Subject:

Reduction of Securities for Tract Map No. 17516
Recommendation:

That the Honorable City Council:
(1) Approve the 20 percent release of the Street Faithful Performance Security; and (2) Accept the completed street improvements.

Fiscal Impact:

There is no fiscal impact as a result of this action.

Strategic Plan Goal:

This item aligns with Goal E, Invest in Infrastructure, in the City of Victorville Strategic Plan 2023-2026. Although this is not a Capital Improvement Project, the City applies this same strategy to private development projects as they are essential in meeting the community's needs.

Background:

Tract Map No. 17516 (hereinafter referred to as Tract 17516) is a 39-lot, single-family subdivision, located at the northwest corner of Verano Street and Cataba Road. On July 6, 2021, the City Council approved a Subdivision Improvement Agreement (“SIA”) secured by improvement bonds with Victorville 115 Lots, LP, a California limited partnership also known as Legacy Homes, for development of the tract. The conditions of approval for the tract required the developer to complete various infrastructure improvements, including water, drainage, sewer, street, and monumentation improvements. The developer has made significant progress in the development of the tract. At the regular City Council meeting held on June 6, 2023, the City Council approved the 60 percent release of Street Faithful Performance Security. 4 8

Discussion:

The developer has met the conditions of approval and has successfully completed all requirements for the street improvements. Therefore, staff recommends that the City Council approve a 20 percent reduction of the Street Faithful Performance Security in accordance with Victorville Municipal Code (VMC) Section 17.64.070(1), and accept the completed street improvements. The remaining 20 percent of the Faithful Performance Securities will be held for a one-year warranty period in accordance with VMC Section

17.64.070(4).

Staff is available for any questions Council may have.
