REQUEST FOR BIDS RFB No. 24-25-41
ANNUAL CONTRACT FOR BACKFLOW TESTING, REPAIRS, AND MAINTENANCE SERVICES ADDENDUM NO. 1
Issued: Friday, November 21, 2025
Bids Due: THURSDAY, DECEMBER 11, 2025 AT 2:00 PM
Addendum is being issued to provide responses to questions. This addendum becomes part of the RFB 24-25-41 document and must be signed and submitted with bid.
ITEM 1: QUESTIONS/RESPONSES
Q1: In the bid documents it says that minor repairs are part of the unit price to test backflows. If later on it starts to leak, are we still responsible for faulty internals for that same backflow? R1: Contractors will be responsible for all labor in minor repairs. Cost for parts for minor repairs will be paid for by the City by reimbursing the contractor when receipts for parts are included with the invoice to the City.
Labor for major repairs may be billed at contractor’s hourly rate and cost for parts for major repairs will be paid for by the City by reimbursing the contractor when receipts for parts are included with the invoice to the City. Before any work is performed on major repairs, contractor must submit to the project manager an itemized cost estimate for approval prior to making any repairs.
Q2: What if a rebuild is needed, how do we bill this? Is this covered under the cost per device in the bid or would this be additional labor that we are allowed to charge? R2: A rebuild may be billed at contractor’s hourly rate.
Q3: If we are called out for an emergency, do we need to respond within 2 hours? R3: Yes, if the backflow is causing an emergency, we need a response within 2 hours. A 24-hr contact must be provided.
Q4: If a backflow device needs to be replaced, do I need to have my certified backflow tester do the install or can my plumber do the install and my tester do the test?
R4: Plumbers may perform the installation, but the test after repair must be done by a certified backflow tester.
Q5: Is the testing paid at prevailing wage as well, not just the repairs? R5: All labor is to be paid at prevailing wage rate.
Q6: What classifications should we use for prevailing wage rate? R6: DIR classification Plumber: Plumber, Steamfitter, Refrigeration Fitter. Rates may be found on the DIR website: https://www.dir.ca.gov/OPRL/DPreWageDetermination.htm.
Q7: Since this contract will most likely be over $30,000, will there be an exemption from the requirement of hiring an apprentice since backflow testers are required to be certified and apprentices most likely are not certified? R7: No, the City of Visalia cannot provide an exemption as it is a State of California requirement. 1269

Addendum #1 Page 2 of 2
Q8: When do you anticipate this contract to start?
R8: Projected start date is 2/1/26.
Q9: Would you be able to clarify if this project has a PLA (Project Labor Agreement)? R9: The City of Visalia has not entered into a Project Labor Agreement for this project. The City has no ordinance requiring or prohibiting such agreements. If a contractor has a Project Labor Agreement with labor unions, it may be used. Please note that this project is considered a public works contract and therefore, subject to registration with the Department of Industrial Relations, payment of prevailing wages, submission of certified payroll records to the Labor Commissioner and other requirements listed in the City of Visalia Labor Compliance Manual which was attached to the RFB.

Award engineering design services - Authorize the City Manager to award and enter into a contract with Brandley Engineering for the engineering design project for the design phase of the Taxilane “A” and “B” and Hangar H3 Row 10 reconstruction project at Visalia Municipal Airport.
Deadline for Action: None
Submitting Department: Administration - Airport
Contact Name and Phone Number:
Jody Miller, Airport Manager, (559)713-4282, [email protected] John Lollis, Assistant City Manager, (559)713-4323, [email protected] Department Recommendation:
Staff recommends that the City Council authorize the City Manager to enter into a contract with Brandley Engineering for approved CIP project CP0573 for the design phase of the Taxilane “A” and “B” and Hangar H3 Row 10 reconstruction project at Visalia Municipal Airport.
Background Discussion:
As part of the approved Federal Aviation Administration (FAA) Airport Capital Improvement Plan, the FAA funds the rehabilitation, and if needed, replacement of communal aircraft movement areas at airports nationwide. This project is the design phase of the reconstruction of one of these areas (Taxilane “A” and “B” and Hangar H3 Row 10) at Visalia Municipal Airport.
At its meeting on August 4, 2025, the City Council acted to conditionally accept federal funds via an FAA grant in the amount of $134,520 that would fund the majority of the project, the remaining $7,080 will be split between state funds and airport funds.
At its meeting on November 17, 2025, the Council authorized a professional services agreement between the City and Brandley Engineering for the purpose of providing airport engineering design services and project management for a 5-year contract period. The projects that Brandley administers for the Airport, as well as the vast majority of the Airport’s capital improvement program (CIP) projects, are federally funded. This project is included in exhibit A “Scope of Work” in the attached professional services agreement with Brandley Engineering and is why they were selected for the work.
Staff will return to Council for approval for the construction phase of the project following FAA acceptance of the design phase.
Fiscal Impact:
$141,600 has been appropriated for the project from the Airport fund, of which all but $354 will be Visalia City Council Page 1 of 2 Printed on 1/16/2026

Notice of completion - Request authorization to file the notice of completion for the Valley Strong Ballpark Outfield Fence & Batter’s Eye Replacement Project.
Prepared by:
Bryce Nagel, Assistant Engineer, (559) 713-4197, [email protected] Rebecca Keenan, Senior Civil Engineer, (559) 713-4541, [email protected] Christopher Crawford, City Engineer, (559) 713-4331, [email protected] Jason Huckleberry, Engineering & Building Director, (559) 713-4495, [email protected] Department Recommendation:
Staff recommends that the City Council authorize the filing of the Notice of Completion for the Valley Strong Ballpark Outfield Fence & Batter’s Eye Replacement Project.
Summary:
The Outfield Fence & Batter’s Eye Replacement Project replaced approximately 290 lineal feet of existing, 12-foot-tall outfield fence. The project attached new 12-foot-tall fence panels to new steel posts; reconstructed approximately 41 lineal feet of an existing iron-framed gate and fence; and reconstructed the north face of the existing red storage barn that makes up a portion of the outfield fence line, all located at Valley Strong Ballpark. This project also included installation of athletic padding on the fence and the removal and replacement of the existing batter’s eye structure. The improvements were constructed to comply with Minor League Baseball/Major League (MiLB/MLB) requirements. The construction contract was awarded to Forcum/Mackey Construction, Inc. in the amount of $915,000 with the final project cost totaling $916,990.12.
Background Discussion:
On February 25, 2025, the City of Visalia Purchasing Division issued RFB 24-25-42 to obtain bids for the construction of the Valley Strong Ballpark Outfield Fence & Batter’s Eye Replacement Project. On March 25, 2025, the City received no bid packages in response to this solicitation. As allowed by the City’s purchasing policy, the City requested bids from two potential bidders for the project as RFB 24- 25-42A. On April 22, 2025, the City received two bids in response to this second solicitation.
Forcum/Mackey Construction, Inc., submitted a total bid amount of $915,000, and Seals Construction Inc. submitted a total bid amount of $1,290,000. Forcum/Mackey Construction, Inc., was determined to be the lowest bidder by comparing the “total bid amount” of each bidder. The low bid was 27% under the engineer’s estimate of $1,250,000.
The project also included the removal & replacement Visalia City Council Page 1 of 5 Printed on 1/16/2026

fence line, all located at Valley Strong Ballpark. The project also included the removal & replacement of the existing batter’s eye structure. The new outfield fence was constructed of wood sheathing, attached to galvanized pipe posts that are set in 7-foot-deep footings. The side of the fence that is facing the play field is covered with 3-inch-thick padding, in compliance with MiLB/MLB requirements.
The fence is supported by 2”x6” wood wind girts, which provide the lateral support to resist wind loads and impacts. The backside metal paneling was installed to dissuade climbing or tampering with the fence. A small storm drain system was incorporated to provide drainage to the area just south of the existing outfield entry gate. This gate is the main access point for field maintenance, and the dirt area becomes muddy during rain events. The new storm drain system will direct the water away from the entrance gate and provide better operations.
The project was issued with one bid item, “total bid amount”, for all work included in RFB 24-25-42A to meet Minor/Major League Baseball requirements. The RFB also included three (3) deductive alternatives to provide potential cost saving items to be implemented, depending on the bids received. The following are the three (3) deductive alternatives:
1. Deductive - Metal Paneling at Back of Batter’s Eye (east side)
2. Deductive - Metal Paneling at Back of Fencing System (exterior side)
3. Deductive - Storm Drain System
Upon staff review of the bids with the owners of the Visalia Rawhide team, First Pitch Entertainment (FPE), the project team recommended awarding the total bid amount of $915,000. The City Council awarded this contract to Forcum/Mackey Construction, Inc. at the May 5, 2025 meeting in the amount of $915,000.
There were two (2) construction change orders processed for the project, resulting in a total construction cost of $916,990.12. The total construction change orders amounted to $1,990.12 (0.22%). The following is a breakdown of the construction change orders.
Errors & Omissions (E & O) $ 0 0.00%
Utilities (UT) $ 0 0.00%
Balance of Quantities (BQ) $ 0 0.00%
Unforeseen Conditions (UN) $ 33,490.12 3.66%
Owner Directed Change in Scope (CoS) ($31,500.00) -3.44% TOTAL: $1,990.12 0.22%
Owner Directed Change in Scope (CoS):
The change in scope directed by the City incorporated deductive alternate no. 1 in the amount of - $31,500.00 as a change order. Applying deductive alternative no. 1 eliminated the metal paneling from the back of the batter’s eye. Since the batter’s eye will be subject to impacts from flying baseballs, eliminating the back metal paneling will simplify any needed replacement and/or repair any dented front panels.
As directed by Council, staff was able to develop a maintenance agreement with FPE to address any issues related to nesting birds, debris and any other unsightly issues that may arise from leaving the rear paneling off of the batter’s eye. In the agreement FPE has agreed to maintain the batter’s eye and keep it clean of any nests.

Unforeseen Conditions (UN):
The change in scope due to unforeseen conditions includes an array of items that were found during the project. This first included removing and rerouting existing conduits and fiber cables that were found during potholing that conflicted with the proposed batter’s eye footings, rerouting them outside of the footing areas. The second unforeseen circumstance was discovered while replacing the siding for the existing camera booth. Crews found that the framing for the camera booth was unsafe and did not meet current building code requirements. This led to a full redesign and a reframe of the camera booth. The third unforeseen condition was found during the drilling of the caisson footings for the batter’s eye, pockets of sand were discovered that were not included in the geotechnical report in the bid. This led to the contractor having to vacuum the sand out of the footings and use extra concrete.
The last unforeseen condition during the project was during construction of the storm drain system phase. The contractor discovered the main irrigation lines to the outfield of Valley Strong Ballpark would conflict with the proposed drain inlet. To accommodate the irrigation line, the storm drain inlet needed to be relocated causing the gate slab to be extended. The total cost for unforeseen conditions is $33,490.12
Fiscal Impact:
This project has a current budget of $1,175,700 from the Baseball Fund which is subsidized by the General Fund. The total budget for completion of the Outfield Fence & Batter’s eye project included the contract amount awarded to Forcum/Mackey, contingency, and support costs such as professional design services and materials testing services. The budget is further broken down in Table 1 below. This is one of three projects covered under the agreement that was executed in 2024 between the City of Visalia and First Pitch Entertainment, LLC. That agreement covered projects related to upgrading the sports lighting to LED (recently completed); the Outfield Wall/Padding/Batter’s Eye (this project); and the Clubhouse/Batting Cage (approved by City Council on August 8, 2025). An overall budget update of these three projects is shown below in Table 2.

Park project notice of completion - Request authorization to file a partial notice of completion for the booster pump installation project at various parks.
Submitting Department: Parks and Recreation Department
Prepared by: Daryl Tillman, Park Maintenance Supervisor 713-4435; [email protected]; Ivan Nicar, Parks and Facilities Manager 713-4564; [email protected]; Jason Glick, Parks and Recreation Director 713-4042; [email protected]
Department Recommendation: Staff recommends that the City Council authorize the filing of a partial notice of completion for the booster pump installation project at various parks with Quality Landscape Construction, Inc.
Summary:
The scope of work included a construction contract for the installation of new irrigation booster pumps at Blain, Burke, Jefferson, Pinkham, Riverbend, and Summers Parks. The contract was awarded to Quality Landscape Construction, Inc. at the April 15, 2024, City Council meeting in the amount of $434,830.00.
During installation at Summers Park, the contractor encountered an unforeseen electrical issue that required coordination with Southern California Edison. An additional electrical leg is necessary, as the booster pump requires higher amperage to operate properly. Due to delays associated with the installation of this additional electrical leg, work at Summers Park has not yet been completed.
As a result, the contractor has requested partial completion of the project, as retention payment for work already completed is currently being withheld.
Background Discussion:
At the December 20, 2021, City of Visalia Council Work Session, City Council approved the appropriation of $29,364,455 from the American Rescue Plan Act (ARPA), including $1,250,000 allocated for citywide park irrigation improvements. These funds are being used to complete several park projects, including booster pump installations, irrigation system upgrades, and landscape restoration.
Staff identified Blain, Burke, Jefferson, Pinkham, Riverbend, and Summers Parks as needing a booster pump and irrigation upgrades. These parks rely on California Water Service (Cal Water) as the point of connection for irrigation water. Currently, the irrigation systems operate solely on the water pressure provided by Cal Water, which does not allow the systems to function efficiently. The installation of new booster pumps will increase water pressure, improve irrigation efficiency, reduce system run times, and ensure adequate water application throughout the parks.

Side letter agreement with employee group - Adopt a side letter agreement approving the proposed changes to the Confidential Group Compensation and Benefit Summary and authorize the City Manager to execute same.
Prepared by: Shonna Oneal, Administrative Services Director, [email protected], 713- 4053, Amy Powell, Human Resources Manager, [email protected], 713-4300 Department Recommendation: It is recommended that the Visalia City Council authorize the City Manager to execute and implement a side letter agreement approving the proposed changes to the Confidential Group Compensation and Benefit Summary. The changes will be documented in a side letter agreement until labor negotiations are undertaken in 2027, at which time they will be incorporated into the City of Visalia Confidential/ Unrepresented Group Compensation and Benefit Summary.
Summary:
An oversight in the Confidential Group Compensation and Benefit Summary was discovered and brought to Council in Closed Session on December 5, 2025. It is being corrected with a side letter agreement, along with other small changes to circumstances in the agreement, including a title change for the Communications and Brand Manager and the addition of the Fire Deputy Chief position and the corresponding benefits associated with that position, until they can be incorporated into the City of Visalia and the City of Visalia Confidential/ Unrepresented Group Compensation and Benefit Summary after the next labor negotiations.
Background Discussion:
It recently came to Staff’s attention that there was a likely oversight in the compensation and benefit summary related to the longevity pay approved for the Battalion Chief classification. All sworn fire personnel in Group G (Fire) are eligible for longevity pay based on all of their sworn, paid, full-time experience. However, the addition of “all experience,” not just experience with the City of Visalia, was negotiated with Group G after the Confidential Group agreement was reached. All of Group G (Fire) members receive this compensations. All current and recent Battalion Chiefs receive full longevity pay based on their experience with the City of Visalia.
However, the Confidential Group agreement includes full pay for all experience for the Police Captains, and the City Manager believes, based on the conversations at the time, that the Council intended to have all Battalion Chiefs receive the same longevity provision, although at a reduced rate, 2% per five years’ experience versus 2.5% per year for Police. The omission was not caught at the time of the negotiations. The City Manager requested that this issue be corrected now, prior to the hiring of the new Battalion Chief. Without this correction, there will be a real issue with compaction.

Although it is unusual for Staff to propose a mid-cycle revision to an agreement; given that this was a perceived oversight, the City Manager has requested this correction now.
The side letter agreement also includes other small changes to circumstances in the agreement, including the addition of the Fire Deputy Chief and a title change for the Communications and Brand Manager. Staff recommends that all proposed changes be included in the revised side letter agreement.
Staff met with or talked with the members of the Confidential Group, informed them of the proposed changes, the rationale for the unusual mid-cycle revision, and their right to question or protest the changes. They were asked to contact the Human Resources Manager by the end of the day on Tuesday, December 2, 2025, if they have any concerns. No such concerns were raised. They were also told they would receive a copy of the side letter agreement if approved by Council.
Fiscal Impact: No fiscal impact associated with adopting this side letter agreement. The current budget includes the longevity pay calculation.
Prior Council Action: 12/05/2025
Other: N/A
Alternatives: Maintain the agreement in its current form and have an issue of compaction between the new Battalion Chief and some of the Fire Captains.
Recommended Motion (and Alternative Motions if expected):
I move to adopt a side letter agreement approving the proposed changes to the Confidential Group Compensation and Benefit Summary and authorize the City Manager to execute same.

Fiscal Year 2026-27 federal congressional community project funding requests - Approve the submittal of federal congressional community project funding requests for the upcoming 2026-27 fiscal year.
Deadline for Action: 1/20/2026
Submitting Department: Administration
Contact Name and Phone Number:
John Lollis, Assistant City Manager, [email protected], (559)713-4323 Department Recommendation:
Staff recommends that the City Council approve the submittal of three (3) federal congressional community project funding requests for the upcoming 2026-27 Fiscal Year, including $4 million for the Shirk Street Capacity Enhancing Project, $4 million for the Law Enforcement Training Facility, and $1 million for the development of the Visalia Industrial Park Employment Resource Center.
Background Discussion:
With the second session of the 119th United States Congress having begun on January 5, 2026, preparations are beginning to be made by the Offices of both Congressman Costa and Fong to begin receiving federal congressional community project funding (CPF) requests (commonly known as earmarks), which provide direct federal funding to selected projects.
In the 2023-24 Fiscal Year, the City requested $3.5 million and received CPF funding of $700,00 from Congressman Costa for the development of Groundwater Recharge Basins. In the 2024-25 Fiscal Year, the City requested $3 million and received tentative CPF funding of $2 million from Congressman Fong for the Tulare Avenue Safety Improvement Project, and requested $5 million and received tentative CPF funding of $850,000 from Congressman Costa for the Downtown Main Street Improvement Project, however, both CPF requests were ultimately not funded due to the lack of an adoption of a federal budget.
In the current 2025-26 Fiscal Year, the City requested $4 million from Congressman Costa for the Riggin Avenue Capacity Enhancing Project between Akers and Roeben Streets, $3 million from Congressman Costa for the Downtown Main Street Improvement Project, $3 million from Congressman Fong for the Tulare Avenue Safety Improvement Project, $3 million from Congressman Fong for the Eastside Regional Park Groundwater Recharge Basins, $1 million from Congressman Fong and Senators Padilla and Schiff for the Tulare County Event Barricade System, and $3 million from Senators Padilla and Schiff for the Hydrogen Plant and Bus Fueling Station Project.
Congressman Costa supported the Riggin Avenue Project request and the City has received tentative CPF funding of $250,000 pending Congressional funding bill approval, and Congressman Visalia City Council Page 1 of 3 Printed on 1/16/2026

Fong supported the Groundwater Recharge Basins Project request and the City has received tentative CPF funding of $2 million pending Congressional funding bill approval. Although Senator Padilla supported the Event Barricade System and Senator Schiff supported the Hydrogen Project, the Senate Appropriations Committee did not select either project for funding.
The City is seeking to continue the Shirk Street Capacity Enhancement Project south of State Route 198 to improve traffic flow and support future growth, involving roadway widening and improvements including center median, curb, gutter, sidewalks, bike lanes, lighting and signalization, landscaping, as well as utility upgrades involving the installation of storm drain lines. Shirk Street is considered to have regional significance within Tulare County, which $5 million in Measure R Regional funds have been designated by the Tulare County Association of Governments (TCAG) for the project. The project area is within Congressman Fong’s representative district, which with an estimated total cost of $20 million for the project segment, staff recommends the submittal of a CPF request of $4 million to Congressman Fong for consideration of support.
Both Congressman Costa and Fong have expressed interest in supporting a CPF for Visalia in support of the Visalia Police Department, which the development of a new Law Enforcement Training Facility and new indoor shooting range is planned for the next phase of the Civic Center. The estimated cost of the new facility is approximately $5 million, including necessary equipment. The federal guidelines for CPF requests specifically prohibits the use of funds for construction but does allow for the equipping of facilities. In the current 2025-26 Fiscal Year, there are three (3) CPF requests for shooting ranges in other jurisdictions that have been funded between $1 million and $3 million.
Congressman Costa has expressed his interest in supporting the City’s proposed reuse of the Tulare County Office of Education’s (TCOE) Doe Complex as an Employment Resource Center within the growing Visalia Industrial Park considering the significant employment opportunities the businesses provide for residents across the region. The Doe Complex reuse project focuses on enhancing Visalia’s ability to grow and retain primary jobs in the Industrial Park by providing a “one stop” resource center that would serve existing and prospective Industrial Park employees, enhancing existing employers’ ability to attract and retain skilled workers while also expanding equitable access to industrial career ladders. This project aims to break barriers to upskilling in partnership with existing companies which leverages a strong business retention and expansion focus that will aid in business attraction efforts.
Congressman Costa has expressed particular interest in the proposed development of an extendedhour childcare facility at the Employment Resource Center to be operated by TCOE’s Early Childhood Education (ECE) Program. The ECE Program found that almost seventy percent (70%) of Tulare County parents need childcare to go to work, especially during non-traditional hours, and that twelve percent (12%) need ECE to attend school or receive training. Improvements to the facility for preliminary childcare services include the conversion of office space, installation of an outdoor playground, and perimeter fencing, and are estimated at $1 million.
The City’s lobbyist has recommended to limit each CPF request to no more than $4 million, which as evidenced by previous CPF requests, final CPF awards are generally significantly reduced. CPF requests will likely begin to be received by Congressional Offices in March.
Fiscal Impact:

Any CPF funding supported and received will greatly assist in the implementation of projects. If the City is awarded funds, staff will return to Council to appropriate at that time.

Background Discussion:
Every three years, the State adopts new codes (known collectively as the California Building Standards Code) to establish uniform standards for the construction and maintenance of buildings, electrical systems, plumbing systems, mechanical systems, and fire and life safety systems. These codes have been updated for 2025, the prior update was in 2022, and the attached ordinance is being passed to update the references in the Visalia Municipal Code to the applicable statewide standards.
On July 1, 2025 the State of California, Building Standards Commission published the 2025 California Administrative Code, 2025 Referenced Standard Code, 2025 California Building Code (CBC), 2025 California Plumbing Code (CPC), 2025 California Mechanical Code (CMC), 2025 California Electric Code (CEC), 2025 California Historical Building Code, 2025 California Existing Building Code, 2025 California Residential Code (CRC), 2025 California Green Building Standards Visalia City Council Page 2 of 3 Printed on 1/14/2026

Section 2. Pursuant to Health and Safety Code, sections 17958.7 and 18941.5 because of local climatic, topographical or geological conditions the City of Visalia hereby finds that the following appendices and code section amendments are necessary. It is noted that these appendices and code section amendments are referenced above, but are also listed below to clarify that they have been found to be necessary and that they have been added by the City of Visalia:
A. The following appendices and code sections are adopted by reference as necessary due to the local climatic, topographical, or geologic conditions, which are described in further detail in this Section 2:
2025 California Building Code Appendices B (Board of Appeals), C (Group U – Agricultural Buildings), F (Rodent proofing), H (Signs), I (Patio Covers), J (Grading), P (Sleeping Lofts) and Q (Emergency Housing).
2025 California Plumbing Code Appendix A (Recommended Rules for Sizing the Water Supply System), B (Explanatory Notes on Combination Waste & Vent Systems), D (Sizing Storm Water Drainage Systems), H (Private Sewage Disposal Systems), I (Installation Standards), and J (Combination of Indoor and Outdoor Combustion and Ventilation Opening Design)
Section 808.0 of the 2025 California Plumbing Code was amended to prevent the discharge of cooling water into the sanitary sewer system. Refer to Section 13.08.500 of City of Visalia Municipal Code (Prohibition on Unpolluted Water). 2025 California Mechanical Code Appendix B (Procedures to be followed to Place Gas Equipment into operation) and C (Installation and testing of oil (liquid) fuel-fired equipment).
2025 California Residential Code Appendix BF (Patio Covers), BB (Tiny Houses), BJ (Strawbale Construction), CK (Areas Protected by the Facilities of the Central Valley Flood Protection Plan), and CJ (Emergency Housing).
B. The City of Visalia has found the following concerning local climatic conditions, specifically extreme temperatures, support the adoption of the listed appendices and code amendments:
As documented in the Visalia General Plan Visalia is characterized as having an “inland Mediterranean” climate. High temperatures are also contributors to ozone formation, and summer high temperatures often exceed 100ºF with an all-time high of 115ºF averaging 275 sunny days per year. Climate models predict a 4ºF temperature increase in the next 20 to 40 years, with an increase in the number of long dry spells (Visalia: 2010). Data shows that during the months of July and August, Visalia's daily 1376
high temperature has averaged in excess of 94ºF as compared to San Francisco with an average of 67ºF and San Diego having an average of 74ºF. Though Health & Safety Code § 17958.7 does not require the local conditions to be unique to a particular jurisdiction, the temperatures experienced in Visalia are extreme as compared to temperatures experienced in other parts of California.
The City notes that these temperatures cause frequent use of cooling water during these times of high heat and in order to avoid disruptions with the City’s sanitary sewer system that could be caused by cooling water discharges over the long period of high heat in Visalia the City has amended Section 808.0 to prevent the discharge of cooling water into the sanitary sewer system.
The local climatic condition, high summer temperatures, results in patio covers being common in the City of Visalia to provide shade around homes. The City has determined to adopt 2025 California Building Code Appendix I and 2025 California Residential Code Appendix BF (Patio Covers) to regulate these types of improvements.
The Heat Stress Index published by the Federal Emergency Management Agency in its publication entitled Emergency Incident Rehabilitation sets forth the stress placed on the human body when exposed to various temperatures and humidity. A note under the Heat Stress Chart states that 10 degrees should be added to the temperature when protective clothing is worn and an additional 10 degrees should be added when the person is standing in direct sunlight. According to this chart, a person exposed to temperatures between 90 and 105 degrees is subject to heat cramps and heat exhaustion if exposure to these temperatures is prolonged and there is physical activity. A person exposed to temperatures of 105 to 130 degrees is likely to experience heat cramps and heat exhaustion. Furthermore, heat stroke is possible if exposure is prolonged and there is physical activity. A person exposed to temperatures above 130 degrees or greater faces a high risk of suffering from heat stroke.
The high levels of potential heat stress that can occur during the summer periods in Visalia raised concerns by the City for emergency responders, which supports the City’s adoption of the 2025 California Mechanical Code Appendix B and Appendix C concerning the installation of equipment that could lead to serious emergency incidents if installed incorrectly, and 2025 California Residential Code, Appendix BJ, concerning straw bale construction.
C. As documented below the City of Visalia makes the following findings concerning local geological conditions, specifically water supply and water pressure, that support the adoption of the listed appendices:
The Visalia area is an arid area that receives an average of 11 inches of precipitation per year occurring primarily in the winter months. Furthermore, Visalia relies completely on groundwater for its water supply and the groundwater basin it is located within and has been found to be in overdraft by the State of California. Due to the hot, dry summers in the Visalia area, domestic water demand can substantially reduce the ability of the public water system to dependably provide 1377
service, which supports the adoption of the referenced appendices to the 2025 California Mechanical Code needed to prevent serious emergency incidents. The adoption of 2025 California Plumbing Code Appendix A, Appendix B, Appendix I and Appendix J are necessary to prevent the loss of scarce water resources in the City of Visalia that could be caused by incorrect water supply facility installations.
D. In addition, the City of Visalia makes the following findings concerning local climatic/topographical conditions, specifically air quality caused by the topography of the San Joaquin Valley air basin, number of sunny days, and inversions that form during winter months, that support the adoption of the listed appendices:
As a result of the San Joaquin Valley's climate and topography, the San Joaquin Valley Air Basin (SJVAP) is predisposed to poor air quality. High mountain ranges surrounding the Valley frequently create air layer inversions that prevent mixing of air masses. The large number of sunny days per year, and high temperatures in the summer favors the formation of ozone. In the winter, inversions form that often trap particulate matter
The Federal Environmental Protection Agency and the California Air Resources Board have classified the San Joaquin Valley Air Basin as severe non-attainment for ozone and serious non-attainment (federal) non-attainment (state) for PM10. Ozone is formed by a complex series of chemical reactions between reactive organic gases (ROG), oxides of nitrogen and sunlight. PM10 is suspended particulate matter that is less than 10 microns in size. Given its small size, PM10 can remain airborne for long periods and can be inhaled, pass through the respiratory system, and lodge in the lungs. In general, nonattainment means that the federal standard has been exceeded more than twice per year.
Due to the local topographic conditions that impact air quality the City of Visalia is concerned over activities that can cause additional particulate matter through dust or fire and has determined it is appropriate to adopt 2025 California Building Code Appendix J, Grading, and 2025 California Residential Code Appendix BJ concerning Strawbale Construction.
E. City makes the following findings concerning local topographical conditions, specifically the City of Visalia’s development pattern, that supports the adoption of the listed appendices:
There is a relatively low-density growth pattern in the Visalia area, Visalia is in an area with a high level of agriculture that contributes heavily to the local economy and the agricultural uses surround the community. As Visalia has expanded it sometimes annexes areas that were remain used for agriculture. This local topographic condition has resulted in areas consisting of former rural developments being incorporated into the City with areas of mixed rural and urban usage along with rural uses being immediately adjacent to urban uses.
This local topographical condition supports the City’s adoption of 2025 California Building Code Appendix C Group U – (Agricultural Buildings) and Appendix F (Rodent Proofing).
1378
The City’s local topographical condition, its development pattern has led to numerous areas of residential housing being built on large lots, that are now available for use as secondary rental units or multigenerational homes on the same lots by building a small accessory dwelling unit, due to this local topographic condition, the City finds that the adoption of 2025 California Residential Code Appendix BB (Tiny Houses) and 2025 California Building Code Appendix P (Sleeping Lofts) are needed to oversee potential construction of this type of housing.
The City also finds that this local topographic condition, existing rural development that has been incorporated into the City of Visalia, has led to numerous private sewer systems within the city limits. The City of Visalia has a public sewer system and has recently spent over one hundred million dollars updating its wastewater treatment plant, but still needs to deal with older homes and private sewage disposal systems.
Therefore, the City has determined that it is appropriate for it to adopt 2025 California Plumbing Code Appendix H (Private Sewage Disposal Systems).
F. The City of Visalia makes the following findings concerning the local topographic, geographical, and climatic conditions of potential flooding within Visalia:
The Federal Emergency Management Agency (FEMA) provides maps that estimate flood hazards throughout the United States and areas within the City of Visalia have been found to be considered by FEMA to be high risk for flooding. It is noted that the City of Visalia is located near the large alluvial fan formed by the Kaweah River and its distributary channels, historically the City of Visalia has flooded several times since it was founded in 1852, although the construction of the Terminus Dam on the Kaweah River in 1962 has drastically reduced the risk of flooding, flooding is still a possibility within the City of Visalia.
Due to the possibility of flooding within the City of Visalia due to the local topographic, geographical, and climatic conditions, the City has adopted 2025 California Building Code Appendix Q (Emergency Housing), 2025 California Plumbing Code Appendix D (Sizing of Storm Water Drainage Systems), 2022 California Residential Code Appendix CK (Areas Protected by the Facilities of the Central Valley Flood Protection Plan) and CJ (Emergency Housing) is necessary and appropriate. It is noted that the potential for flooding is magnified by the flat topography of Visalia, when constructing buildings in the areas in order to avoid being designed within an elevation subject to flooding grading measures are employed to alter the base elevation. Due to this local condition that leads to grading during building construction the City of Visalia has determined that 2025 California Building Code Appendix J (Grading), should be adopted.
G. The City of Visalia makes the following findings concerning the local topographic, geographical, and climatic conditions of potential wildfire near Visalia that support the adoption of the listed appendices:
The City of Visalia is located near the Sierra Nevada mountains, and due to the previously described dry and hot summers the hills and mountains can be susceptible to wildfires, during such fires, residents of these areas seeking shelter often travel to Visalia, which is the largest city in Tulare County, the City of Visalia has also been 1379
utilized as a staging area for firefighting operations, which can require the emergency housing of firefighters.
Due to these local topographic, geographical, and climatic conditions, nearby wildfires, the City of Visalia has adopted 2025 California Building Code Appendix Q (Emergency Housing) and Appendix P (Sleeping Lofts) and 2025 California Residential Code Appendix CJ (Emergency Housing) and notes that during these events, alternative forms of housing, such as tiny homes could supply housing, further supporting the City’s decision to adopt 2025 California Residential Code Appendix BB (Tiny Homes).
Section 3. That if any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The Council of the City of Visalia hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional.
