Petitiontoopposetheapprovalofa24-hourJackintheBoxfastfoodrestaurantinourneighborhoodandtomaintainthePlanningCommission’soriginaldecisionoflimitingoperatinghoursfrom5:00amto12:00am.

BACKGROUND
Formanyyears,thepreviousbusinessesontheNortheastcornerofLoversLaneandTulareAveconsistedofadoggroomingsalon,atattooparlor, andasmallstoragefacility. Whilethebuildingitselfmighthavebeenolder, therewereneveranyissuesthatbroughtconcerntotheneighborhood.Thetraffictothesebusinesseswasquiet,mostlybecausecustomerswouldshowupfortheirappointmentsinapproximately30minuteto1hourintervals.

InAugustof2021,aconditionalusepermitwasgrantedtoMikeDavistobuildandoperateafastfoodJackintheBoxrestaurantat1145S.LoversLane.Thispermitincludedaconditionofapprovalthatlimitedthehoursofoperationto5:00amto12:00am.(ConditionofApprovalNo.10forConditionalUsePermitNo.2021-22).Someofthelocalresidentsvoicedtheiropinioninoppositionoftheprojectatthetimeandmanyofuswererelievedtolearnafteritwasbuiltthatitwouldhaverestrictedhoursandwouldnotbeinoperationfor24hoursaday.

Atsomepoint,onhisownaccord,Mr. Davisadjustedthehoursofthislocationtoextendfrom5:00amto1:00am.TherewasasandwichboardadvertisingthesehoursforquitesometimeandthecurrenthourslistedinGoogleMapsstillreportthesehours.

Currently, manyoftheneighborscontinuetoremaininoppositionofa“bait&switch”situationinwhichtherestaurantcouldpossiblybeoperating24hoursoftheday. Thetrafficpatternswiththistypeofbusinessareverydifferentthanthepreviousbusinesses,withcarsandtrafficmovingthroughthelocationeveryfewminutesratherthanevery30minutesoranhour.

LOCATION
Thislocationhasadrivethruthatislocatedmuchlessthantherequired250feetfromanyresidenceorresidentiallyzonedarea.Whilethepreviouslyapprovedconditionalusepermitallowedthislocationtobebuiltonthisspot,itwarrantshighlightingjusthowclosethislocationistomultipleresidences.

OTHER24-HOURBUSINESSES
Ifdriversneeda24-houroptionforfood,therearealreadythreeotheroptionsnearbythatarelocatedinareasthatdonotaffectnearbyresidences.TheselocationsareneartheLoversLaneand198freewayaccessandthemajorintersectionofWalnutAveandLoversLane.Therefore,thereisnoneedtodirectadditional24-hourtraffictoaseparatelocationthatwouldaffecttheresidentsinourneighborhood. 7-ElevenandArco/AMPMarebothlocatedneartheintersectionofLoversLaneandNobleAve,bothlocationsappeartobeatleast400ftfromtheclosestresidence,asshownbelow.

ShellGasstationislocatedatthecornerofLoversLaneandWalnutAve.Thissiteislocatedapproximately180ftawayfromthenearestresidence,butisseparatedbylandscapingandablockwallbarrier, asseeninthephotobelow.

CONCERNS
Someofthemajorconcernsthatneighborshaveareanincreaseintrafficonthiscorner, especiallyduringthelatenightandearlymorninghours.Withincreasedtrafficcomesadditionalnoisepollutionandlightpollutionduringthesehours.TheheadlightsofcarsgoingthroughthedrivethrushinetheirheadlightsatadifferentanglethanthosegoingthroughtheTulareAve/LoversLaneintersection.Theseheadlightsshinedirectlyatthelivingroomandbedroomwindowsofmorethanonehomenearbyastheymaketheirwaythroughthedrivethrough.

Thesefollowingimagesweretakenfrommyparticularresidence,fromrightoutsidemyfrontdoor,whichisdirectlynexttomylivingroomwindow, andfrominsidefrommybedroomwindow,respectively. Otherneighborshavestatedsimilarinstancesofheadlightsshiningintotheirhomes.

Additionally, thereisaconcernregardingthetypeoftrafficanddriversthatthismaybringtoourneighborhoodduringtheearlymorninghours.Thereisaconcernthatthiscouldbringahigherincidenceofintoxicateddriversduringthesehours.Theresidentat2912E.LaurelAvenuehasalreadyhadadrunkdrivercrashintohisfrontlawnintheearlymorninghours(picturedbelow)andhashadanothertrafficaccidentendupinhisfrontlawnfromaseparatecollision.Theneighborhoodwouldprefernottocreateasituationinwhichthistypeofoccurrencecouldhappenonamorefrequentbasis.

THENEIGHBORHOOD
Thisneighborhoodconsistsofmanylong-establishedfamiliesandhomes.Manyofthemhavelivedintheareabetweenten,twenty, thirty, andevensixtyyears.I personallyliveinmychildhoodhomeandhavebeenbabysatbysomeofthecurrentresidencesorsoldGirlScoutcookiestothemmanyyearsago.Weknoweachotherandwelookoutforeachother. Thisareaisaformercountyannex,andthereforeiswithoutthetypicalphysicalbarriers,suchaslandscapingandablockwall,tobusinessesandbusyroads.Anydevelopmentthathappensalongthestreetsadjacenttoourhomesaffectsustoamuchhigherdegreethaninothermorerecentlydevelopedneighborhoodswiththesefeatures.

Throughconversationswithneighbors,I knewI wasnotaloneinhavingtheconcernsrelatedtothispossiblechangeinbusinesshours.Therefore,I recentlycollectedsignaturesonapetitiontoopposetheapprovalofthe24-hourJackintheBoxandtomaintainthePlanningCommission'soriginaldecisionoflimitingoperatinghoursfrom5:00amto12:00am.I collectedatotalof37signatures.Twenty-sevenwereinperson,andanother10wereviaadigitalversionofthesamepetition.

Thesesignaturesrepresented26nearbyresidencesand7otherconcernedresidentswhohavefamilyorfriendsthatthisdecisioncouldaffect.Oursincerehopeisthatthebusinesscouldremainsympathetictotheneighborhoodandmaintainthereducedhoursof5:00amto12:00amthatthePlanningCommisionalreadydecidedwasthebestchoiceforthislocation.

WiththeimprovementsoftheintersectionatLoversLaneandHighway198,weknowthattherewillbemoreprogressandbusinesscomingtoourarea,however, weaskthatthesafety, comfort,andlivabilityofourneighborhoodbestronglyconsideredwhenmakingthesedecisions.Weappreciated

andagreedwiththePlanningCommission'sdecisionandconditionofreducedhoursfortheJackintheBoxat1145S.LoversLaneandimplorethemembersofCityCounciltomaintainthisoriginaldecision.
