Release of Existing Subdivision Improvement Agreement with Lien Agreement for Tract Map Nos. 16894-1 and 16894-2
Recommendation:
That the Honorable City Council approve the release of the existing Subdivision Improvement Agreement with Lien Agreement for Tract Map Nos. 16894-1 and 16894-2 recorded on April 14, 2021.

There is no fiscal impact associated with this item.
Strategic Plan Goal:
This item aligns with “Goal E - Invest in Infrastructure” in the City of Victorville Strategic Plan 2023-2026. Although this is not a Capital Improvement Project, the City applies the same strategy to private development projects, as they are essential in meeting the community’s needs.
Background:
Tract Map Nos. 16894-1 and 16894-2 is a residential subdivision consisting of 142 single- family residential lots, located at the southwest corner of Mojave Drive and Topaz Road.
The original developer, Mojave Onyx Development Company, entered into a Subdivision Improvement Agreement (SIA) and Lien Agreement with the City, which was recorded against Tract Map Nos. 16894-1 and 16894-2 on April 14, 2021. Since that time, ownership of the property has been transferred to Victorville 142 L.P. On May 20, 2025, the new owner entered into a new Subdivision Improvement Agreement (SIA) with the City for Tract Map No. 16894-1 and a Subdivision Improvement Agreement with Lien Agreement for Tract Map No. 16894-2. The new owner also provided the required improvement securities for Tract Map No. 16894-1 and a new lien agreement for Tract Map No. 16894-2. The required public improvements include water, sewer, storm drain, 4 8

street, Landscape Maintenance Assessment District (LMAD), and monumentation improvements.
Discussion:
As a result of Victorville 142 L.P. entering into a new Subdivision Improvement Agreement on May 20, 2025, for Tract Map No. 16894-1 and a new Subdivision Improvement Agreement with Lien Agreement for Tract Map No. 16894-2, the original Subdivision Improvement Agreement with Lien Agreement recorded on April 14, 2021, is no longer required. Therefore, staff recommends that the City Council approve the release of the Subdivision Improvement Agreement with Lien Agreement associated with Tract Map Nos. 16894-1 and 16894-2, recorded on April 14, 2021, in its entirety.
