Harry Mayo, Assistant City Engineer
Subject:
Reduction of Security for Tract Map No. 17599
Recommendation:
That the Honorable City Council:
(1) Approve an 80-percent release of the Landscaping Maintenance Assessment District (LMAD) Faithful performance Security for Tract Map No.17599; and (2) Accept the completed Landscaping Maintenance Assessment District (LMAD) Public Improvements.
Fiscal Impact:
There is no fiscal impact associated with this item.
Strategic Plan Goal:
This item aligns with Goal E, Invest in Infrastructure, of the City of Victorville Strategic Plan 2023–2026. Although this is not a Capital Improvement Project, the City applies the same strategy to private development projects, as they are essential in meeting the community's needs.
Background:
Tract Map No. 17599 (hereinafter referred to as “Tract 17599”) is a 22-lot, single-family residential subdivision located between Highway 395 and Richmond Avenue. Tract 17599 was recorded on April 23, 2007; however, the required public improvements were not completed. Since recordation, the property has changed ownership multiple times.
On December 21, 2021, LGI Homes – California, LLC, a California Limited Liability company (LGI), acquired Tract 17599 and entered into a Subdivision Improvement Agreement (SIA) with the City to secure completion of outstanding public improvements.
The Conditions of Approval for Tract 17599 require the developer to complete various infrastructure improvements, including water, drainage, sewer, street, Landscaping Maintenance Assessment District (LMAD), and monumentation improvements. Since entering into the SIA, LGI has made significant progress toward fulfilling these requirements and completing the remaining improvements for the tract.
Discussion:
The developer has satisfied the Conditions of Approval and successfully completed the requirements associated with the LMAD improvements. The LMAD improvements were placed into a 90-day plant establishment and maintenance period, which concluded on July 19, 2025.
Therefore, staff recommends that the City Council accept the completed LMAD improvements and approve an 80-percent reduction of the original LMAD Faithful Performance Security, in accordance with Section 19 of the SIA and applicable provisions of Victorville Municipal Code (VMC) Sections 17.64.060(b)(3) and 17.64.070.
Following the 80-percent reduction, the remaining 20-percent of the original Faithful Performance Security will be retained as warranty security for the one-year warranty period, consistent with Section 19 of the SIA and VMC Sections 17.64.060(b)(3) and
17.64.070(4), to guarantee improvements against defective work, labor, or materials.
Staff is available for any questions Council may have.
