City Manager Steve Franks presented a brief staff report on the item as detailed in the public agenda report. He highlighted that the work would not affect the walkway.
Councilmember Jones expressed that the residents were concerned that by allowing the encroachment over the whole property, even if they're only allowed to develop on the site plan now, the fact that they're granting the encroachment leaves that area open to allowing later development. Councilmember Jones inquired if that would be the case. City Manager Steve Franks responded that everything outside the easement was in Orange, and he then confirmed that the City would work with the owner and that the walkway would not be affected.
Councilmember Miles asked why the item was not a public hearing. City Attorney Todd Litfin responded that most encroachment permits were ministerial and usually do not go to council and that there was no legal requirement to do so. Councilmember Miles also inquired how the City ensures that by approving the item, the City is not creating the appearance of preferential treatment and asked how the City separates this item's action from future potential variance granting. City Manager Steve Franks responded that the actions would be separate and that the variance would come at a different time as a separate agenda item. City Attorney Todd Litfin informed the council the variance would require a public hearing. Councilmember Miles inquired if the variance for the wall would be denied if the area would still be left open.
The contractor for the property owner, Clay Barret, provided public comment. He shared that the purpose of the fence was for security and safety.
Councilmember Miles inquired what the property owner's plan was if the encroachment was approved and the variance later denied. Contractor Clay Barret responded that the motivation behind the encroachment was for the six-foot wall. Contractor Clay Barret expressed that a 3-foot wall was not ideal, but if later denied, the property owner would still take some course of action for property security.
