She shared that she felt the City has more control by approving it with the conditions, and that she did not feel it could be denied. Mayor Pro Tem Frackelton shared the negative and positive aspects of the project. Councilmember McBride noted that there is pressure from the State Department of Housing and Community Development to amend the zoning to densify the E-4 residential. He explained that this was a way to add housing and preserve the community.
Councilmember Miles expressed that this was an outside land developer. She expressed disfavor for the project; she noted they did not reach out to residents, expressed concerns for short-term rentals, and expressed concern over Mesa Investors. She expressed concern over ADUs that could be added and the increase in housing on a narrow street and its impact on the road. Councilmember Miles expressed that she desired to know the intent of the property and that conditions of approval be strong enough to hold the applicant to the purpose that they themselves declare. Councilmember Miles requested a continuance so they could further discuss and insert language to guarantee it would be a single-family dwelling home. She also requested to sit down with the developers.
A motion was made by Councilmember Miles to continue the item.

He asked City Attorney Todd Litfin if intent with the developer on the property became void once it was sold. City Attorney Todd Litfin stated that if there is a recorded covenant that outlines uses that are allowed on the property that is recorded and all subsequent purchasers are bound thereby and are deemed to have notice, then they are required to follow the conditions.
