
portance of Complete Streets infrastructure
and modifications that enable safe, conven-
ient and comfortable travel for all catego-
ries of users. Implementation of complete
streets will happen over time and evolve
the City’s current street network into multi-
modal streets that offer safe and attractive
choices of travel options throughout the
City. This will be accomplished through the

implementation of updated roadway sec-
tions and the retrofit of existing street net-
works that embody the principles of com-
plete streets.

Figure Circ-2 illustrates the circulation net-
work through build-out year 2035, including
the City’s local thoroughfares and limited
access freeways. Regional access to the
City of Victorville is provided primarily by
the I-15 freeway and several other high-
ways.

MAJOR CIRCULATION

COMPONENTS
Freeways

Interstate 15

Over the years, I-15 has emerged as a mul-
ti-faceted corridor, serving commuters in
the cities of the Victor Valley. For the City,
it provides access to and from Riverside
County to the south and Barstow, continu-
ing to Nevada, to the north. Also called the
Mojave Freeway, this is a major north-
south corridor, with three lanes through Vic-
torville in each direction. According to the
California Department of Transportation
(Caltrans), the section of the I-15 within
Victorville carried an annual average daily
traffic (AADT) of 60,000 to 104,000 vehi-
cles in 2006, of which approximately 17%
to 24% was comprised of truck traffic. In
Victorville, seven full-service interchanges
with the I-15 are currently provided at the
following streets:

 Bear Valley Road
 Palmdale Road (SR-18) / 7th Street
 Roy Rogers Drive / La Paz Drive
 Mojave Drive
 National Trails Highway / D Street
 E Street
 Stoddard Wells Road
 Stoddard Wells Road North (Sphere
of Influence)
 Dale Evans Parkway (Sphere of In-
fluence proposed)

I-15 Comprehensive Corridor Study

A Major Investment Study (MIS) examined
potential improvements on I-15 between
the State Route 60 (SR-60) interchange in
Mira Loma (Riverside County) and the Mo-
jave River crossing in Victorville. This effort
evaluated possible solutions to problems of
higher than average truck volumes (10 to
15% of total traffic), steep grades ap-
proaching 6% through the Cajon Pass,
roadway design limitations particularly at
the I-15/I-215 interchange, heavy traffic de-
mand on both weekdays and weekends,
and limited alternative travel options. Five
alternatives were selected for detailed eval-
uation, from an initial set of nine alterna-
tives, including:

A. No-Build;
B. Transportation Demand Management /
Transportation System Management
(TDM/TSM);
C. High Occupancy Vehicle (HOV) Lanes;
D. Full Corridor Dedicated Truck Lanes;
and
E. Reversible Managed Lanes.

The Southern California Association of
Governments (SCAG), San Bernardino As-
sociated Governments (SANBAG), and the
California Department of Transportation
(Caltrans) jointly sponsored this study. The
Final Report was completed December 20,
2005. Based on the report findings, two
alternatives will be carried forward for fur-
ther corridor development efforts: Alterna-
tive D and Alternative C/E hybrid.

New Interchanges

A new interchange is being planned at Eu-
calyptus Street, approximately 1.2 miles
south of I-15/Bear Valley Road Interchange
and about 2.3 mi north of the I-15/Main
Circulation

Street Interchange. This is a joint project
between the City of Victorville and the City
of Hesperia. This project is intended to re-
duce congestion at the Bear Valley Road
interchange and Main Street interchange,
and is expected to reduce operational con-
flicts, accidents and provide levels of ser-
vice that are consistent with the goals of the
local components of the countywide Con-
gestion Management Plan. A Project Study
Report/Project Development Support (PSR/
PDS) for this new interchange was ap-
proved by Caltrans on May 18, 2005. There
has been no further activity on the project
since approval of the PSR/PDS.

U. S. Highway 395 – Alignment

U.S. Highway 395 is a second north-south
highway that passes through the western
part of the City. Predominantly a two-lane
highway, this facility has a stretch of four
lanes just south and north of its intersection
with Palmdale Road. In the City of Vic-
torville, it currently has eight at-grade inter-
sections with the following arterials:

 Eucalyptus Street
 Sycamore Street
 Bear Valley Road / Duncan Road
 Dos Palmas Road
 Luna Road
 Palmdale Road
(SR-18)
 Mojave Drive
 Cactus Road

Caltrans traffic data shows that for Vic-
torville in 2006, this facility carried an AADT
of approximately between 16,000 and
25,000 vehicles, of which about 13% to
18% was truck traffic. With the southern
terminus of this facility at its junction with I-
15 in the City of Hesperia, this facility con-
nects the City of Victorville to the City of Ad-
elanto and unincorporated northwestern
San Bernardino County, before continuing
on to adjacent Kern County.

This alignment within the City of Victorville,
from the aqueduct to Adelanto / Hopland
Road (about 6.9 miles in length) is two-lane
with existing 4-lane segments as follows:

 1.3 miles, south of Eucalyptus
Street to Bear Valley Road (1.4
miles long)
 Luna Road to 0.3 miles north of
Palmdale Road (1.3 miles long).

A memorandum of understanding (MOU)
regarding the existing US-395 among Vic-
torville, Caltrans, SANBAG, San Bernardino
County, Hesperia and Adelanto became
effective on October 18, 2002. The MOU
established US-395 in the local agency gen-
eral plans as a 6-lane conventional highway
with the minimum right of way width of 130
feet. Typical cross sections for segments
and signalized intersections are included in
the MOU. Development projects adjacent to
or with significant impacts to US-395 are
required to submit a traffic report to the Cal-
trans District 8 Intergovernmental Review
California Environmental Quality Act (IGR/
CEQA). Projects are subject to the IGR/
CEQA review process and required to rea-
sonably mitigate impacts.

Caltrans is the lead agency and is proceed-
ing with the Project Approval / Environmen-
tal document to widen the existing US-395
from two to four lanes from I-15 to SR-58.

State Route 18

The existing SR-18 is a four-lane divided
highway with turn lanes in the Town of Ap-
ple Valley, where it is also called Happy
Trails Highway, and a four-lane divided road
with a continuous left turn lane through
most of the City of Victorville (D Street).

When SR-18 joins I-15, travelers must fol-
low I-15 south to Palmdale road, where SR-
18 proceeds west and is called Palmdale
Road. A designated truck route within the
City of Victorville, this facility carried an
AADT of 19,000 to 48,000 vehicles in 2006,
of which approximately 7% to 9% was truck
traffic. SR 18 provides access to and from
Antelope Valley to the west and the Town of
Apple Valley, continuing further eastward to
Lucerne Valley.

High Desert Corridor

This proposed project will realign SR-18 to
a new alignment from about one mile south
of Yucca Loma Road in the Town of Apple
Valley, through the City of Victorville, to US-
395 in the City of Adelanto. It would be the
first phase of the 21-mile long High Desert
Corridor linking the Victor Valley to SR-14 in
the Antelope Valley. The proposed align-
ment proceeds northwest until it nears the
Apple Valley Airport, where it turns west.

The alignment continues west near SCLA in
the City of Victorville and proceeds on to US
-395. The new facility will be a four-lane
expressway between the connection to ex-
isting SR-18 and I-15 with at-grade intersec-
tions and an interchange at I-15. From I-15
to US-395, the facility will be a six-lane free-
way with grade separated interchanges at
Phantom East, Phantom West and either
Adelanto Road and existing US-395.

The project is jointly funded by Caltrans,
using Federal Demonstration and Measure I
funds. Caltrans is the lead agency. Prepa-
ration of the Project Approval and Environ-
mental Document (PA/ED) began in 2003.

The Final Environmental Impact Report/
Environmental Impact Statement was com-
pleted in 2016.

Historic Route 66

One of the original federal routes, Route 66
or Will Rogers Highway was established in
1926. Its original length of approximately
2,500 miles connected the cities of Chicago,
Illinois and Los Angeles, California, travers-
ing through the states of Missouri, Kansas,
Oklahoma, Texas, New Mexico and Arizo-
na. As a major migratory path west, espe-
cially during the Dust Bowl of the 1930s, it
supported the economies of the communi-
ties through which it passed. These com-
munities later fought to keep it alive when
the new interstate freeway system began
dominating the country’s transportation net-
work. This route was officially decommis-
sioned after the interstate freeways began
to define this country’s surface transporta-
tion and segments of this route that were
not replaced by interstate freeway align-
ments were designated as national scenic
byways and renamed ‘Historic Route
66’ (Hist-66).

Today, from the southern limit of the City of
Victorville, Hist-66 follows the current align-
ment of I-15 to the freeway’s interchange
with Palmdale Road (SR-18) / 7th Street.

North of this interchange, Hist-66 follows
the alignment of 7th Street to D Street.

Continuing northeast on D Street it follows
the National Trails Highway alignment into
the community of Oro Grande on the north-
western edge of the City
.

Roadway Classifications

There are several different types of roadway
classifications maintained by the City of Vic-
torville that range from two lane, undivided
collectors to super arterials with six lanes
and a positive separation (raised median).

The City has developed design standards
and specifications for six different street
classifications, which are illustrated by their
standard cross-sections and, if applicable,
modified retrofit cross-sections shown in
Figure Circ-3, and described below.

Retrofit cross-sections are typically existing
roadways that are modified to include bicy-
cle lanes within existing right-of-way widths.

The roadways are designated by their pri-
mary function and level of mobility. The typ-
ical roadway cross-sections illustrated in
Figure Circ-3 are general standards and in
certain cases, where implementation of the
standard street width may not be possible
due to various constraints, such as right of
way, existing development, etc., these may
be modified, subject to the approval of the
City Engineer. Where unavoidable con-
straints exist, right-of-way dedication, medi-
an, shoulder, lane widths and other features
may be modified to the non-desired widths
but still provide the functionality and safety
designated in standard roadways. The
function of the street will still remain the
same to serve the City’s traffic demand.

Super Arterials

Super Arterials transport large volumes of
intercity, intra-city, and regional traffic at
higher speeds with limited access control
points. Super arterials generally connect to
freeways to distribute traffic to other facili-
ties such as major and secondary arterials,
and collector facilities serving the City and
other regional networks. At a minimum, de-
velopment of new segments of super arteri-
als shall have a 128-foot wide right of way
consisting of six travel lanes, two bicycle
lanes with traffic buffers, and a raised medi-
an up to fourteen feet in width.

Super arterials can also have the lane con-
figuration of six travel lanes with additional
right turn lanes at intersections. This lane
configuration requires a 145 foot wide right
of way. At intersections, the super arterial
can have a double left within the center me-
dian area, three through lanes and a right
turn lane.

Existing roadways, or as specified on Figure
Circ-2, will utilize a “Retrofit” roadway clas-
sification, which provides the same six
lanes, bike lanes and sideways at non-
preferred widths within existing right-of-way.

Currently, this category includes Bear Val-
ley Road east of Petaluma Road. The
City’s recently updated Circulation Map at
build-out indicates that the full extent of
Bear Valley Road, Palmdale Road, Mojave
Drive, and US-395 are designated as Super
Arterials.

Major Arterials

Major Arterials facilitate mobility of large
volumes of intra-city traffic. These streets
access freeways or super arterials and dis-
tribute traffic to secondary arterials or col-
lector streets. Major Arterials have a 102-
foot minimum right of way consisting of a
minimum of four travel lanes, two bicycle
lanes with traffic buffers, and a raised medi-
an up to fourteen feet in width. Traffic sig-
nals are located at major intersections. Ex-
isting major arterials in the Planning Area
include: 7th Street, Amethyst Road, El
Evado Road, Green Tree Boulevard, Hes-
peria Road, and La Mesa Road east of Am-
ethyst Road.

Residential Arterials

Residential Arterials transport large vol-
umes of intra-city traffic to and from residen-
tial areas. These streets connect to major
arterials, arterials, and collectors. Residen-
tial arterials have a minimum right of way of
one-hundred feet, four traffic lanes with up
to a twelve foot raised median, and a Class
1 two-way bicycle and pedestrian path on
one side of the street. Traffic signals are
located at major intersections. La Mesa
Road west of Amethyst Road is the only
designated Residential Arterial.

Arterials

Arterials serve the same function as Major
Arterials, although serving relatively lower
traffic demands. The standard 98-foot right
of way contains four travel lanes with a cen-
ter left turn lane, and two bicycle lanes with
traffic buffers. Left-turn and right-turn lanes
are provided, at master planned intersec-
tions. Some of the Arterials in Victorville
include Amargosa Road, Eagle Ranch
Parkway, Hook Boulevard, Mariposa Road,
Mesa Linda Avenue, Topaz Road, Village
Drive, and most of El Evado Road.

Secondary Arterials

Secondary Arterials are localized in the Old
Town area, situated in the northeastern part
of the City, bounded by I-15 in the west,
Hesperia Road in the east, Mojave Drive/
Verde Road in the south and to the north by
E Street. The right-of-way width of these
existing roadways vary to provide facilitates
such as wider sidewalks, on-street parking
and two-to-four travel lanes. 7th Street be-
tween Forrest Avenue and D Street is the
only Secondary Arterial
.

Collectors

Collectors are street that provide circulation
within a defined geographic area and con-
nect this area to intra-city traffic routes.

Some motorists may use collectors as
through routes, but the primary function of a
collector is to connect local traffic to larger
streets and to provide access to nearby
destinations.

Collectors contain two travel lanes, center
turn lane and two bicycle lanes with a 68-
foot right of way. Alternatively, collectors
may have two travel lanes and parking with-
out a center left turn lane when located
away from intersections. Collector streets in
the Planning Area include 1st Avenue, 9th
Avenue, Cobalt Road, Cypress Avenue,
Luna Road, Pacoima Road, Reno Loop,
Sycamore Street, and Tawney Ridge Lane.

Local Streets

Local Streets provide direct access to adja-
cent properties and transport local traffic
from these properties to higher volume,
higher speed facilities. In general, local
streets are not intended to carry through
traffic. The 60-foot right of way contains
two traffic lanes and two parking lanes.

Sidewalks are generally provided within a
ten-foot, right of way. Most streets in resi-
dential neighborhoods are designed as Lo-
cal Streets. The local roadway classification
standard, as shown in FIGURE Circ-3b,
provides two options for parkway design.

Option #1 has parkway landscape area be-
tween the curb/gutter and sidewalk, and this
option shall only be utilized when a develop-
er demonstrates sufficient means to main-
tain this landscape area, as approved by
the Planning Commission.

Roadway Components

Super Arterial Components

Traffic Signals – Super Arterials

Locations for new traffic signals shall be at
a minimum of one-half mile spacing, or at
master planned intersections (collector
street classifications or above). Proposed
traffic signal locations shall be justified by a
traffic study and are subject to the approval
of the City Engineer.

Driveway Access – Super Arterials

Residential driveway access is not allowed
from a super arterial, unless approved by
the City Engineer for a large multi-family
residential project. Commercial driveway
access, if allowed, should be as far away
from a street intersection or other driveways
as feasible. Shared driveway access with
other parcels or other developments may be
required. If a commercial driveway access
is allowed, an additional number 4, merge
in / merge out, lane is required. New drive-
way access shall allow right in / right out
access only. Left turns in and out shall be
prohibited. The design of the access con-
trol, whether raised median or other con-
trols, is subject to the approval of the City
Engineer.

Street Connections – Super Arterials

New street connections to super arterials,
including Bear Valley Road, Mojave Drive,
Palmdale Road and US-395 will be restrict-
ed. Only streets classified as collector or
higher may connect to a super arterial. No
new local street connections shall be al-
lowed.

Major Arterial, Arterial and Collector
Street Components

Traffic Signals – Major Arterial, Arterial
and Collector Street

Proposed traffic signals locations shall be
justified by a traffic study and are subject to
the approval of the City Engineer.

Driveway Access – Major Arterial, Arte-
rial and Collector Street

Residential driveway access is not allowed
to new segments or for new subdivisions
fronting on existing segments. For infill sin-
gle family homes on existing segments, for-
ward egress for residential driveways is re-
quired by either a standard circular or ham-
merhead driveway. Commercial driveway
access should be as far away from a street
intersection or other driveways as feasible,
or connect to a street of lower classification.

Shared driveway access with other parcels
or other developments may be required. To
accommodate commercial driveway access,
an additional merge in / merge out may be
required. New driveway access may be re-
stricted to right in / right out access only, or
left turns out may be prohibited. The design
of the access control, whether raised medi-
an or other controls, is subject to the ap-
proval of the City Engineer. Full access
driveways, if allowed, should line up with
driveways on the other side of the street.

Intersections

At intersections of collector or larger road-
way classifications with another collector or
larger roadway classification, additional
right turn lanes shall be accommodated
within 100-500 feet of such intersections, as
approved by the City Engineer. The City
may require augmentation at existing inter-
sections that necessitates requirements in-
cluding dedication of additional right of way,
relocation of existing facilities, road widen-
ing, medians, restriping, signage changes
and traffic signal modifications. The City
may also require augmentation of new inter-

sections that necessitates requirements
above the minimum standards including
dedication of additional right of way, reloca-
tion of existing facilities, road widening, me-
dians, striping, signage changes and traffic
signal construction.

The additional turn lanes may be master
planned by the City or justified by a traffic
study subject to the approval of the City En-
gineer.

Segments

Standard roadway classification widths and
cross sections can be modified as dis-
cussed below to accommodate additional
merge in / merge out lanes for driveway ac-
cess. School site or commercial site access
may also necessitate additional center turn
lanes or parking lanes and thus additional
right of way dedication, relocation of exist-
ing facilities, road improvements, medians,
striping, signage,

Alignments

The alignment of roads on the Circulation
Map is not depicted as precise alignments.

Most of the arterial and collector alignments
in the City have been laid out along section
lines or half section lines. Usually, the cen-
terline of the right of way is located on or
between property lines. Usually, arterial and
collector roads are straight. However, sev-
eral constraints can dictate arterial and col-
lector road alignments that may shift the
alignments, introduce reversing curves or
result in slight skews at intersections. The
constraints can include, crossing SCE or
LADWP power line easements, meeting
clearance requirements for SCE or LADWP
transmission towers or transmission lines,
crossing or running parallel to major wash-
es, crossing the aqueduct, avoiding the re-
location of major utilities or avoiding impacts
to existing development.

Public Transportation

Public transportation (bus and train) pro-
vides an alternative means of travel to the
automobile and offers additional mobility
choices, while making more efficient use of
available roadway capacity. Transit service
in the Victor Valley area has expanded from
providing approximately 4,480,200 passen-
ger miles in 1998 to approximately
11,055,700 passenger miles in 2003, with
the number of average weekday transit trips
rising from about 2,579 daily trips in 1998 to
roughly 3,766 average weekday transit trips
in 2003. This growth in transit services cor-
relates to associated growth in Victorville
and surrounding areas.

Bus Service

Bus service in the City of Victorville is pro-
vided by the Victor Valley Transit Authority
(VVTA), a joint powers agency serving Vic-
torville and adjacent areas. The VVTA ser-
vice area is comprised of the cities of Ade-
lanto, Hesperia, and Victorville, the Town of
Apple Valley, and San Bernardino County.

Within the joint powers area, the VVTA cur-
rently operates 13 fixed-routes with various
transfer points to adjoining routes, with ad-
ditional subscriber services for certified rid-
ers. There are ten fixed-routes providing
service within or through Victorville. Transit
service currently is offered from 6:00 AM to
9:00 PM, Monday through Friday, and from
7:00 AM to 8:00 PM on Saturdays, with no
service on Sundays and national holidays.

VVTA buses are equipped with bicycle
racks that facilitate intermodal bicycle-
transit trips. These racks can accommo-
date two bicycles at a time. For physically
challenged patrons, Direct Access Transit is
available by reservation only. Direct Access
Transit is available the same dates and
times as general transit service and ob-
serves the same holidays.

Regional commuter bus service from the
City of Victorville was initiated in July 2002

but discontinued in July 2005. The com-
muter service was a three-year demonstra-
tion project funded with a Congestion Miti-
gation Air Quality (CMAQ) grant from the
Federal Transit Administration (FTA), which
at the end of the three-year period would be
funded by the VVTA or discontinued on un-
availability of funds. The program provided
commuter routes from Victorville to down-
town San Bernardino, the Rancho
Cucamonga Metrolink station and Ontario
Mills. Currently, VVTA does not provide
commuter service beyond the Victor Valley
region; however, Amtrak Motor Coach ser-
vice provides two daily round trips to Bak-
ersfield.

Passenger Rail

Passenger rail service to the City is provid-
ed by Amtrak. Figure Circ-4 illustrates
passenger rail routes serving the City of
Victorville. Amtrak’s Southwest Chief Liner
connecting Chicago, Illinois with Los Ange-
les, California, via Arizona, New Mexico,
Colorado, Kansas and Missouri, offers daily
service from the City of Victorville to Los
Angeles. This train offers a morning and an
evening commute to and from Los Angeles.

Westbound, travelers can connect to the
Coast Starlight in Los Angeles and the Pa-
cific Surfliner in Fullerton.

Victor Valley Transportation Center

Located on the north side of D Street, be-
tween 2nd Street and 6 th Street, in the
northeastern section of the City, the Victor
Valley Transportation Center offers travel-
ers multi-modal services and facilities. The
transportation center is fully accessible to
persons using wheelchairs, and is a transfer
point for Amtrak national rail service and
local bus. It contains 145 automobile park-
ing spaces in a lighted, parking lot and bicy-
cle lockers. Since the station is not staffed
by Amtrak, tickets, baggage, or package
express shipments are not handled at this
location. The nearest stations offering
these services are in Los Angeles or Bak-
ersfield.

Park-and-Ride Lots

Public transportation within the City of Vic-
torville is supported by the convenience of
park-and-ride lots. As shown in Figure Circ
-4, the City has two existing park-and-ride
lots, and one proposed in 2006. The exist-
ing lots are located at the following loca-
tions:

 Victor Valley Transportation, off D Street
– 145 parking spaces
 Southwest corner of Amargosa Road and
Bear Valley Road – 70 parking spaces,
with space to expand to 203).

A new park-and-ride lot is planned at the
northeast corner of Bear Valley Road and
Fish Hatchery Road, adjacent to the Victor
Valley College with 412 spaces.

Freight and Goods Movement

Freight Train Service

Southern California’s major inter-modal car-
go loading facilities are located in ports of
Long Beach and Los Angeles. In the future,
with the expansion of the SCLA, the City will
function as a major hub for inter-modal car-
go transfer and distribution. As shown in
Figure Circ-5, the City is served by a major
freight rail corridor. The Burlington Northern
Santa Fe Company (“BNSF”) operates
freight rail services through the City of Vic-
torville, with a double main line and lead
tracks for industrial uses. The services of-
fered include transporting containers, trail-
ers, and chemical/oil tankers. Union Pacific
Railroad also operates on the double main
line and Victorville is within its service area.

Southern California’s major inter-modal car-
go loading facilities are located in the ports
of Long Beach and Los Angeles. In the fu-
ture, with the expansion of the SCLA, the
City will function as a major hub for cargo
transfer and distribution. Potentially encom-
passing 1,600 acres and creating 1,500 per-
manent jobs, the City has begun construc-
tion of the first phase of rail lines leading to

a new inter-modal/multi-modal rail yard.

This facility will allow transfer of freight from
rail-to-truck and rail-to-rail and include stor-
age areas for automobiles and storage con-
tainers.

The City’s Foxborough Industrial Park cur-
rently offers freight rail accessed parcels.

Companies such as Goodyear, Mars M&M,
Nutro and ConAgra utilize rail spurs in their
day-to-day operations. This service will
also be offered in the industrial area at the
north end of the SCLA.

Truck Routes

Various size trucks and other types of vehi-
cles are the primary mode of transporting
goods from storage and distribution centers
in and out of the Victor Valley, to their user
destinations throughout the Planning Area.

In concert with Noise Element policies,
truck routes are restricted to arterials that
minimize disturbance to noise sensitive
land uses, such as residences, hospitals,
churches, schools, etc., with the exception
of existing truck routes adjacent to existing
developed areas such as along Hesperia
Road, Amargosa Road and Nisqualli Road.

Chapter 12.36 of the Victorville Municipal
Code establishes truck route regulations for
commercial vehicles exceeding a maximum
gross weight limit of 12,000 pounds. With
the exception of making pickups or deliver-
ies of goods, wares and merchandise from
or to any building or structure located on
non-truck routes, or for building construc-
tion or repair in these locations, trucks ex-
ceeding the specified weight limit are man-
dated to drive on City arterials that are
clearly marked as a ‘Truck Traffic Route’.

All designated truck routes have access to
the regional freeways within the Victor Val-
ley area.

As Figure Circ-5 indicates, the following
streets are designated as truck routes with-
in the City of Victorville:

Bicycle and Pedestrian Facilities and
Trails

In 2010, the City of Victorville adopted an
updated non-motorized transportation plan
to address the increased demand for non-
motorized facilities and recreational oppor-
tunities for the City. The purpose of the
plan is to provide a safe network of facilities
for pedestrians, hikers, bicyclists, wheel-
chairs, and health enthusiast that will link
public facilities such as parks, open spac-
es, golf courses, the Victor Valley Trans-
portation Center, Old Town Victorville, Vic-
tor Valley Community College, the Mojave
Narrows Regional Park, and other destina-
tions. The Plan will also provide connectivi-
ty to the San Bernardino County Non-
Motorized Transportation Plan system and
the non-motorized transportation plan of
surrounding cities.

The City of Victorville recognizes the value
of providing opportunities for local residents
and visitors to bicycle for work and recrea-
tion, as well as to use off-road trails for hik-
ing, equestrians and jogging. Such oppor-
tunities help to reduce auto trips, improve
the environment, promote healthy lifestyles
and create livable communities.

The plan promotes the alternate mode of
transportation and will utilize the Mojave
River, river washes, public utility ease-
ments, existing specific plan paseo sys-
tems, future paseos and the existing street
system to develop non-motorized facilities.

These non-motorized transportation facili-
ties, as noted on Figure Circ-6, will be pro-
vided as the City matures and continues to
build out.

In 2001, SANBAG updated the San Bernar-
dino County Non-Motorized Transportation
Plan. It is intended to coordinate and guide
San Bernardino County and local jurisdic-
tions in taking measurable steps to promote
and facilitate the use of non-motorized
modes for recreational travel and for com-
muting and other purposes. The Plan in-
cludes regional and intra-jurisdictional bicy-
cle connections and pedestrian facilities.

To develop a successful and widely used
bicycle route network, the San Bernardino
County Non-Motorized Transportation Plan
identifies the following four key issues to be
addressed: safety, access, quality of life
and effective implementation. A main goal
of this Plan is to upgrade existing facilities,
implement new facilities and develop a
countywide non-motorized network.

A majority of the non-motorized facilities
include both shared-use and exclusive bi-
cycle use facilities. Shared-use facilities,
include shared paths for pedestrians and
bicycles, and shared right of ways with bi-
cycles and automobiles. Non-motorized
facilities, specifically bike routes or shared-
paths are defined in Section 890.4 of the
California Streets and Highway Code. The
design standards for such facilities are de-
scribed in the Caltrans Design Manual and
are consistent the criteria documented in
the American Association of State Highway
and Transportation Officials (AASHTO)
Guidelines for the Development of Bicycle
Facilities.

The City’s bikeway network consists of
three types of facilities, as follows:

 Class I bikeways, such as ‘bike
paths’, provide a completely sepa-
rated right of way designated for
exclusive use of bicycles and pe-
destrians with minimum cross flows
by motorists. These are shared use
paths that may be used by pedestri-
ans, skaters, wheelchair users, jog-
gers and other non-motorized us-
ers.

 Class II bikeways, such as ‘bike
lanes’, provide a restricted right of
way designated for the exclusive or
semi-exclusive use of bicycles with
through travel by motor vehicles or
pedestrians prohibited, but with per-
mitted vehicle parking and cross
flows by pedestrians and motorists.

This is a portion of roadway that has
been designated by striping, sign-
ing, pavement delineation, and
pavement markings for preferential
or exclusive use of bicyclists.

 Class III bikeways, such as on-
street or off-street ‘bike routes,’ pro-
vide a right of way designated by
signs or permanent markings and
shared with pedestrians or motor-
ists. Under the Caltrans Design
Standards, Class III bikeways are
designated by signage as a pre-
ferred route for bicycle use and
routes.

Congestion Management Program

The need to maintain a comprehensive and
functional regional circulation system
throughout the Victor Valley and San Ber-
nardino County was one of the main objec-
tives in the creation of the San Bernardino
Associated Governments (SANBAG).

SANBAG is the council of governments and
acts as the transportation planning agency
for San Bernardino County. There are cur-
rently 25 member jurisdictions that, through
appointed representatives, are responsible
for the cooperative regional planning of lo-
cal and regional roadway improvements,

train and bus transportation, deployment of
intelligent transportation systems and long
term planning studies. As designated by
statute, SANBAG serves in the capacity of
County Transportation Commission, which
is responsible for allocating and program-
ming state and federal funds for regional
transportation projects throughout the
County.

SANBAG also serves as the County Trans-
portation Authority and is responsible for
administering Measure I, the half-cent
transportation sales tax originally approved
by voters in 1989 and extended for an addi-
tional 30 years in November 2004.

SANBAG also has been designated as the
Service Authority for Freeway Emergencies
and as the Congestion Management Agen-
cy responsible for establishing, maintaining,
and enforcing San Bernardino County’s
Congestion Management Program (CMP).

San Bernardino County’s CMP was created
in June 1990 as a provision of Proposition
111. Under this proposition, urbanized are-
as with populations of more than 50,000
were required to undertake a congestion
management program that was adopted by
a designated Congestion Management
Agency (CMA). As stated earlier, SANBAG
was designated as the CMA by the County
Board of Supervisors.

The CMP’s level of service (LOS) standard
requires all CMP segments to operate at
LOS E or better, with the exception of those
facilities identified in the list below. The
following Victor Valley roadway segments
have been designated LOS F in the 2001
CMP, updated in December of 2001:

 Bear Valley Road, between
Amargosa Road and Mariposa
Road
 Bear Valley Road, between Hesper-
ia Road and Peach Avenue
 SR-18, between I-15 (North) and
Stoddard Wells Road

The procedures in the 2000 Highway Ca-
pacity Manual (HCM) were adopted as the
LOS procedures to be utilized in analyzing
CMP facilities. Through the use of traffic
impact analysis (TIA) reports and Compre-
hensive Transportation Plan (CTP) model
forecasts, the CMP evaluates proposed
land use decisions to ensure adequate
transportation network improvements are
developed to accommodate future growth
in population. If a CMP facility is found to
fall below the level of service standard, ei-
ther under existing or future conditions, a
deficiency plan must be prepared, adopted,
and implemented by local jurisdictions that
contribute to such situations.

Deficient Intersections

Deficient intersections are those with an
Intersection Capacity Utilization (ICU) value
greater than 0.95 or Highway Capacity
Manual (HCM) delay LOS worse than D
(i.e., E or F). Intersections under this cate-
gory would require mitigations to improve
the LOS to satisfactory levels, that is to an
ICU less than 0.95 or an HCM delay LOS
of D or better. Specific critical movements
that are LOS F require mitigation to satis-
factory levels. For existing deficiencies, a
determination can be made to mitigate for
future impacts to avoid degrading the LOS
of the intersection.

Near-Deficient Intersections

Near-deficient intersections are those with
an ICU value greater than 0.90 but less
than 0.95 and HCM delay LOS equal to or
better than D. Intersections under this cat-
egory are technically operating satisfactori-
ly, under the given conditions, but could
become deficient if traffic volumes increase
slightly or if the growth in traffic volumes or
land use projections become higher than
those assumed in the model.

Satisfactory Intersections

All intersections that operate at ICU less
than 0.90 but less than 0.95 and HCM de-
lay LOS D or better are considered to be
operating satisfactorily.

Wet and Dry Utilities
Water, sewer and storm drainage infra-
structure (wet utilities) and electricity, natu-
ral gas, and telecommunications infrastruc-
ture (dry utilities) are also essential compo-
nents of the circulation system. Such infra-
structure is typically installed in conjunction
with development to serve that develop-
ment or be reasonably related to it. Utility
systems usually follow the street system
and are installed within the public right of
way. Planning and maintenance of wet util-
ities is the City’s responsibility. Private and
quasi-public entities own and manage the
dry utilities systems. An exception is that
the City of Victorville Utility Department pro-
vides service for dry utilities (exclusive of
telephone service) in the SCLA and Fox-
borough industrial area.

Through its annual Capital Improvement
Program (CIP), the City identifies anticipat-
ed major infrastructure needs for the next
five years, including street improvements,
traffic signals, sewer improvements, water
system improvements and storm drains.

Planning and programming of water system
improvements are handled by County Ser-
vice Area 64. CIP projects include those for
which funding is anticipated, from Federal,
State and local sources. Since priorities
and funding levels are subject to change,
the CIP is subject to annual review and re-
visions. The CIP is designed to:

1. Provide a centralized and compre-
hensive mechanism for forecasting
and defining capital improvement
needs;

2. Assign priorities among capital pro-
jects;

3. Budget projects in accordance with
City priorities;

4. Develop a projected revenue program
for financing;

5. Schedule projects on a fixed-time ba-
sis and provide for appropriate im-
plementation;

6. Coordinate activities of various City
departments and outside entities in
meeting schedule objectives

7. Monitor and evaluate the progress of
capital improvements; and

8. Inform the public and private develop-
ers of projected capital improvements
needs and implementation projects

While the CIP can save the City money by
facilitating purchase of land and materials in
advance of actual need, careful considera-
tion is necessary when programming pro-
jects to ensure that physical improvements
do not outpace need. The City’s policy has
and continues to be that infrastructure
should be installed only when necessary
and only to the extent warranted to avoid
excessive maintenance costs.

GOALS, OBJECTIVES, POLICIES

AND IMPLEMENTATION
The following goals, objectives, policies and
implementation measures are intended to
achieve the Vision of this Circulation Ele-
ment and to guide the City’s efforts to con-
tinue to build and maintain an efficient
transportation and circulation infrastructure
to support the community development poli-
cies set forth in the Land Use Element.

GOAL #1: GOOD MOBILITY - PRO-

VIDE A SAFE, EF FICIENT TRANS-

PORTATION SYSTEM THAT EN-

HANCES MOBILITY FOR LOCAL RES-

IDENTS AND BUSI NESSES, AND FA-

CILITATES REGIONAL TRAVEL FOR
AUTOMOBILES AND TRUCKS.

Objective 1.1: Prov ide sufficient traf-
fic carrying capacity at intersections
throughout the roadway network, to
achieve level of service performance
standards.

Policy 1.1.1:

Maintain LOS “D” or better
at intersections (as defined in the most cur-
rent version of the Highway Capacity Manu-
al), except in certain high activity areas des-
ignated by the Planning Commission, where
a LOS E is acceptable.

Implementation Measure 1.1.1.1: Assess
traffic impacts of significant new develop-
ment and redevelopment projects to deter-
mine whether the projects would cause af-
fected intersections to operate at deficient
levels of service or would substantially
worsen the LOS at already deficient
LOS. A threshold for determination of what
classes of projects trigger a traffic impact
analysis or traffic study shall be established
by the City Engineer.

Policy 1.1.2: If a development project
would worsen an intersection peak hour
LOS to E or worse, it is considered a signifi-
cant impact that must be mitigated. If a de-
velopment project would worsen an already
deficient intersection by two percent or
more, it is considered a significant impact
that must be mitigated.

Policy 1.1.3: Require new development
and redevelopment projects to bear respon-
sibility for traffic sy stem improvements nec-
essary to mitigate the project’s significant
impacts at affected intersections, concur-
rently with construction of such projects.

Implementation Measure 1.1.3.1: Typically,
developers will construct necessary traffic
system improvements. Alternately, in lieu of
developer-provided improvements, the City
will impose exactions, dedications and/or
fees on new development and redevelop-
ment projects to fund improvements that
mitigate significant safety and/or congestion
impacts on the roadway network. These
shall be based on a clear and proportional
nexus between the level of project impact
and the estimated cost of providing the im-
provements required to mitigate the impact.

Policy 1.1.4: Complete deficiency plans
to mitigate near-deficient and deficient inter-
sections to an acceptable level of service or
to prevent degrading to a worse level of ser-
vice.

Implementation Measure 1.1.4.1: Incorpo-
rate deficiency plan projects into the five-
year Capital Improvement Program or into
longer range plans.

Objective 1.2: Achieve and maintain
mobility goals set forth in county-
wide CMP, on local CMP segments.

Policy 1.2.1:

Support and cooperate with
all aspects of the countywide CMP for main-
taining levels of service for CMP segments
located in the Planning Area.

Implementation Measure 1.2.1.1: The City
will be responsible for requiring, reviewing
and approving traffic impact analyses and
traffic studies for all applicable private and

public projects, in accordance with CMP
standards for these studies.

Implementation Measure 1.2.1.2: Incorpo-
rate deficiency plan projects into the five-
year Capital Improvement Program or into
longer range plans.

Objective 1.3: Complete the planned
highway improvements.

Policy 1.3.1: Participate with Caltrans
and SANBAG on the environmental docu-
ments for the realignment of Highway 395
through the Planning Area.

Policy 1.3.2: Complete the project ap-
proval and environmental document for the
High Desert Corridor Project.

Policy 1.3.3: Prioritize General Plan im-
provements for new interchanges, inter-
change modifications, new road construc-
tions and road widenings.

Implementation Measure 1.3.3.1: Incorpo-
rate deficiency plan projects into the five-
year Capital Improvement Program or into
longer range plans.

Objective 1.4: Maintain smooth traf-
fic flow, reduce and minimize traffic
conflicts
Policy 1.4.1 :

Restrict residential drive-
way access to arterial roadways to loca-
tions where a finding can be made that
such access will not result in a significant
safety problem, will not conflict with traffic
movements and will not result in a conges-
tion impact.

Policy 1.4.2: Minimize through traffic in
residential neighborhoods through a variety
of land use controls, traffic control devices,
signs, traffic calming techniques, etc.

Policy 1.4.3: Support and participate in
regional efforts to improve/expand freight
movement via trucks and train services,
without increasing conflicts with passenger
car traffic and without increasing conges-
tion on the highway and arterial roadway
networks.

Policy 1.4.4 : Continue to enforce truck
route restrictions throughout the Planning
Area.

Objective 1.5: Ensure adequate
planning and programming of road-
way improvements.

Policy 1.5.1:

Review and prioritize Trans-
portation Systems Management (TSM)
measures and incorporate into Capital Im-
provement Programming (CIP) as appropri-
ate.

Implementation Measure 1.5.1: Each year,
as part of the CIP effort, select a specific
set of TSM measures to complete in the
next fiscal year, to optimize the efficiency
of the local roadway network. TSM
measures include, but are not limited to:

1. Intersection widening

2. Installation of traffic control devices –
signals and stop signs

veloping an integrated and connect-
ed multimodal transportation system
of Complete Streets that serves all
neighborhoods.

Policy 2.1.1:

Each year, as part of the
CIP effort, consider allocation of funds to-
ward completion of some portion of the Non
-Motorized components of the Circulation
Plan.

Policy 2.1.2: The Development, Engi-
neering and Public Works Departments
shall routinely work in coordination with
each other, any Bicycle or Pedestrian Coor-
dinator, and any relevant advisory commit-
tees, to create Complete Streets and to en-
sure consistency with existing Pedestrian/
Bicycle/Multi-Modal Plans, such as the Non-
Motorized Transportation Plan and this Cir-
culation Element.

Policy 2.1.3: Wherever possible, Trans-
portation Projects shall strive to create a
network of continuous bicycle- and pedestri-
an-friendly routes, including routes that con-
nect with transit and allow for convenient
access to work, home, commercial areas,
and schools.

Policy 2.1.4: The Development, Engi-
neering and Public Works Departments
shall coordinate with adjacent jurisdiction(s)
and any other relevant public agencies, in-
cluding Caltrans, to ensure that, wherever
possible, the network of continuous bicycle-
and pedestrian-friendly routes identified in
Policy 2.1.3 extends beyond Victorville’s
boundaries into adjacent jurisdictions.

Policy 2.1.5: Victorville shall rely upon
the current editions of street design stand-
ards and guidelines that promote and sup-
port Complete Streets.

Objective 2.2: Expand public transit
in conjunction with population
growth
Policy 2.2.1:

Require new development
and redevelopment projects (public and pri-
vate), to incorporate needed public transit
facilities as identified by the Victor Valley
Transit Authority (VVTA).

Implementation Measure 2.2.1.1: Consult
with the VVTA during planning/design of
major new development and redevelopment
projects and public facilities, to incorporate
appropriate public transit improvements, in
optimal locations.

Implementation Measure 2.2.1.2: Consult
with VVTA regarding regular assessments
of special transit needs for low-income, el-
derly, handicapped and other residents who
do not have access to private automobiles
or the public bus system.

specifications for construction of utility in-
frastructure within each roadway functional

Policy 3.2.1: Minimize or prohibit the use
of landscape materials that require regular
watering in the design of landscaping for
public streets.

Policy 3.2.2: Include in the design speci-
fications for public and private streets
structural and non-structural techniques to
filter storm water runoff prior to conveyance
to storm drain inlets.

Policy 3.2.3: Program the funding and
construction of wet and dry utilities within
City service areas concurrent with the actu-
al need for those improvements.

Objective 3.3: Provide adequate in-
frastructure improvements in con-
junction with new development and
redevelopment projects
Policy 3.3.1: Require private and public
development projects to be responsible for
constructing road improvements along all
frontages abutting a public street right of
way, in accordance with the design specifi-
cations for that roadway. Such road front-
age improvements shall be constructed
concurrently with and completed prior to
opening of the project.

Implementation Measure 3.3.1.1: Require
private and public development projects to
be responsible for constructing roads, traf-
fic control devices, wet and dry utility im-
provements necessary to meet the needs
of the project, and to property integrate into
the established and planned infrastructure
systems. Such improvements shall be
constructed concurrently with and complet-
ed prior to opening of the project.

This update is being proposed to align with recommendations from the City Engineer to ensure the Cir culation Element of the General Plan and the included Circulation Map accurately reflect current roadway function, planned infrastructure, and long-term mobility needs.

Discussion/Analysis:

1. General Plan Amendment.

Background/Purpose

As shown in the attached graphic (Attachment B), staff is proposing reclassification of the length of Valley Park Lane from Amargosa Road to Civic Drive to a local roadway.

This update will resolve inconsistencies between planning documents and ensure the City’s Circulation Map accurately reflects the City’s intended roadway network.

The Circulation Element of the Victorville General Plan (Attachment C) establishes the functional classification and general alignment of major roadways to support the efficient movement of people and goods throughout the City. Periodic updates to the Circulation Map are necessary to reflect changing land use patterns, updat ed traffic analyses, and current infrastructure planning.

Valley Park Lane, located between Amargosa Road and Civic Drive, is currently designated as a Collector roadway on the City’s Circulation Map (Attachment D).

However, the circulation plan within the Civic Center Community Sustainability Specific Plan (Attachment E), adopted after the current Circulation Element, does not identify Valley Park Lane as a master‑planned Collector roadway. This inconsistency has prompted a reevaluation of the roadway’s appropriate classification.

Analysis/Future Impacts

The Specific Plan’s circulation analysis, supported by a January 2014 traffic study prepared by the City Engineering and included within the Specific Plan document (Attachment E), concluded that Valley Park Lane is not needed to meet long‑ term mobility needs in the Civic Center area. Concurrently, the study found that the roadway network as included in the Civic Ce nter Community Sustainability Specific Plan is capable of achieving acceptable performance when compared to the standards of the Circulation Element of the General Plan. Additionally, the current City Engineer’s evaluation (Attachment F ) identifies operational constraints associated with maintaining a Collector designation in this location, including a required traffic signal at Amargosa Road and Valley Park Lane, which would conflict with the planned and warranted signal at Amargosa Road and Kimberly Drive.

A portion of Valley Park Lane west of Civic Drive has been constructed and currently operates as a retrofit Collector. Even with the reclassification to a local roadway, these improvements would remain in place. Future development along the corridor would 348

be required to be constructed with frontage improvements consistent with Victorville Municipal Code Section 9.32.040 unless alternative designs are approved that result in the terminus of Valley Park Lane prior to its intersection with Amargosa Road.

2. Environmental Assessment

The General Plan Amendment proposal will not have an effect on the environment and is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of the CEQA guidelines, as there is no possibility that the proposed amendment will have a significant effect on the environment . The action consists solely of removing Valley Park Lane’s Collector designation from the Circulation Map and reclassifying it as a Local roadway. This administrative update does not authorize construction, modify roadway capacity, or change land use intensity.

Valley Park Lane is already omitted from designation as a master‑planned Collector roadway in the Civic Center Community Sustainability Specific Plan (Attachment E), and the circulation analysis supporting that plan demonstrates that the roadway is not needed to meet long‑term mobility needs. Because the amendment simply reconciles the General Plan with existing adopted policy and does not require physical improvements, it can be determined with certainty that no environmental impacts would occur.

Consideration of Resolution No. VWD 26-012 - A Resolution of the Board of Directors of the Victorville Water District Adopting New Rates, Fees, and Charges for Water Services Recommendation:

That the Honorable Victorville Water District Board of Directors:
(1) Review and consider all valid written legal objections and District responses; (2) Determine that staff has adequately responded to all valid legal objections and direct that the Public Hearing proceed in accordance with AB 2257; (3) Open the Public Hearing;
(4) Receive testimony, public comment, and consider all protests against the Victorville Water District’s adoption of new rates, fees, and charges for water services;
(5) Determine if a majority protest exists;
(6) Close the public hearing;
(7) If no majority protest exists, approve Resolution No. VWD 26-012 to adopt the new Water Rates, Fees, and Charges for Water Services.

Fiscal Impact:

Proposed Resolution No. VWD 26-012 (Attachment A) authorizes the District to implement a new water rate structure, which is designed to meet the District’s cost for service and yield an annual average revenue rate increase of 4%. This annual increase is essential to cover the growing cost of capital improvement projects that are necessary to meet state regulatory guidelines and for the District to continue to provide reliable water services and quality drinking water to District customers.

Strategic Plan Goal:

This item aligns with Goal A, Financial Sustainability, and Goal E, Invest in Infrastructure.

Background:

Water Rate Increase History
On July 20, 2021, the Board of Directors of the Victorville Water District (the “District”) adopted Resolution No. VWD-21-011, which established new Water Rates for a five-year period covering Fiscal Year (FY) 2021/2022 through FY 2025/2026. As the District is now in the final year of that rate cycle, a new water rate study was required to evaluate projected operational, capital, and financial needs for the next five-year period (FY 2026/2027 through FY 2030/2031).

Concurrent with the recently completed and adopted Water Rate Study, the District has also updated its Water Master Plan (WMP). The WMP serves as the District’s long-range planning document by evaluating existing system conditions, projecting future water demands, identifying infrastructure improvements needed to meet future service demands and regulatory requirements, and establishing a capital improvement program.

The capital improvements identified in the WMP were incorporated into the rate model to ensure adequate funding over the upcoming five years. The WMP update was completed with assistance from Water Systems Consulting (WSC) and is being presented to the District Board of Directors (the “District Board”) for adoption as a separate agenda item on the July 21, 2026 District Board meeting.
2026 Water Rate Study, Rate Workshop, and Intent Meeting In December 2025, Bartle Wells Associates was awarded the contract for the 2026 Water Rate Study (Rate Study) and began data collection, analysis, and bi-weekly coordination meetings with District staff soon thereafter.

On April 27, 2026, the District Board held a workshop to review the preliminary findings of the Rate Study, including a proposed five-year schedule of 4% annual rate increases beginning August 1, 2026. This cost-of-service analysis incorporates repayment of the remaining Baldy Mesa Water District bond debt and reallocates the revenues previously pledged for debt service to support ongoing District operations, helping minimize future rate increases while ensuring sufficient funding for operational and capital needs.

The District Board discussed the proposed rate structure during the workshop, including its greater effect on residential customers. Staff and the rate consultant explained that recent case law had prompted the replacement of the District’s existing tiered volumetric rate structure with a single volumetric rate that more closely aligned with current judicial interpretations of Proposition 218 cost-of-service and proportionality requirements.

Updated cost-of-service analyses also resulted in minor adjustments to the fixed charges for residential meter customers. Staff further explained that residential customers experienced comparatively greater changes in the first year only because the tiered rate 4 8

structure was replaced with a single volumetric rate, thereby eliminating the rate design that had previously provided lower volumetric rates for qualifying residential water use.

Staff advised the District Board that the refined 2026 Water Rate Study would be returned for consideration and, if approved, authorization from the District Board to initiate the Proposition 218 rate-setting process, as set out in Article XIII D, Section 6 of the California Constitution, would be sought.

On June 2, 2026, the District Board adopted Resolution No. VWD 26-009, which accepted the Rate Study prepared by Bartle Wells, authorized the mailing of public hearing notices regarding the proposed changes in water service rates, and established that the Public Hearing on the rates would take place during the District Board’s July 21, 2026 regular meeting in the City Council Chambers at 6:00 pm. The Notices of Public Hearing, as further described below, were mailed to all affected property owners on June 4, 2026.

At that same meeting, staff outlined and recommended the District Board adopt an additional “written objection” procedure pursuant to AB 2257 (Government Code Sections 53759.1 and 53759.2). Under this procedure, property owners must submit timely and valid written objections to the proposed water rates prior to the objection submission deadline date specified in the Notice of Public Hearing. Failure to submit a timely written objection constitutes a failure to exhaust administrative remedies and bars any subsequent legal action challenging the adopted rates. Utilizing this procedure also provides the District with an opportunity to address rate concerns prior to final adoption.

To ensure awareness of and compliance with AB 2257, the District Board adopted Resolution No. VWD 26-011 to establish AB 2257 procedures.

Discussion:

District staff, with the assistance of the Finance and IT departments, identified all Assessor Parcel Numbers (APNs) receiving water service from the District and therefore subject to the proposed rates (Proposed Rates) established in the Rate Study. In compliance with Proposition 218, Notices of Public Hearing describing the Proposed Rates, the basis for the rate adjustments, the calculation methodology, and written protest procedures were mailed to the record owners of each affected parcel at least 45 days prior to the Public Hearing.

In addition, to comply with the procedures in AB 2257 and Resolution No. VWD 26-011, the Notices of Public Hearing contained: a link to the City/District website where the Rate Study and related materials would be posted; a telephone number at which to call the District for additional information; detailed and conspicuous instructions on how to file a written objection (“Legal Objection”); a requirement that any valid objection explain the legal basis for the claim with specificity; and the deadline by which Legal Objections must be submitted. A copy of the Public Hearing Notice is in Attachment B.

As of the preparation of this Staff Report, one valid Legal Objection has been received.

This valid Legal Objection, and District staff’s responses thereto, are in Attachment C for the District Board’s review and consideration. As the deadline for submitting Legal Objections (July 20, 2026, at noon) occurs after the posting of this agenda, any additional 4 8

valid Legal Objections received (and Staff’s responses), will be provided as a supplement to this Staff Report prior to the start of the July 21, 2026, meeting.

Based upon the Legal Objection currently attached, and as indicated in the District response thereto, District staff recommend that the District Board proceed with conducting the Public Hearing, as no clarifications, revisions, further review, or other actions regarding the proposed water rates appear to be warranted.

AB 2257 and the procedures in Resolution No. VWD 26-011 require the District Board to consider and review all valid Legal Objections received and District responses, and determine one of the following prior to conducting the Public Hearing:
(1) Whether the valid Legal Objections and the District’s responses warrant clarifications of the proposed water rates;
(2) Whether a reduction of the proposed water rates is warranted; (3) Whether to further review the proposed water rates before determining whether clarification or reduction is needed;
(4) Whether to proceed with the Public Hearing and protest tabulation.

Staff are confident that the District’s responses to all valid legal objections, provided in Attachment C and included as supplemental materials to this Staff Report if received after agenda posting, adequately address the issues raised. However, consistent with AB 2257 and Resolution No. VWD 26‑011, it is ultimately the District Board’s discretion to determine whether these responses are sufficient and whether to proceed with the Public Hearing and protest tabulation. Findings consistent with this course of action have been included in proposed Resolution No. VWD 26-012.

As outlined in the Public Hearing Notice, a majority protest exists only if written protests are submitted by the owners of a majority (50% plus one) of the identified parcels before the close of the Public Hearing. To be considered valid, each written protest must: (1) state opposition to the Proposed Rates; (2) identify the APN or service address; and (3) include the printed name and original signature of the property owner of record. Only one written protest per parcel may be counted.

The District Secretary has received and reviewed all written protests submitted to date.

As of the preparation of this Staff Report, the District has not received written protests from a majority of property owners. In accordance with Proposition 218, the Secretary will formally announce the final number of valid written protests upon closure of the Public Hearing. If a majority protest is received, the District Board is legally prohibited from adopting the Proposed Rates. If no majority protest exists, the District Board may proceed with consideration of Resolution No. VWD 26-012 adopting the Proposed Rates.

The Proposed Rates are based on the comprehensive Rate Study prepared by Bartle Wells Associates and accepted by the Board through Resolution VWD 26-009. The Rate Study includes detailed financial planning, cost-of-service analysis, and rate design that allocate costs proportionally to customers in accordance with Article XIII D, Section 6 of 4 8

the California Constitution (Proposition 218). The Proposed Rates are necessary to meet increasing operating costs, implement planned capital improvement projects, address inflationary pressures, maintain prudent reserve levels, and ensure the financial stability of the District’s water utility.

Rate Table Summary
The Rate Study proposes adjustments to fixed service charges and volumetric rates over a five-year period beginning August 1, 2026. Monthly fixed service charges are based on meter size and hydraulic capacity.

The Study also recommends replacing the prior two-tier residential volumetric structure with a uniform volumetric rate for all domestic water customers, set at $2.28 per hundred cubic feet (HCF) in FY 2026/27 and increasing annually to $2.67 per HCF by FY 2030/31.

Updated volumetric rates apply similarly to recycled water, untreated well (non-potable) water, construction flow meters, and intertie customers, all of which reflect the proportional cost of service per the Rate Study.

These rates balance revenue stability with fairness and transparency and provide the necessary funding for system operations, reinvestment in infrastructure, and compliance with regulatory requirements.

Comparison to Other Jurisdictions
The Rate Study includes a comparative regional review of single-family residential water bills based on an average monthly usage of 12 HCF. As illustrated in Figure 9 of the Rate Study and listed below, the District’s proposed FY 2026/27 charges remain among the lowest in the region, with only one surveyed agency presenting lower monthly costs. Even with the proposed rate adjustments, Victorville Water District customers will continue to pay below-average monthly water bills compared to peer agencies, demonstrating that the District remains competitively and affordably positioned within the regional water market.

These comparative findings support the Study’s conclusion that the District’s Proposed Rates are reasonable, cost-justified, and consistent with maintaining a reliable and financially sustainable water system.

Environmental Exemption
As set forth in the Recitals thereof, the District Board finds that Resolution No. VWD 26- 012 is exempt from environmental review under the California Environmental Quality Act (“CEQA”), pursuant to CEQA Guidelines Section 15061(b)(3) (No Possibility that the Activity may have a Significant Effect on the Environment) and Section 15273 (Adoption of Rates, Tolls, Fares, and Charges).

If adopted, the new Water Rates will take effect for all billings issued on or after August 1, 2026, with subsequent annual adjustments effective each July 1 through FY 2030/31.

These rates will ensure the District’s ability to fund operations, implement capital improvements, maintain financial stability, and provide safe and reliable water service to its customers.

District staff respectfully recommend that the District Board review and consider all valid written Legal Objections received and the District’s written responses; make one of the listed determinations with respect to the proposed New Rates; open the Public Hearing; receive testimony, public comment, and consider all valid protests against the proposed new rates; determine if a majority protest exists; close the Public Hearing; and if no majority protest exists, adopt Resolution No. VWD 26-012.

A RESOLUTION OF THE BOARD OF DIRECTORS OF THE

VICTORVILLE WATER DISTRICT ADOPTING NEW RATES, FEES, AND

CHARGES FOR WATER SERVICE

WHEREAS, the Victorville Water District (the “District”) is a subsidiary district of the City of Victorville, organized and operat ing under the County Water District Law (California Water Code section 30000 et seq.); and

WHEREAS, subject to the provisions of Article XIII D, Section 6 of the California Constitution (“Cal. Const. Art. XIII D, §6 ”) the Board of Directors of the District (the “Board of Directors”) is authorized to fix and collect rates and charges for the provision of water service under California Water Code Section 31007 and 31025; and

WHEREAS, at its regular meeting on June 2, 2026, the Board of Directors adopted Resolution No. VWD 2 6-009 which: (1) initiat ed the process of adopting proposed changes to the District’s water service rates, fees, and charges (the “New Water Rates”) in accordance with Cal. Const. Art. XIII D, §6; (2) accepted the water rate/cost of service study prepared by Bartle Wells Associates upon which such New Water Rates were based (the “Study”); (3) set a Public Hearing for July 21, 2026 to receive testimony and consider any valid written protests against and/or legal objections to the proposed New Water Rates; and (4) authorized District staff to prepare and mail notices to the record owners of each identified parcel upon which the New Water Rates were to be imposed, advising them of the New Water Rates, and the date for a Public Hearing thereon; and

WHEREAS, the written notice of the July 21, 2026 Public Hearing was mailed to all record owners of identified parcels upon which the New Water Rates were to be imposed not less than forty-five (45) days prior to the Public Hearing; and

WHEREAS, such written notices contained the following information as required by Cal. Const. Art. XIII D, §6: (1) the amount of the New Water Rates proposed to be imposed upon each parcel; (2) the basis on which the amount of the proposed New Water Rates was calculated; (3) the reason for the New Water Rates; a nd (4) the date, time, and location of the Public Hearing on the New Water Rates; and

WHEREAS, the written notice s further contained instructions on how to file a written protest against, and/or a written legal objection to the New Water Rates; and

WHEREAS, the District identified 38,863 affected parcels and mailed out notices to the property owners of record. Pursuant to Cal. Const. Art. XIII D, §6, the District would be unable to adopt the proposed New Water Rates if 19,433 valid written protests were received; and

WHEREAS, in accordance with the District’s standard practice for noticing resolutions to be adopted at public hearing s, a notice relating to the adoption of this Resolution was published on July 10, 2026, in a newspaper of general circulation and a copy of this proposed Resolution was made available on the District’s Website on the Water Rate Study webpage; and

WHEREAS, the Board of Directors conducted a Public Hearing on July 21, 2026, at 6:00 p.m. at the Victorville City Council Chambers, 14343 Civic Drive, Victorville, California, 92392 in order to receive oral and written testimony regarding the New Water Rates, consider valid l egal objections filed and District responses provided , and to determine if a majority written protest existed; and

WHEREAS, the adoption of this Resolution is exempt from the California Environmental Quality Act (CEQA) because it approves and sets forth a procedure for determining fees for the purpose of meeting the operating expenses , financial reserve needs and requirements, and obtaining funds for capital projects necessary to maintaining service within existing service areas of the District, as set forth in Public Resources Code Section 21080(b)(8) and 14 Cal. Code Regs. §15273(a); and

WHEREAS, the District previously adopted Resolution No. VWD 14‑ 009, which established a consumption charge for non‑potable water produced from District wells for Municipal Irrigation at thirty‑four percent (34%) of the Standard Domestic Water rate, and Resolution No. VWD 12‑ 002, which established a consumption charge for non‑ potable water purchased from the Industrial Wastewater Treatment Plant or other available sources at sixty percent (60%) of the Standard Domestic Water rate; and

WHEREAS, both of these non‑potable water rate classifications were based upon the actual cost of service at the time of adoption; and

WHEREAS, as part of the District’s current comprehensive S tudy prepared by Bartle Wells Associates, the non‑ potable water customer classes and corresponding rates have been fully evaluated and incorporated into the Study’s cost‑based rate model; and

WHEREAS, in order to maintain a single, internally consistent schedule of rates and charges under this Resolution, it is further necessary to formally rescind the non‑potable water rate provisions adopted under Resolution Nos. VWD 14‑009 and VWD 12‑002; and

WHEREAS, based upon the findings, information, and recommendations of the Study; consistent with the requirements of Cal. Const. Art. XIII D, §6 ; and after following the procedure relating to the noticing, filing, review, and response to written legal objections in accordance with Government Code Section 53759.1 and the procedures adopted by Board of Directors in Resolution No. VWD 26-011 on June 2, 2026, if there is no majority written protest, the Board of Directors may find it in the best interests of the District and its customers to adopt this Resolution and the New Water Rates set forth in Section 3 hereof.

NOW, THEREFORE, THE BOARD OF DIRECTORS OF THE VICTORVILLE WATER DISTRICT DOES HEREBY RESOLVE AS FOLLOWS:

SECTION 1. Recitals.

All of the foregoing recitals are true and correct and the Board of Directors so finds and determines. The recitals set forth above, including any definitions, are incorporated herein; are made findings and determinations of the Board of Directors ; and made an operative part of this Resolution.

SECTION 2. Adoption of New Water Service Rates and Charges; Effective Date.

The rates and charges for water service set forth in the rate tables in Section 3 of this Resolution are hereby adopted. With the exception of the Drought Surcharges in Section

3.d, which require certain conservation levels be reached and advance notice prior to imposition, the rates and charges in said Section 3 shall be effective and fixed for all billings made on or after August 1, 2026 , and thereafter shall be annually adjusted and fixed for all billings made on or after July 1 of each subsequent year, as indicated in the Section 3 rate tables.

SECTION 3. Schedule of New Rates And Charges For Water Service.

a. Rate Structure. The rate structure for the District’s water service charges is comprised of two components: a volumetric consumption charge based on the amount of water consumed during a billing period; and a fixed monthly service (meter) charge.

b. Consumption Rate. As set forth in the table below, a new single -tier, volumetric water consumption rate for all customers is now established. The volumetric consumption charge is per hundred cubic feet (hcf) of water registered by a water service meter established to serve a specific property by the District.

c. Fixed Water Service (Meter) Charge. The fixed water service (meter) charge is based on the size of the water meter serving a property and assessed on an approximately monthly basis and prorated for billing periods less than twenty (20) days or more than forty (40) days. The meter charge is assessed to each property where water is made available, whether or not water is actually used, and shall be as set forth in the following table:

d. Drought Surcharges. If, during the adopted five- year rate period (FY 2026/27 through FY 2030/31), customer water use decreases in response to drought -related conservation measures to a level that causes District revenues to fall below what is required to sustain required rate revenues , the Board of Directors may implement the Drought Surcharges in the following table. If implemented, the surcharge amounts shown in the table below would be added to the adopted consumption water rate currently in effect. Any implementation, adjustment, or repeal of D rought Surcharges will occur only after the Board adopts a formal resolution and written notices are mailed to affected property owners at least thirty (30) days prior to the effective date of the new rate.

SECTION 4. Recission of Certain Prior Water Rate Provisions.

a. The non‑ potable water rate for Municipal Irrigation established pursuant to Resolution No. VWD 14‑ 009, Section 3.a.iii., which set the consumption charge at thirty‑four percent (34%) of the Standard Domestic Water rate is hereby rescinded effective as of July 31, 2026.

b. The non‑potable water rate for non‑ potable water purchased from the Industrial Wastewater Treatment Plant or other available sources established pursuant to Resolution No. VWD 12 ‑002, Section 4.a.iv., which set the consumption charge at sixty percent (60%) of the Standard Domestic Water rate is hereby rescinded effective as of July 31, 2026.
c. These rescissions are made because the rate and customer classifications formerly established under Resolution Nos. VWD 14‑ 009 and VWD 12‑ 002 are now incorporated into the cost ‑of‑service analysis and rate structure adopted by this Resolution, based upon the actual and proportional cost of service as documented in the Study.

SECTION 5. Findings.

The Board of Directors of the Victorville Water District hereby further finds and determines all of the following:
a. That prior to the close of the Public Hearing and final tabulation of written Protests, District Staff considered and responded in writing to all ____ valid written Legal Objections (“ Legal Objections ”) received by the District as specified in Government Code Section 53759.1 and the procedure adopted by the Board of Directors in Resolution No. VWD 26-011. Such Legal Objections and responses were further presented to the Board of Directors for consideration just prior to the start of the Public Hearing, at which time the Board of Directors determined : (1) that the valid Legal Objections and the District’s responses did not warrant clarifications of the proposed New Water Rates; (2) that no reduction of the p roposed New Water Rates was warranted; (3) that no further review of the proposed New Water Rates was needed before determining whether clarification or reduction was warranted; and (4) to proceed with the Public Hearing and protest tabulation.
b. That at the close of the Public Hearing, the District received __________ _ valid written protests against the proposed New Water Rates set forth in the mailed written notices and in Section 3 of this Resolution. The District Secretary has certified the tabulation of written protests. As valid written protests were not presented by a majority of record owners of parcels upon which the proposed New Water Rates are to be imposed, the Board of Directors is authorized to adopt and impose the New Water Rates set forth in Section 3 of this Resolution.
c. That, as demonstrated by the Study, the revenues derived from the New Water Rates will be utilized to meet the costs of operation, maintenance, regulatory compliance, administration, and capital improvements necessary to provide water service within the District’s service area, and does not exceed the funds required to provide water services.

d. That the revenues derived from New Water Rates will not be used for any purpose other than providing water service, which service includes water capital projects that upgrade and/or repair infrastructure within the District’s service area.

e. That the Study has created a rate structure which ensures that the amounts of the New Water Rates imposed on any parcel or person as an incident of property ownership will not exceed the proportional cost of the service attributable to the parcel.

f. That the New Water Rates will be imposed only for water or water services actually used or immediately available for use by the parcels on which they are imposed.

g. That the revenues derived from the New Water Rates will not be used for general governmental services, including police, fire, ambulance or library services.

SECTION 6. Supersession of Prior or Conflicting Resolutions.

All resolutions or administrative actions by the Board of Directors, or parts thereof that are inconsistent with any provision of this Resolution are hereby superseded, but only to the extent of such inconsistency.

SECTION 7. Compliance with Law; Severability.

If any section, subsection, clause or phrase in this Resolution is for any reason held invalid, the validity of the remainder of this Resolution shall not be affected thereby.

SECTION 8. Certification.

The District Secretary is directed to fill in the number of valid written Legal Objections filed in Section 5 .a, above and the number of valid written protests received in Section 5.b, above; shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of the District; and shall make a minute of passage and adoption thereof in the records of the proceedings of the District, in the minutes of the meeting at which this Resolution is passed and adopted.

SECTION 9. Effective Date.

This Resolution shall take effect immediately upon its adoption.

This notice is being sent to all property owners of record who receive water service from the District to describe the P roposed Rates, explain how they were calculated, and provide the reasons they are being imposed. Such notice is required by California Constitution Article XIII D (also known as “ Proposition 218”) whenever a public agency proposes changes to property-related fees, such as water service. Proposition 218 also requires the District to conduct a public hearing prior to adopting the Proposed Rates and provide property owners with the opportunity to submit a written protest to the P roposed Rates. These requirements ensure transparency, accountability, and an opportunity for customers to participate in the rate‑setting process.

2 REASONS FOR THE PROPOSED RATES
The District strives to provide safe, reliable, and high-quality water and water delivery services to its customers at a reasonable cost, while adhering to regulatory requirements and maintaining fiscal and environmental responsibility. As part of its fiscal responsibilities , the District regularly evaluates the cost of providing water and water systems/services (“ Water Service”) to confirm that expenses are balanced with revenues. To that end, the District engaged an independent consultant to perform a comprehensive cost of servi ce analysis/rate study (“Rate Study”) to evaluate costs associated with the District’s operations and maintenance requirements , infrastructure needs, programs, and administrative functions directly related to providing W ater Service.

As required by Proposition 218, this notice and the Proposed Rates must reflect the District’s actual costs of providing water service (“Cost of Service ”). Water rates must be based upon the
expenses involved in operating and maintaining the water system, treating and delivering water, and completing necessary repairs, replacements, and infrastructure improvements needed to ensure safe and reliable service. In sum, Cost of Service simply means that the Proposed Rates must be based on what it truly costs the District to provide safe water to customer homes and businesses, and that customers only pay for the proportional cost of the water they use and the demands they place on the water system, as shown in the Rate Study.

The Rate Study concluded that
the District should update its methodology for calculating rates and charges to: (1) align with current legal and industry standards; and (2) fully recover the costs of providing Water Service, which have risen over the past five years ( e.g., pumping power, wholesale water purchases, costs of goods and services, and state-mandated drinking water compliance requirements). The Proposed Rates will help the District continue to fund needed capital improvements to deliver safe and reliable drinking water, strengthen fire service capacity, minimize water main breaks, maintain operational and financial stability, and prevent operating deficits and reserve shortfalls.

BASIS UPON WHICH THE PROPOSED RATES WERE CALCULATED
Water Rate Structure. T he District’s current and proposed rate structure consists of two components: (1) a monthly fixed service charge, imposed upon all customers based on the size or capacity of the meter serving the property , which covers the fixed cost of providing water service and maintaining water service avail ability; and (2) a variable/ volumetric water consumption charge (rate), based on the amount of water us ed by each customer during the billing period, measured per hundred cubic-feet (“hcf”). One hcf is equal to 748 gallons of water.

The Proposed Rates are projected to yield a revenue increase of 4.0% each year through fiscal year (FY) 2030-2031.

Rate Tables. Table 1 shows the changes that the District proposes to make to its monthly fixed
service charges and the changes proposed to be made to the water consumption (variable/volumetric) rates. Table 2 contains Drought Surcharges, which would only be added to the consumption rates shown in Table 1 (other than for recycled water) under the circumstances summarized below.

Monthly Service Charges
. Table 1 provides a side-by-side comparison of the District’s current and proposed new monthly fixed service charges. The proposed charges are designed as part of a rate structure consisting of 40% fixed revenue recovery and 60% volumetric revenue recovery. The fixed an d volumetric rate components allow the District to stabilize the revenue needed to provide safe and reliable Water Service while equitably allocating costs among customers.
3 Water Consumption Rates
. Table 1 also provides a side- by-side comparison of the District’s current water consumption (variable/volumetric) rates and shows the proposed new rates to be imposed for water consumption, unless drought conditions necessitate imposition of the surcharges outlined in the Drought Surcharges rate schedule as further explained below . The water consumption rates have been restructured so that all customer classes will have a uniform volumetric rate. The current two-tiered residential rate structure has been discontinued in favor of a single-tier structure to ensure the District’s costs of service are proportionally allocated among all customer classes in accordance with Proposition 218.

Drought Surcharges
. The surcharges shown in Table 2 may be activated following notice and a public hearing if drought conditions at various response stages significantly reduce water usage and sales below levels necessary to sustain required rate revenues during the upcoming five-year period. Should dramatic climatic or regulatory changes necessitate activation of these surcharges, the District will send a written notice of imposition of Drought Surcharges to affected property owners at least thirty (30) days prior to the date any change becomes effective.

Although water consumption and meter sizes do vary, a typical single-family residential parcel with a ¾ inch meter connection (approximately 89% of all District customers) uses an average of 12 hcf (8,976 gallons) per month. A sample of billing impacts (comparing monthly bills based on the District’s current Water Service charges and rates to bills based on the Proposed Rates for fiscal year 2026-2027), is shown below in Chart A.

HOW TO RECEIVE ADDITIONAL INFORMATION
The Proposed Rates shown in Tables 1 and 2, and the comparison in Chart A, are based on information and calculations from the Rate Study. The Rate Study also includes additional charts showing estimated customer billing impacts for fiscal years 2027-2028 through 2030-2031 and other information regarding the District’s Cost of Service analysis and how the Proposed Rates were calculated. The Rate Study is available for review at the District offices at City Hall, and online at: https://www.victorvilleca.gov/Government/Legally-Required-Postings. HOW TO SUBMIT A
PROTEST: Any property owner of record of an identified parcel subject to the Proposed Rates (each an “Affected Parcel”), may submit a written protest (“Protest”). Only one Protest will be counted per identified parcel. To be valid, a Protest must: (1) state that the identified property owner is protesting the proposed water rate changes; (2) provide the location of the identified parcel (by street address or assessor’s parcel number); and (3) include the printed name and original signature of the submitting property owner.

Written protests may be submitted by mail to
the Victorville Water District, Secretary of the Board
at P.O. Box 5001, Victorville, CA 92392; or in person to the Victorville Water District, Secretary of the Board, 14343 Civic Drive, Victorville, CA 92392. Protests made by telephone, e-mail, social media, or other electronic means will not be accepted as a valid written protest. “Proposed Water Rates Protest” must be written or typed on the front of each envelope in which a protest is

5 submitted. Written protests may also be submitted at the July 21st, 2026 Public Hearing; however, in order to be counted, all written protests (whether mailed or submitted in person) must be received by the District prior to the close of the public comment portion of the Public Hearing. Oral protests at the public hearing will not qualify as a protest unless accompanied by a written protest.

At the Public Hearing, the Board will accept and consider all written protests and hear all oral comments on the Proposed
Rates. At the conclusion of the Public Hearing, the Board will consider adopting the proposed changes to the water rates and service charges described in this notice as follows:

1. If valid written protests
against the Proposed Rates are received for a majority of the Affected Parcels, the Board will not adopt the Proposed Rates.

2. Alternatively , if written protests are not received for a majority of the Affected Parcels, the Board may vote to adopt the Proposed Rates, provided all valid Legal Objections have also been reviewed and considered. If adopted, the Proposed Rates will be the maximum allowable rates for the Water Service described in this notice that the District may impose annually over the next five years, commencing as of August 1, 2026.

WRITTEN LEGAL OBJECTION PROCEDURE
Property owners wishing to preserve the ability
to legally challenge the Proposed Rates
described in this notice must file a written legal objection (“Legal Objection”) as described below no later than 12:00 pm (Noon) on Monday, July 20, 2026. Legal Objections will only be considered valid if they meet ALL of the following requirements:
o Must be in writing
;
o Must be filed separately from Protests;
o Must be received by the District Secretary no later than Monday, July 20, 2026 at 12:00 pm (Noon);
o Must be mailed to the Victorville Water District, Secretary of the Board at P.O. Box 5001, Victorville, CA 92392; hand delivered to the Victorville Water District, Secretary of the Board, 14343 Civic Drive, Victorville, CA 92392; or alternatively, may be emailed to [email protected].
o Must include the following information:
• The identified parcel (street address or assessor’s parcel number) subject to the Proposed Rates;
• The legal name of the objecting property owner;
• A statement that the communication is a Legal Objection to the proposed water rates (if submitted in an envelope, “Legal Objection to Proposed Water Rates” must be written or typed on the front of the envelope);
• A description of the nature of the L egal Objection, with sufficient specificity to allow the District to respond in writing. A statement that the Proposed Rates violate Proposition 218, are too high, or are illegal, without an explanation of the legal basis of the claim, will be insufficient to constitute a Legal Objection.

Failure to submit a
Legal Objection in accordance with the requirements set forth above will bar any right to challenge the Proposed Rates through a legal proceeding.

While the same person or entity may submit both a protest and a Legal Objection, in order to be valid, P
rotests and Legal Objections must be submitted separately and be clearly labeled as EITHER a Protest or a Legal Objection. Any written submission labeled as both a Protest and a Legal Objections shall be deemed invalid.
6 Prior to the close of the Public Hearing, the
District will review and respond in writing to any valid Legal Objections. Written responses to valid Legal Objections will be prepared and made available to the public prior to or at the Public Hearing on the Proposed Rates. Responses may be posted on the City’s website and made available through the District Secretary. Copies may also be provided upon request. The District’s response will explain the substantive basis for retaining or altering the Proposed Rates. The Board will receive and consider all written responses prior to adopting the Proposed Rates.

California Government Code Section 53759 specifies a 120-day statute of limitations for judicially challenging all rates set forth in this notice that runs from the effective date of the resolution adopting the Proposed Rates

That same section of the Notice also contained a phone number property owners may call to receive additional information about the proposed water rates, and callers were advised that they could receive a copy of the Rate Study by mail at no charge. The Rat e Study (copy enclosed for your convenience) was also available for review in the District Offices at City Hall as indicated in the Notice.

In addition, the District held a public workshop on April 24, 2026 regarding the proposed water rates, and a second meeting was held regarding adoption of the proposed water rates on June 2, 2026, both of which were noticed via agenda as required by the Brown Act. Materials from these meetings are available for review o n the District’s website at the following link:

Should you so desire, the District will mail you copies of these materials as well.

In other words, the Notice alone was never intended to be the sole source of information relating to the proposed water rates. The District’s detailed information regarding the cost of providing water service to its customers and how the water rates were s tructured to apportion those costs among property owners/parcels was provided by the enclosed Rate Study, as required by Government Code Section 53759.1. For example:

• Identifying the actual cost of running the water system. Section 3 (“Financial Plan,” p. 9) shows operating costs, capital needs, reserves, and inflation projections. Page 11 lists the cost inflation factors, and Appendix Table 5 shows how those factors were applied. • Showing how customer data was used to divide costs fairly. Section 4 (“Cost of Service Analysis and Rate Derivation”) explains how costs were allocated based on water use, meter size, number of customers, and system capacity needs. Appendix Tables 11 - 14 show customer counts, water use by class, meter‑equivalent factors, and consumption used to calculate volumetric rates.
• Providing the step‑by‑step calculations used to develop the rates. Section 4 includes the formulas and tables used to determine fixed meter charges and volumetric rates, including how costs were grouped (commodity, capacity, customer, recycled water, fire service) and assigned proportionally.
• Showing how the proposed rates align with the cost of serving each customer type.

The Study includes tables comparing current and proposed rates, customer bill impacts, and regional comparisons, allowing property owners to see how calculated costs match the rates they would pay.

Proposed Resolution Number VWD 26-010 will allow delinquent balances to be collected for Fiscal Year 2026-2027, assessed by the County Assessor; assessments to be submitted for an estimated total of $768,823.50.

Strategic Plan Goal:

This item aligns with Goal A, Financial Sustainability – foster fiscal health through disciplined long-term planning, cost control, increased revenues, and cost recovery. By adding the non-paid charges to the taxes levied upon the property, the Victorville Water 4 8

District is able to collect expected revenues and help maintain water rates as low as possible.

Discussion:

Attached is a report of delinquent non-paid charges for water services within the Water District. The list includes the property location, assessor’s parcel number (APN), amount of unpaid charges, and property owner. The property owners have been notified of their delinquency and of the public hearing. As of this date, the balances shown remain unpaid.

Per California Water Code Section 31701 (e) and 31701.5, accounts that are more than sixty days delinquent and have unpaid charges may be included in the property tax levied and shall constitute a lien on said property.

Senate Bill 998 (SB 998), the Water Shutoff Protection Act, established requirements governing the discontinuation of residential water service for nonpayment, including written notice procedures and protections for eligible residential customers experiencing financial hardship or qualifying medical conditions. Senate Bill 3 (SB 3) expanded these protections by requiring water agencies to adopt formal policies that provide deferred payment and alternative payment options for customers with delinquent accounts without requiring documentation of a qualifying medical condition or proof of income.

Due to Senate Bill 3 (SB 3), the Victorville Water District (VWD) temporarily suspended residential water service disconnections until the required policy could be implemented.

As a result, delinquent accounts that would have otherwise been resolved through the shutoff process continued to accumulate and instead proceeded through the lien process.

Consequently, the number of accounts eligible for lien placement increased significantly, resulting in the issuance of 4,157 Notices of Public Hearing (NOPH) this year, compared to an average of approximately 500 notices in prior years.

Notices of the Public Hearing and availability of the written report were mailed to all affected parcel owners on June 12, 2026, and published twice in the newspaper on June 19, 2026, and July 3, 2026. The notice mailed out to parcel owners provides them with an opportunity to remedy the arrearage on or before July 28, 2026, at 4 p.m. to avoid having the delinquent non-paid charges added to the annual taxes levied upon their property. Delinquent balances paid before the deadline will be removed from the list submitted to the County Assessor.

Staff remains available for any questions the Board of Directors may have.

A RESOLUTION OF THE VICTORVILLE WATER DISTRICT, CITY OF VICTORVILLE,

ADDING DELINQUENT NON-PAID CHARGES TO ANNUAL TAXES LEVIED UPON THE

PROPERTY FOR WHICH THE CHARGES ARE DELINQUENT AND UNPAID

WHEREAS, the Board of Directors of Victorville Water District has prepared a report and statement of those delinquent non -paid charges for water and other services within the District, which will be delinquent and unpaid for sixty days or more shall they remain unpaid as of July 28, 2026, done under and pursuant to Section 10.04.060 of the Victorville Municipal Code; and

WHEREAS, the Board has decided that said delinquent and unpaid charges are to be included in the property tax levied and shall constitute a lien on said property pursuant to California Water Code Sections 31701(e) and 31701.5 et seq; and

WHEREAS, after the filing of said assessment/lien, the City Clerk has, as required by law, given notice of the filing of said assessment and of the time fixed in said notice for hearing by this Board of Directors; and

WHEREAS, all property owners involved in this assessment/lien have been duly notified pursuant to California Water Code Section 31701.6.

WHEREAS, a Public Hearing was held before the Board of Directors of the Victorville Water District, at 6:00 p.m., July 21, 2026, in the Victorville City Council Chambers, 14343 Civic Drive, Victorville, California, the time and place fixed in such notice; and

WHEREAS, during the aforementioned Public Hearing, all appeals, protests or objections, if any, were duly presented and all persons desiring to be heard thereon were heard and the Board of Directors gave all persons present an opportunity to be heard in respect to any matter relating to said work, to any act or determination of said Board of Directors in relation thereto, to the correctness of said assessment, or to any matter relating to said work, or the proceedings therefor; and

WHEREAS, all such persons desiring to be heard have been heard by the Board of Directors and are fully informed in the premises.

THEREFORE, THE BOARD OF DIRECTORS OF VICTORVILLE WATER
DISTRICT DOES HEREBY RESOLVE, DETERMINE, AND ORDER AS FOLLOWS:

SECTION 1. That said hearing has been duly held; that each and every step in the proceedings prior to and including the hearing has been duly and regularly taken; that this Board of Directors is satisfied with the correctness of the assessment; the proceedings and all matters relating thereto; and that all protests, objections, or appeals be and the same are hereby overruled and denied, and the Board of Directors does hereby confirm said proceedings and said assessment.

SECTION 2. That the report of the Victorville Water District’s delinquent and unpaid charges for water and other services within the District, which remain unpaid and delinquent for sixty days or more as of July 28, 2026, is hereby adopted and approved by said Board.

SECTION 3. That the Secretary shall file with the County Auditor of San Bernardino County a copy of such written report with a statement endorsed hereon over the signature of the Secretary, that such a report has been adopted and approved by the Board of Directors and that the San Bernardino County, Auditor-Controller/Treasurer/Tax Collector shall enter the amount of such charges against the respective lots or parcels of land as they appear on the current assessment roll.

SECTION 4. That the amount of unpaid charges shall be added to the annual taxes next levied upon the property by the San Bernardino County, Auditor - Controller/Treasurer/Tax Collector, and that the amount of such charges shall constitute a lien on that property purs uant to California Water Code Section 31701. 5, and that the amount of such unpaid and delinquent charges shall be collected at the same time and in the same manner, as the County taxes are collected, and shall be delinquent at the same time, and thereafter be subject to the same delinquency penalties . After collection by the County, the net amount of the levy shall be paid to the City Treasurer of the City of Victorville.

SECTION 5. That all liens not paid within one year from the adoption of this resolution shall bear interest on the unpaid balance at the rate of ten percent (10%) per annum on the unpaid balance.

SECTION 6. That the parcels to be liened and the amount of said lien are set forth on Exhibit "A" attached hereto and made a part hereof. Unpaid balances will continue to be updated prior to submission as payments and/or charges are posted to the account.
