Subject:

Release of Securities for Tract Map No. 16677
Recommendation:

That the Honorable City Council approve the full release of the Sewer and Street Labor and Materials Securities for Tract Map No. 16677.

Fiscal Impact:

There is no fiscal impact as a result of this action.

Strategic Plan Goal:

This item aligns with Goal E, Invest in Infrastructure, of the City of Victorville Strategic Plan 2023–2026. Although this is not a Capital Improvement Project, the City applies the same strategy to private development projects, as they are essential in meeting the community's needs.

Background:

Tract No. 16677 (hereinafter referred to as “Tract 16677”) is a subdivision of 215 singlefamily lots located at the northeast corner of Mesa View Drive and Dos Palmas Road. In 2005 Canterbury Hills, LLC, the original developer of Tract 16677, recorded the map after entering into a Subdivision Agreement and posting securities for the required public improvements. Canterbury Hills, LLC began construction of the required public improvements; however, due to the economic downturn of 2008, development came to a halt. At its regularly scheduled City Council meeting on July 19, 2022, the City Council entered into a Subdivision Improvement Agreement with Mojave HM, LLC (Pacific Communities). The conditions of approval required the developer to complete various infrastructure improvements, including water, drainage, sewer, street and monumentation improvements. The developer has since made significant progress toward completion of the tract. At its regularly scheduled meeting on April 7, 2026, the City Council accepted the sewer and street public improvements.

Discussion:

Per Victorville Municipal Code Section 17.64.070(3), the Labor and Materials Securities were held for a six-month period following acceptance of improvements to allow subcontractors and/or persons who furnished labor, materials, equipment or any other obligations secured thereby an opportunity to file a claim for payment.

The sewer and street public improvements were accepted by the City Council on April 7, 2026. The six-month holding period has now been satisfied, and no claims have been filed against the Labor and Materials Securities. Therefore, staff recommends the full release of the Sewer and Street Labor and Materials Securities for Tract Map No. 16677.

Staff is available for any questions Council may have.
