Subject:

Consideration of Resolution No. 26-072, Accepting the Unanimous Approval of the Property Owner and Annexing the Woodspring Suites Hotel Development into Community Facilities District No. 2024-01 (Annexation No. 5) Recommendation:

That the Honorable City Council adopt Resolution No. 26-072 to accept the unanimous approval of the property owner and make the findings necessary to annex Assessor Parcel Number (APN) 3093-141-05-0000 to Community Facilities District No. 2024-01 of the City of Victorville (Municipal Services) and to order the levy of Special Taxes to pay for municipal services and maintenance of certain facilities associated with the Woodspring Suites Hotel Development (Annexation No. 5).

Fiscal Impact:

The adoption of Resolution No. 26-072 will offset the financial impact associated with the operations, maintenance, and improvement of public infrastructure and public safety services required for the Woodspring Suites Hotel Development.

This annexation is occurring after the property tax levy deadline for Fiscal Year (FY) 2026-

27. Accordingly, the development will be levied by the special tax rates established in Resolution No. 26-072 beginning in FY 2027-28. Funds received will be deposited into Fund 380 – CFD Tax A (Public Safety) and Fund 381 – CFD Tax B (Municipal Services).

Pursuant to the Rate and Method of Apportionment (RMA), the current Maximum Special Tax A for Commercial Property is $0.0609 per building square foot. The current Maximum Special Tax B for Tax Zone 6 is $4,600.94 per acre.

Beginning July 1, 2026, and each July 1 thereafter, the Maximum Special Tax A and Maximum Special Tax B shall be adjusted from the prior fiscal year's maximum by the greater of: (i) the percentage change in the Consumer Price Index (CPI) for the calendar 4 8

year ending in December of the prior fiscal year, or (ii) five percent (5%). The current projected annual collectible revenues associated with Annexation No. 5 are $2,825.76 for Tax A and $14,630.99 for Tax B.

Special Tax A will fund public safety services, including Police, Fire, Code Compliance and related administrative expenses. Special Tax B will fund road maintenance, graffiti abatement, and related administrative expenses.

Strategic Plan Goal:

This item aligns with Goal A Financial Sustainability, Goal B Public Safety, and Goal E invest in Infrastructure in the City of Victorville Strategic Plan 2023-2026. The proposed annual levies will support the expenses for operations, maintenance, and improvement of the public infrastructure and public safety associated with the Woodspring Suites Hotel Development.

Background:

The City's Strategic Plan identifies financial sustainability as a key priority, emphasizing long-term fiscal planning and cost recovery. To address the ongoing municipal service costs generated by new development, the City evaluated funding mechanisms beyond traditional assessment districts, which do not cover certain services such as road maintenance and graffiti abatement.

Beginning in 2021, City staff explored the formation of a Community Facilities District (CFD) under the Mello-Roos Community Facilities Act of 1982 as a means of funding these additional municipal services. In August 2022, the City implemented a condition of approval requiring applicable development projects to mitigate their ongoing service impacts through annexation into a future citywide CFD or by providing a comparable funding mechanism.

Following the required public hearings and proceedings, the City Council established Community Facilities District No. 2024-01 (Municipal Services) on December 17, 2024, through the adoption of Resolution No. 24-102 and Ordinance No. 2453. The Citywide CFD is structured to fund public safety and maintenance services through special taxes levied on new development. The CFD includes a Future Annexation Area encompassing the entire City, allowing eligible development projects to annex into the district upon approval by the property owner(s) at the time of annexation.

Discussion:

On April 9, 2025, the Victorville Planning Commission unanimously approved Planning Case No. PLAN24-00037, which included an entitlement for the development of a 4-story hotel totaling 46,400 square feet on a 3.18-acre parcel located at the northeast corner of Cottonwood Street and Pahute Avenue as shown in the attached Vicinity Map (Attachment B). One of the conditions of approval for the project was to annex into the Citywide CFD or otherwise mitigate the economic impacts of the development. 4 8

On July 14, 2026, the owner of the Woodspring Suites Hotel Development (TGC VICTORVILLE, LLC), submitted its signed petition to the City, constituting its Unanimous Approval to annex into the Citywide CFD and agreement to the levy of the Special Taxes.

Said petition is Exhibit B to Resolution No. 26-072 (Attachment A).

To ensure a transparent and well-documented annexation process, staff is presenting Resolution No. 26-072 to the City Council for consideration. The resolution identifies the project initiation for the annexation and contains all pertinent information necessary for the City Council to consider and approve the annexation.

To complete Annexation No. 5, staff requests that the City Council consider approval of the attached Resolution No. 26-072 including the proposed annexation boundary (Annexation Map), provided as Exhibit C of said Resolution. Resolution No. 26-072 outlines the following:
Identification of the property owner and legal description of parcels being annexed; Receipt and acceptance of the property owner’s Unanimous Approval (petition); Findings that the public convenience and necessity require the annexation; Adoption of the boundary map (Annexation Map);
Types of services that will be funded through the special taxes; Rate and method of apportionment (RMA);
Creation of a new Tax Zone 6 (See Appendix A of the RMA); and Authorization/direction to staff to record the Annexation Map and an amendment to the Notice of Special Tax Lien.

Should the City Council move forward with adoption of Resolution No. 26-072, staff will record the Annexation Map and the Amendment to the Notice of Special Tax Lien with the County, to complete the annexation.

Staff recommends that the Honorable City Council adopt Resolution No. 26-072 to annex territory to Community Facilities District No. 2024-01 of the City of Victorville (Municipal Services) and to levy the Special Taxes to pay for municipal services and maintenance of certain facilities associated with the Woodspring Suites Hotel Development (Annexation No. 5).

Staff is available for any questions Council may have.
