A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VISALIA ADOPTING THE INITIAL STUDY AND MITIGATED NEGATIVE DECLARATION FOR the STONEBROOK STREET CULVERT PROJECT AT PACKWOOD CREEK CROSSING (State Clearinghouse No. 2022020164) WHEREAS, the purpose of the proposed Stonebrook Street Culvert Crossing at Packwood Creek (“Project”) is to provide a crucial component to the future construction of the roadway improvements for a portion of Stonebrook Street identified by the City’s transportation element as a collector street between Caldwell and Cameron Avenues; and WHEREAS, the City Council at the November 16, 2020 City Council meeting authorized the City Manager to execute a professional design services contract with Lars Anderson & Associates, Inc., for the design of the Project (CIP# 2520-72000/CP0043-999); and WHEREAS, the Project will encompass installing a double-box culvert and associated wingwall and headwall construction at the Packwood Creek and Stonebrook Street intersection, which is located approximately three-hundred feet south of Caldwell Avenue on Stonebrook Street; and WHEREAS, an Initial Study and Mitigated Negative Declaration has been prepared for the Project pursuant to the California Environmental Quality Act of 1970 (CEQA), as amended, which disclosed that no significant environmental impacts would result from the Project with the identified mitigation measures applied; and WHEREAS, the Initial Study and Mitigated Negative Declaration for the Project were prepared and noticed for public review and comment for thirty days beginning on February 8th, 2022; and WHEREAS, no comments were received during the advertised comment period which required no modifications to the Initial Study and Mitigated Negative Declaration; and WHEREAS, the City Council of the City of Visalia has considered the whole record before it, including but not limited to the Initial Study and Mitigated Negative Declaration; and WHEREAS, the City Council of the City of Visalia hereby finds that the Initial Study and Mitigated Negative Declaration contain and reflect the independent judgment of the City of Visalia.
NOW, THEREFORE, BE IT RESOLVED that the Initial Study and Mitigated Negative Declaration for the Project was prepared consistent with the California Environmental Quality Act (CEQA) and the City of Visalia Environmental Guidelines.
BE IT FURTHER RESOLVED that the City Council of the City of Visalia hereby finds, on the basis of the whole record before it, that there is no substantial evidence that the Project, with the adopted mitigation measures, will have a significant effect on the environment and hereby adopts the Initial Study and Mitigated Negative Declaration for the Stonebrook Street Culvert Crossing at Packwood Creek, which can also be found in Mitigated Negative Declaration No. 2023-63, State Clearinghouse No. 2022020164.
BE IT FURTHER RESOLVED that the proposed mitigation measures stated in the referenced Initial Study and Mitigated Negative Declaration are hereby adopted and shall be required by the City during Project construction.
BE IT FURTHER RESOLVED the documents and other material which constitute the record of the proceedings upon which this decision is based are located at the office of the Visalia City Planner, 315 E. Acequia Avenue, Visalia, California, 93291, who is designated as the custodian of documents and other materials that constitute the record of this decision.
BE IT FURTHER RESOLVED that City staff are directed to file and record a Notice of Determination with the Tulare County Clerk-Recorder’s office within five (5) days of this Resolution.
