RESOLUTION NO. 2023-27
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VISALIA DIMINISHING AGRICULTURAL PRESERVE NO. 187 located on the north side of Ferguson Avenue, situated approximately 789 feet west of Demaree Street.
WHEREAS, Agricultural Preserve No. 187 and Land Conservation Contract No. 2735, which cover land that is located on the on the north side of Ferguson Avenue situated approximately 789 feet west of Demaree Street within APN 177-190-007, were established and entered into between the County of Tulare and the property owner in 1969 pursuant to the Williamson Act (California Government Code Section 51200 et seq.); and WHEREAS, the subject site was annexed to the City of Visalia on April 18, 2023; and WHEREAS, the property owner has filed an application for cancellation of the 23 acres of Land Conservation Contract No. 2735 and diminishment of Agricultural Preserve No. 187 located on the subject site in accordance with the provisions of the Williamson Act; and WHEREAS, an Initial Study was prepared which disclosed that with the inclusion of mitigation measures no significant environmental impacts would result from this project, and that Mitigated Negative Declaration No. 2022-04 was previously prepared in association with the Victory Oaks Tentative Subdivision Map and Annexation, which sufficiently evaluated the environmental impacts associated with the removal of the Williamson Act restrictions, and adopted by the City Council on November 7, 2022; and WHEREAS, the City Council of the City of Visalia previously authorized the recording of a Certificate of Final Cancellation of Land Conservation Contract No. 2735 on June 19, 2023, based on evidence presented that all conditions of the associated Certificate of Tentative Cancellation have been met, including the filing of a request for the diminishment of Agricultural Preserve No. 187; and WHEREAS, the City Council of the City of Visalia, after ten (10) days published notice, held a public hearing before said Council on July 17, 2023, pertaining to the diminishment of Agricultural Preserve No. 187.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Visalia finds that Mitigated Negative Declaration No. 2022-04 adequately evaluated the potential environmental impacts of the project.
BE IT FURTHER RESOLVED that the City Council of the City of Visalia hereby authorizes the diminishment of Agricultural Preserve No. 187.
