Subject:

Southern California Edison Easement on Mesa Street and Topaz Road Recommendation:

That the Honorable City Council:
(1) Grant exclusive utility easement to Southern California Edison on Assessor Parcel Numbers (APNs) 3136-451-08, 3136-451-11, and 3136-451-12 as described in the attached documents; and
(2) Authorize the City Manager to execute the easement on the City's behalf.

Fiscal Impact:

There will be no fiscal impact resulting from this action.

Strategic Plan Goal:

This item aligns with “Goal E Invest in Infrastructure” in the City of Victorville Strategic Plan 2023-2026. Approval of the easement will allow Southern California Edison to install the necessary infrastructure to allow LGI Homes continue development of Tract No. 17584.

Background:

The Lane’s Crossing community consists of 550 single-family residential lots located near Mesa Street and Mesa Linda Street, as shown in the Vicinity Map (Attachment A). This project encompasses Tract Map Nos. 17582, 17583, and Nos. 17585 through 17588, which overlay Master Tract Map No. 17584. Originally approved under the name "Vista del Valle" at the December 7, 2021 City Council meeting, the final maps were subdivided by the previous developer, Joshua Tree Fund 589 VIC, LLC. Per Victorville Municipal Code Section 17.64.065, Joshua Tree initially secured final map approval through a Subdivision Improvement Agreement (SIA) secured by a Lien Agreement. In 2022, LGI Homes (LGI) acquired the tracts and renamed the community "Lane’s Crossing" to honor 4 8
2 7
Captain Aaron G. Lane, the first pioneer settler on the Mojave River who established an 1800s ranch and traveler store in the area.

At the August 16, 2022 meeting, the City Council approved a new SIA with LGI, which is detailed in Approved Phasing Plan (Attachment B). This update secured Phase 1 with improvement bonds and Phases 2 and 3 with a new lien agreement. Under this arrangement, Phase 1 focuses on Tract Map Nos. 17585 and 17586 alongside the extension of Topaz Road from Mesa Street to Eucalyptus Street. Phase 2 encompasses Tract Map Nos. 17587 and 17588, and Phase 3 concludes the layout with Tract Map Nos. 17582 and 17583.

The Engineering Department issued a Right-of-Way Subdivision permit to LGI for Phase 1 on January 11, 2024, after LGI secured all necessary jurisdictional permits. LGI has since made significant grading progress and completed most of the onsite water and sewer systems. The project is now ready for Southern California Edison (SCE) to install the phase's electrical infrastructure. This follows the City Council's August 16, 2022 action, which granted SCE an exclusive utility easement on Assessor Parcel Number 3136-451-08 to facilitate the initial Mesa Street work order.

Discussion:

The required underground conduits and vault structures will be mostly constructed within the dedicated right-of-way on Mesa Linda Street and Mesa Street. SCE has requested an easement on the City’s lettered lots along the Mesa Street and Topaz Road frontages for further installation. The lettered lots which were dedicated in-fee to the City for the required landscaping and irrigation improvements (LMAD) on Mesa Street and Topaz Road that LGI will ultimately construct.

To satisfy safety and access protocols, SCE requires an eight-foot clearance around all transformer structures, necessitating this additional footprint within the lettered lots. Staff recommends that the City Council grant SCE the requested easements to allow LGI to proceed with tract development. Without the easements in place, SCE cannot energize the utility lines, which will ultimately result in delays in construction.

Staff is available for any questions Council may have.
