RESOLUTION NO. 2021-38
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VISALIA, RECOGNIZING THE EXPANSION OF THE CITY OF VISALIA URBAN DEVELOPMENT BOUNDARY FROM THE CURRENT TIER I BOUNDARY TO THE TIER II BOUNDARY FOR RESIDENTIAL AND COMMERCIAL (EXCLUDING REGIONAL RETAIL) LAND USE DESIGNATIONS AND TO THE TIER III BOUNDARY FOR INDUSTRIAL LAND USE DESIGNATIONS IN ACCORDANCE WITH POLICY LU-P-21 OF THE VISALIA GENERAL PLAN LAND USE ELEMENT.
WHEREAS, the City of Visalia has met the criteria to expand the City of Visalia Urban Development Boundary from the current Tier I boundary to the Tier II boundary for Residential and Commercial (excluding Regional Retail) land use designations and to the Tier III boundary for Industrial land use designations in accordance with Land Use Policy LU-P-21 of the Visalia General Plan Land Use Element; and, WHEREAS, the Visalia General Plan Update, adopted October 14, 2014, provides for three successive Urban Development Boundaries referred to as Tier I, Tier II, and Tier III, that are intended to manage growth in and around Visalia; and, WHEREAS, the stated purpose of the Urban Development Boundaries are to guide the timing, type, and location of growth, to preserve resource lands, natural features, and open space, and to promote infill and redevelopment; and, WHEREAS, Policy LU-P-21 of the General Plan Land Use Element includes phasing thresholds based on the issuance of building permits for allowing annexation and development of urban land within the Urban Development Boundary Tier II and Urban Growth Boundary Tier III; and, WHEREAS, City staff has monitored the issuance of building permits for housing units and the issuance of building permits for non-residential land uses on a quarterly basis during each calendar year since the adoption of the Visalia General Plan Update, and has presented to the City Council reports regarding the status of reaching the thresholds on January 16, 2020, April 6, 2020, and March 17, 2021; and, WHEREAS, City staff has determined that the thresholds have now been met for the expansion of the Urban Development Boundary to allow annexation and development of lands with Residential and Commercial land use designations within Tier II and land with Industrial land use designations within Tier III; and WHEREAS, the Program Environmental Impact Report (EIR) prepared for the City of Visalia General Plan Update (SCH No. 2010041078), adopted by the City Council on October 14, 2014, and certified by Resolution No. 2014-37, can and will be utilized for this action. Urban development occurring within Growth Boundary Tiers II and III in accordance with the underlying General Plan land use and zoning designations was addressed within the scope of the Program EIR. Expansion into Growth Boundary Tiers II and III was anticipated upon reaching the specific triggers identified in Land Use Policy LU-P-21. As a result of the proposed project, no new effects could occur and no new mitigation measures would be required that were not already addressed within the scope of the Program EIR.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Visalia makes the following findings with regard to the expansion of the Urban Development Boundary:
The City of Visalia previously certified Program Environmental Impact Report (EIR) prepared for the City of Visalia General Plan Update (SCH No. 2010041078) on October 14, 2014 by Resolution No. 2014-37. The method to incrementally expand the Urban Development Boundary through General Plan Land Use Policy LU-P-21 is the implementation of mitigation measures that serve to protect prime agricultural land as long as possible. The City of Visalia has determined that the expansion to the Urban Development Boundaries identified in the Visalia General Plan Update falls within the scope of issues and impacts addressed in the Program EIR.
There is a need for more land to be made available for future residential and job growth.
Expansion of the Urban Development Boundary from the Tier I to Tier II for Residential and Commercial (excluding Regional Retail) land uses and to Tier III for Industrial land uses is consistent with the Visalia General Plan Land Use Policy LU-P-21 and appropriate at this time.
The residential threshold of issuing building permits for 5,850 housing units since April 1, 2010 that is necessary to expand from Tier I to Tier II has been met. As of July 1, 2021, the City has issued permits for 5,868 housing units.
The threshold of issuing building permits totaling 480,000 square feet of commercial space on designated Commercial Mixed Use, Downtown Mixed Use, Office, and Service Commercial land since April 1, 2010 that is necessary to expand from Tier I to Tier II has been met. As of January 1, 2015, the City has issued permits for 522,556 square feet of commercial building space.
The threshold of issuing building permits totaling 2,800,000 square feet of industrial space on designated Industrial, Light Industrial, and Business Research Park land use since April 1, 2010 that is necessary to expand from Tier I to Tier III has been met. As of July 1, 2020, the City has issued permits for 3,264,040 square feet of industrial building space.
The additional land is either adequately served or can be served by planned and programmed public facilities including streets, sanitary sewer, water, police/fire protection, and other urban services and facilities.
Additional land is determined to provide a significant social and economic benefit to the community.
BE IT FURTHER RESOLVED that the City Council of the City of Visalia hereby allows, upon annexation into the City limits, development of Residential and Commercial land use designations (excluding areas designated for Regional Retail) to occur within the Urban Development Boundary (Tier II) and development of Industrial land use designations to occur within the Urban Growth Boundary (Tier III), in accordance with Land Use Policy LU-P-21 of the General Plan Land Use Element.
