Reduction of Securities for Tract Map No. 16887-2
Recommendation:

That the Honorable City Council:
(1) Approve a full reduction in Landscaping Maintenance Assessment District (LMAD) Labor and Materials Security for Tract Map No. 16887-2; and (2) Approve the full reduction in the Landscaping Maintenance Assessment District (LMAD) Faithful Performance Security for Tract Map No. 16887-2.

Fiscal Impact:

There is no fiscal impact as a result of this action.

Strategic Plan Goal:

This item aligns with “Goal E: Invest in Infrastructure” in the City of Victorville Strategic Plan 2023-2026. Although this is not a Capital Improvement Project, the City applies the same strategy to private development projects, as these projects are essential in meeting the community’s needs.

Background:

Tract No. 16887-2 (hereinafter referred to as Tract 16887-2) is a 149-lot, single-family subdivision located east of Highway 395, between Verano Street and Eucalyptus Street.

On March 16, 2021, the City entered into a Subdivision Improvement Agreement (SIA) with LGI Homes, secured by improvement bonds, for the development of the tract. The conditions of approval require the developer to complete various infrastructure improvements, including water, drainage, sewer, street, landscaping maintenance assessment district (LMAD), and monumentation. The developer has made significant progress toward completion of the tract and anticipates completing the remaining improvements within the coming months. At the September 16, 2025, regular meeting, the City Council approved and accepted the Landscaping Maintenance Assessment District (LMAD) improvements.

Discussion:

To comply with Victorville Municipal Code (VMC) Section 17.64.060(b)(3), the City requires that the portion of the improvement security necessary to guarantee the work through the one-year warranty period be retained until that period has expired. For this project, the remining 20 percent of the Faithful Performance Security represents the amount established through the approved security documents to satisfy this one-year warranty requirement. Consistent with VMC Section 17.64.070(4), this warranty security cannot be released until the warranty period has concluded. As the improvements were accepted at the September 16, 2025, regular City Council meeting and the one-year period has now expired with no outstanding warranty items, staff recommends the full release of the LMAD Faithful Performance Security.

Additionally, pursuant to VMC Section 17.64.070(3), the Labor and Materials Security is required to be held for six months to allow subcontractors that have furnished labor, materials, or equipment to file a claim for payment. That period has concluded, and since the improvements were accepted at the September 16, 2025, regular City Council meeting and no claims have been submitted, staff recommends the full release of the LMAD Labor and Materials Security.

Staff is available to answer any questions Council may have.
