Ordinance adoption - Second reading and adoption of ordinance no. 2026-11 amending Visalia Municipal Code Chapter 8.70 Abandoned Shopping Carts, citywide.
Agenda Date: 10/5/2026
Prepared by:
Jeff Riedmann, Code Enforcement Officer, [email protected], (559) 713-4172 Jesse Villegas, Neighborhood Preservation Manager, [email protected], (559) 713-4187 Paul Bernal, Planning and Community Preservation Director, [email protected], (559) 713- 4025
Department Recommendation: Staff recommends that Visalia City Council adopt the second reading of Ordinance No. 2026-11, amending Chapter 8.70 of the Visalia Municipal Code (VMC) to increase the amount for the retrieval and return of shopping carts from $50 per shopping cart to $100 per shopping cart and establish the requirement for cart containment systems for new construction/businesses that use shopping carts and for existing businesses that obtain a building permit with the improvement valuation exceeding $50,000.
Summary:
Based on the State’s passage of SB 753, City staff reviewed VMC Chapter 8.70 (Abandoned Shopping Carts, see Attachment 2) and presented a Work Session item to City Council at the August 3, 2026 City Council meeting recommending Chapter 8.70 be amended due to changes in state law that allow for an increase in the amount that shopping cart owners can be fined if they do not pick up their carts after being notified. During this presentation, staff also recommended Chapter 8.70 be amended to require businesses/companies that use shopping carts to install a physical containment system when a new location is built or when a significant improvement or expansion occurs to that existing facility/shopping center. Based on the staff report and presentation during the August 3rd City Council Work Session, Council directed staff to begin drafting revisions to Chapter 8.70.
Background Discussion:
In 2025 California Business and Professions Code section 22435.7 was amended per SB 753 (see Attachment 2). The amendment increased the amount a city or county can charge under cost recovery measures for the retrieval and return of shopping carts from $50 per shopping cart to $100 per shopping cart. State law requires cities and counties approve an ordinance to implement these cost recovery fees. The current municipal code lists the prior authorized cost recovery charge of $50 per shopping cart. Staff recommends the amount be increased from $50 to $100, as permitted by state law.
Staff also recommends that Chapter 8.70 be amended to identify the requirement of a physical containment system for shopping carts be required when a new business/location is constructed and that business uses shopping carts or when an existing business/shopping center is modified or Visalia City Council Page 1 of 3 Printed on 10/2/2026

that business uses shopping carts or when an existing business/shopping center is modified or expanded to the extent that a building permit from the City is required for the modification or expansion with the improvement valuation exceeding.
The municipal code, section 8.70.020, defines a “physical containment system” for shopping carts as one of the following:
1. Disabling devices on all shopping carts which prevent them from being removed from the business premises by locking the wheels or otherwise preventing the movement of the carts.
2. Any other system of equipment approved by the City Manager or their designee which physically contains shopping carts on the premises.
Staff was able to provide applicable businesses that have shopping carts with informational flyers with the proposed changes and additions to Municipal Code 8.70.
Fiscal Impact including annual maintenance and operating costs: None at this time.
Prior Council Action:
1. In 2013, Municipal Code 8.70 Abandoned Shopping Carts was approved and adopted into the Visalia Municipal Code; however, the portion related to a physical containment system for all new construction was not part of the Municipal Code update.
2. On August 3, 2026, City Council approved a motion to move forward to begin drafting revisions to Chapter 8.70.
3. On 9/21/26, City Council approved the first reading to amend Municipal Code 8.70 Abandoned Shopping Carts, citywide.
Alternatives: The City Council may, in lieu of the recommended motion, direct staff not to process any amendments to Visalia Municipal Code Section 8.70 Abandoned Shopping Carts, and instead makes changes at their direction and return with an updated version.
Recommended Motion (and Alternative Motions if expected):
I move to approve the second reading and adopt Ordinance No. 2026-11 amending Chapter 8.70.
Environmental Assessment Status: Exempt from further review under the California Environmental Quality Act (CEQA) Guidelines section 15061(b)(3) (common sense exemption).
CEQA Review: The project is exempt from further environmental review under the CEQA Guidelines section 15061(b)(3), which states that the project is exempted from CEQA if the activity is covered by the common sense exemption that CEQA applies only to projects that have the potential for causing significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.

Authorize the abandonment of a portion of Douglas Avenue - Adopt Resolution 2026-70 ordering the summary vacation and abandonment of a portion of right-of-way along Douglas Avenue west of Burke Street; and further authorize the City Manager to execute the necessary documents to complete the abandonment. (Resolution 2026-70 required) Agenda Date: 10/05/2026
Prepared by:
Sarah MacLennan, Assistant Eng, [email protected], (559) 713-4271; Jason Huckleberry, Eng & Bldg Dept Dir, [email protected], (559) 713-4495 Department Recommendation:
Staff recommends adopting Resolution No. 2026-70 ordering the summary vacation and abandonment of a portion of right-of-way along Douglas Avenue west of Burke Street adjacent to Parcel 1 of Parcel Map 127 , recorded in Book 2 of Parcel Maps, at Page 27, Tulare County Records and further authorizing the City Manager to execute the necessary documents to complete the abandonment.
Summary:
The abandonment of the right-of-way is being requested by a representative for the owner due to an existing permanent structure located within a portion of existing right-of-way.
This vacation and abandonment is being conducted in accordance with California Streets and Highways Code Section 8334(a) allowing the vacation of an excess street or highway that is not required for street or highway purposes. The proposed vacation meets the provisions of this section allowing the use of a summary process.
Background Discussion:
The right-of-way was previously dedicated to the City for public roadway purposes.
An existing permanent structure is located within a portion of the dedicated right-of-way, creating an encroachment into the City's current roadway. The affected portion is not required for existing or reasonably foreseeable roadway purposes.
The proposed abandonment would remove the affected portion of public right-of-way from the City's roadway system and resolve the existing right-of-way conflict associated with the structure. The remaining public right-of-way will continue to provide for the necessary public roadway function.
City staff agrees with the applicant that the portion of right-of-way is no longer needed for street or highway purposes.

James Koontz, City Attorney
Department Recommendation:
Receive the staff report regarding the measures taken to alleviate the conditions which led to the adoption of Urgency Ordinance No. 2026-10, an interim urgency ordinance that placed a temporary moratorium on new data center developments and communications equipment buildings within the City of Visalia, pursuant to Government Code Section 65858(d), which states, “Ten days prior to the expiration of that interim ordinance or any extension, the legislative body shall issue a written report describing the measures taken to alleviate the condition which led to the adoption of the ordinance.” The urgency ordinance is set to expire on October 23, 2026, based on the initial 45-day adoption.
The City Council thereafter may extend the ordinance up to a maximum of two additional times: first, for a period of 10 months and 15 days; and second, for a period of up to one year. In total, the urgency moratorium may last for two years.
This report is being provided for informational purposes as City staff is preparing a public hearing item requesting an extension of Ordinance No. 2026-16, pursuant to Government Code Section 65858(a). The ordinance extension public hearing request will be publicly noticed for the October 19, 2026, City Council meeting.
No other action is required at this time other than to receive the staff report.
Summary:
On September 8, 2026, the City Council adopted Ordinance No. 2026-10, which enacted a moratorium on the acceptance, processing, approval, or issuance of permits and entitlements for new data center development and while the City considers land use regulations governing new data centers and Communications Equipment Buildings, within the City of Visalia pursuant to California Government Code Section 65858. Per the City Council staff report, staff noted the City of Visalia does not regulate nor define “data center” land uses, including location, size and scope, and other development standards in the Zoning Ordinance, as the City’s existing zoning regulations and development standards were adopted before the emergence of date centers and therefore do not Visalia City Council Page 1 of 4 Printed on 10/2/2026

development standards were adopted before the emergence of date centers and therefore do not adequately regulate the intensity, utility demand, operational characteristics, environmental impacts, or cumulative impacts associated with this particular type of use.
In addition, staff further noted that the current zoning regulation, Chapter 17 Zoning, allows for “Communications Equipment Buildings” within the city. This usage is defined as a “building housing electrical and mechanical equipment necessary for the conduct of a public communications business” . Although City staff does not consider this type of use to be a current data center use, in order to avoid potential issues, to the extent this type of use cannot be shown not to be a data center, as defined in the interim ordinance, this use was also prohibited under the temporary moratorium.
The adoption of the urgency ordinance has provided staff with limited time to begin researching, complying, and reading a plethora of information on data center development and impacts.
During the past 27 days, staff has researched data center development tends including but not limited to:
· Data Center development features, such as size, energy consumption/demands, water usage, heating impacts, air quality, noise, and other operational requirements. · Other jurisdictional approaches on how they are regulating and/or considering prohibiting this type of use.
Furthermore, recent legislative action has also been enacted with the California Governor signing seven bills regulating the data center industry, imposing new requirements on electricity costs, energy reporting, and local oversight including:
· AB 1577 by Assemblymember Rebecca Bauer-Kahan (D-Orinda). Data centers: reporting.
This bill requires data center owners and operators to submit specified information to the State Energy Resources Conservation and Development Commission (Energy Commission), including the data center’s location and size, power usage effectiveness, and the quantity of fuel consumed by onsite generators or other fuel-based energy systems. T · AB 2383 by Assemblymember Rick Chavez Zbur (D-Hollywood). Electricity: data centers. A companion bill to SB 886, AB 2383 requires the CPUC to establish generation tariffs for data centers, ensuring compliance with state clean energy procurement requirements and statutory clean energy targets.
· AB 2469 by Assemblymember Diane Papan (D-San Mateo). Data centers: water use disclosures. This bill will prohibit a city, county, or city and county from approving a discretionary or ministerial permit or other entitlement that would result in the construction, or an expansion that increases the maximum peak water use, of a data center unless specified conditions are satisfied, including, among others, that the applicant provides the city, county, or city and county prescribed information.
· AB 2619 by Assemblymember Diane Papan (D-San Mateo). Water resources: data center.
This bill would requires a person who owns or operates a data center, prior to applying to a city or a county for an initial business license, equivalent instrument, or permit, to provide its water supplier, under penalty of perjury, a good faith estimate of the expected water use, the anticipated source of water, and the data centers projected water use volume for the maximum day, maximum month, and average year.
· SB 886 by Senator Steve Padilla (D-San Diego) and Senator Jerry McNerney (D-Pleasanton).

· SB 886 by Senator Steve Padilla (D-San Diego) and Senator Jerry McNerney (D-Pleasanton).
California Technology Innovation and Ratepayer Protection Act. This bill requires the California Public Utilities Commission (CPUC) to adopt new tariffs and update existing electric rules by January 1, 2028, to prevent data center electricity costs from being shifted to other ratepayers · SB 887 by Senator Steve Padilla (D-San Diego). California Environmental Quality Act (CEQA):
environmental leadership development projects: data centers: geothermal power plant projects. This bill defines data center for the purposes of CEQA and prohibits the application of a categorical exemption to a project for the development and operation of a data center, as specified.
· SB 1168 by Senator Jerry McNerney (D-Pleasanton). Data centers: Rate structures. This bill requires the Energy Commission to assess opportunities for rate structures to ensure that data center costs are not shifted to other ratepayers.
Given the degree of information related to data centers, and enactment of new state legislation on data centers, staff will be seeking a request to extend the moratorium pursuant to Government Code Section 65858(a) for an additional 10-months, 15-days; however, this request requires a notice of public hearing, which will occur at the October 19, 2026, City Council meeting.
Fiscal impact including annual maintenance and operating costs:
There is no additional cost to the General Fund associated with adoption of the interim ordinance.
Staff time associated with preparation of permanent municipal code regulations to address Data Centers will be absorbed within existing departmental budget.
Prior Council Action:
On September 8, 2026, the City Council adopted Ordinance No. 2026-10, an interim urgency ordinance placing a temporary moratorium on the acceptance, processing, approval, or issuance of permits and entitlements for new data center development within the City of Visalia pursuant to California Government Code Section 65858.

ORDINANCE NO. 2026-10
AN INTERIM URGENCY ORDINANCE PLACING A TEMPORARY MORATORIUM ON
THE ACCEPTANCE, PROCESSING, APPROVAL, OR ISSUANCE OF PERMITS AND
ENTITLEMENTS FOR NEW DATA CENTER DEVELOPMENT WITHIN THE CITY OF VISALIA PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTION 65858, (CITYWIDE)
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VISALIA:
SECTION 1. Urgency Findings. Consistent with its control over municipal affairs as a charter city and the powers vested in the City of Visalia through the California Constitution, the City of Visalia is authorized to secure and promote the public health, comfort, safety, and welfare of its citizenry adopts the following finding in support of this Urgency Ordinance and finding that there is a current and immediate threat to the public health, safety or welfare of the residents of Visalia:
A. California Government Code Section 65858(a) authorizes the City Council to adopt an interim urgency ordinance for the immediate preservation of the public health, safety, or welfare, and to prohibit a land use that is in conflict with a contemplated general plan, specific plan, zoning, or development standard amendments that the City is studying or intends to study within a reasonable time.
B. California Government Code Section 65858(c) further requires that the City Council find that there exists a current and immediate threat to the public health, safety, or welfare, and that the approval of additional use permits, building permits, subdivisions, variances, or other entitlements would result in that threat to public health, safety, or welfare.
C. Communities throughout the state and country have experienced detrimental effects of Data Center land uses, including but not limited to intensive energy and water use, noise, crime, air quality, water and noise pollution, and other related effects.
D. Data Centers represent a unique form of industrial development that typically requires substantially greater electrical capacity, utility infrastructure, telecommunications infrastructure, emergency and/or alternative power generation systems, cooling systems, and building mass than conventional industrial uses, while generating substantial noise negatively affecting surrounding properties.
E. Data Center development has the potential for significant and immediate impacts on the health, safety, and welfare of the citizens of Visalia through significantly increased energy and water consumption, pollution, noise, and other disturbances, as well as the potential to significantly impact the City’s aesthetic values and community resources.
141
F. The City’s existing General Plan and Zoning Ordinance does not specifically define, regulate, or establish land use policies or development standards for Data Centers.
G. The City’s existing zoning regulations were developed prior to the emergence of data centers and do not adequately address the unique characteristics of these facilities, it is noted that the current zoning regulation allows for Communications Equipment Buildings within the City, this usage is defined as a building housing electrical and mechanical equipment necessary for the conduct of a public communications business, to the extent this type of usage cannot be shown not to be a Data Center, as defined in the interim ordinance, this usage will also be prohibited under the temporary moratorium.
H. Without the imposition of a temporary moratorium on Data Center development within the City, the City may be required to process permit applications for such development without proper study and deliberation of how to regulate Data Center land uses while also safeguarding against the adverse impacts such uses may have on the City’s utility infrastructure and the quality of life of its residents.
I. The City has a compelling interest in protecting the public health, safety, and welfare of its residents by regulating Data Centers as a land use.
J. The adoption of this urgency ordinance is necessary to protect the City and its residents, businesses, and visitors from the potential health and safety impacts of Data Center land uses; and to preserve the quality of life, health, safety, and welfare of the community.
K. Imposition of the moratorium will allow the City sufficient time to study and if necessary, prepare a comprehensive ordinance for the regulation of Data Center land uses.
L. In light of these findings and all evidence in the record, including, but not limited to the staff report accompanying this urgency ordinance, the City Council finds that this moratorium is justified in accordance with Government Code section 65858.
SECTION 2. Imposition of Moratorium. For so long as this Ordinance is in effect, including through any extension, the City shall not receive, accept, process, or approve any application for Data Center land use. For the purposes of this Ordinance the term "Data Center" shall be defined to mean a facility that houses computing infrastructure, including graphics and central processing units, servers, storage devices, networking equipment, and associated power and cooling systems, for the primary purpose of processing, storing, or distributing electronic data. The term Data Center under this Ordinance shall not include server rooms that are being installed as an ancillary component of another permitted use, telecommunications facilities that are separately regulated under the City Zoning Ordinance, government emergency communications 142
facilities, or facilities owned or operated by public utilities that are primarily used for public utility operations not commercial purposes.
In addition, for as long as this Ordinance is in effect, Communications Equipment Buildings, a type of use currently allowed under the Zoning Ordinance, shall not be allowed unless the proposed facility is for a type of use that is excluded from the definition of a Data Center under this Ordinance.
SECTION 3. CEQA Finding. The City Council determines that the provisions of this ordinance are exempt from the California Environmental Quality Act (“CEQA”) because the instant ordinance involves continuing administrative activities and thus is not a project, as CEQA defines. To the extent the adoption of this Ordinance constitutes a project, the City Council finds pursuant to CEQA Guideline Section 15061(b)(3) that the project is exempt from environmental review because it can be seen with certainty that the adoption of the ordinance would not have any significant impact on the environment. Staff Report
Visalia City Council
707 W. Acequia
Visalia, CA 93291
File #: 26-0194 Agenda Date: 10/5/2026 Agenda #: 9.
Agenda Item Wording:
Designate city owned property into public right of way - Adopt resolution 2026-73 designating city owned property located along Santa Fe Street at Cameron Avenue and Redding Avenue into the public right of way system.
Agenda Date: 10/05/2026
Prepared by:
Jason Huckleberry, Director of Eng and Building, (559) 713-4495, [email protected] Department Recommendation:
Staff recommends that the City Council adopt Resolution 2026-73, designating City owned property located along the east side Santa Fe Street at Cameron Avenue and Redding Avenue into the public right of way system.
Summary:
San Joaquin Valley Homes, the developer of the Blankenship Tract Phase 1 residential subdivision, has coordinated with Southern California Edison (SCE) to provide essential utility infrastructure near and around the developer’s residential subdivision. SCE’s approved plans provide power to the new residential development but require additional City property to be dedicated for public right of way to ensure SCE facilities can be installed properly. The City owned properties being converted into public right of way are landscape outlots adjacent to Santa Fe street that were dedicated with the Blankenship Tract Phase 1 final map. This dedication of City owned property is being requested in lieu of providing a specific SCE easement that they have requested. The dedication of public right of way for the areas described in Attachment A & B provides SCE with full rights as conveyed in existing franchise agreements.
Background Discussion:
On August 25, 2026, the Blankenship Tract Phase 1 final map was recorded, subdividing the 33.6- acre area into 123 residential lots. The development project has progressed and is preparing to install final electrical facilities for the residential development. The utilities being installed surrounding the project will provide future services to the new neighborhood being developed.
Fiscal impact including annual maintenance and operating costs:
The approval of this agenda item has no fiscal impact, the outlot areas being converted to right of way are already maintained through a landscape and lighting assessment district.
Prior Council Action:
June 15, 2026 - Council approved the Blankenship Tract Phase 1 final map for recording.

Execute the easements as provided by SCE. This is not recommended as they contain highly restrictive uses within the City landscape outlots.
Recommended Motion (and alternative motions if expected):
I move to adopt Resolution 2026-73, designating City owned property located along Santa Fe Street into the public right of way system.

Staff also recommends that the City Council adopt Resolution No. 2026-66 initiating proceedings for the annexation into Landscape and Lighting Assessment District No. 25-09 “Belissa” and adopt Resolution No. 2026-67 ordering the improvements and levying the annual assessments for Assessment District No. 25-09, “Belissa”.
Summary:
The final map for Belissa Phase 3 will subdivide the remaining single-family residential portion of the Belissa subdivision into 51 residential lots. Phase 3 represents the final phase of the single-family residential development within Belissa Tentative Subdivision Map No. 5587.
The proposed single-family subdivision will be accessible from Demaree Street on the east side, Riverway Avenue on the south side, and serviced by the interior local public street constructed with the Belissa 1st and 2nd phase development. The subdivision will install the remaining interior local public streets and public infrastructure, including curb, gutter, sidewalk, streetlights, sewer, storm drainage, water, and dry utilities.
The final map is ready for recording. All required bonds, cash payments, subdivision agreement, and final map have been submitted by the developer, as follows: 1) an executed subdivision agreement; 2) a faithful performance bond in the amount of $2,327,511.27; 3) a labor and materials bond in the amount of $1,163,755.63; 4) a cash payment of $308,868.95 distributed to various accounts to cover City fees; and 5) the final map. All required items have been submitted and approved by the City prior to execution and recordation of the final map.
Landscape and Lighting Assessment District No. 25-09 “Belissa” was previously formed for maintenance of common improvements associated with the Belissa subdivision. Phase 3 will be annexed into the existing district.

Background Discussion:
The faithful performance bond covers the cost of constructing the public improvements noted in the subdivision agreement and the labor and material bond covers the salaries and benefits as well as the materials supplied to install the required public improvements. As required by the Subdivision Ordinance, the faithful performance bond covers 100% of the cost of the public improvements. The labor and material bond is valued at 50% of the faithful performance bond. A maintenance bond valued at 10% of the cost of the public improvements will be required prior to recording the notice of completion. The maintenance bond is held for one year after the recording and acts as a warranty for the public improvements installed per the subdivision agreement. The cash payment covers development impact fees such as storm water acquisition, waterways, sewer front foot fees, and any outstanding plan check and inspection fees. The plan check and inspection fees are estimated at the beginning of the final map process and are not confirmed until the subdivision agreement is finalized.
Differences are due in cash at the time of City Council approval of the map.
The City of Visalia has been allowing the developers of subdivisions to form assessment districts under the Landscape and Lighting Act of 1972, and now under Proposition 218, in lieu of using homeowners associations for the maintenance of common features such as landscaping, irrigation systems, streetlights, street trees, and local streets. The maintenance of these improvements is a special benefit to the development and enhances the land values to the individual property owners in the district.
The Landscape and Lighting Act allows for the use of summary proceedings when all the affected property owners have given their written consent to waive the requirement for a public hearing. The notice period is also waived. The owner of this development has given their written consent to waive the public hearing and annex into the existing district. The use of summary proceedings allows for the initiation of proceedings and the final annexation action of the assessment district to be acted upon together as separate resolutions.
Pursuant to Title 16 (Subdivisions) of the Visalia Municipal Code, the City’s authorization to record the final map is a ministerial action. Specifically, Section 16.24.080 limits the City Council’s action to the specific determination that the final map conforms substantially to the contents of the tentative map, Chapter 16, and the Subdivision Map Act, and provides in pertinent part that “if the Council determines that the map is in conformity with the requirements of this Chapter, the Council shall approve the map (emphasis added).” Disapproval based upon any other reasons would be outside the authority of the Council for this particular action. The Council may reject any and all offers of dedication in the final map pursuant to Section 16.24.080, and require that the City Engineer so indicate on the map; however, staff’s recommendation is that the City Council authorize recordation of the final map and accept all offers of dedication as previously described in this report.
Fiscal impact including annual maintenance and operating costs:
The 51 residential lots within Belissa Phase 3 will contribute to Landscape and Lighting Assessment District No. 25-09 “Belissa” for maintenance of common improvements associated with the subdivision. The annual assessment is $753.67 per lot.
Prior Council Action:
On June 10, 1987, the City Council authorized the use of landscape maintenance assessment districts pursuant to the Landscape and Lighting Act of 1972 for maintenance of common area Visalia City Council Page 2 of 4 Printed on 10/2/2026

Engineer’s Report
Assessment District No. 25-09, City of Visalia, Tulare County, California Belissa
Fiscal Year 2026/27
General Description
This Assessment District (25-09, Belissa) is located at the northwest corner of North Demaree Street and West Pratt Avenue. Exhibit “A” is a map of Assessment District 25-09. This district includes the maintenance of shrub areas, irrigation systems, street trees, landscape trees, block walls, streetlights, pavement on local streets, pocket park, and any other applicable equipment or improvements; see Exhibit “B”. The maintenance of irrigation systems and block wall includes, but is not limited to, maintaining the structural and operational integrity of these features and repairing any acts of vandalism (graffiti, theft or damage) that may occur. This District also includes the preventative maintenance of all internal local City streets by means including, but not limited to overlays, cape seals, crack seals, and reclamite (oiling). The total number of lots within the district is 306, of which 51 will be assessed for Fiscal Year 2026/27.
Determination of Benefit
The purpose of landscaping is to provide an aesthetic impression for the area. The lighting is to provide safety and visual impressions for the area. The block wall provides security, aesthetics, and sound suppression. The maintenance of the landscape areas, streetlights, streets, and block walls is vital for the protection of both economic and humanistic values of the development. In order to preserve the values incorporated within developments and to concurrently have an adequate funding source for the maintenance of all internal local streets within the subdivision, the City Council has determined that landscape areas, streetlights, block walls, street trees, landscape trees, and all internal local streets should be included in a maintenance district to ensure satisfactory levels of maintenance.
Method of Apportionment
In order to provide an equitable assessment to all owners within the District, the following method of apportionment has been used. All lots in the District benefit equally, including lots not adjacent to landscape areas, block walls, and streetlights. The lots not adjacent to landscape areas, block walls, and streetlights benefit by the uniform maintenance and overall appearance of the District.
All lots in the District have frontage on an internal local street and therefore derive a direct benefit from the maintenance of the local streets.
Estimated Costs
The estimated costs to maintain the District includes the costs to maintain any landscaping, street trees, landscape trees, streetlights, block walls, and pavement on local streets. The regular preventive maintenance of pavement on local streets is based on the following schedule:
Reclamite on a 5 year cycle, Crack Seal on a 7 year cycle; Cape Seal on a 15 year cycle and Overlays on a 20 year cycle.

Annual Cost Increase
This assessment district shall be subject to an automatic annual increase derived by the following formula:
year “n” assessment = ($230,623.17) (1.05) (n-1)
where “n” equals the age of the assessment district with year one (1) being the year that the assessment district was formed;
However, in no case shall the assessment be greater than 1) The actual cost of providing the benefit conferred to each parcel plus any prior years’ deficit and less any carryover, as determined annually or; 2) a 10% increase over the prior year’s assessment.
The reserve fund shall be replenished as necessary to maintain a level of 10% of the estimated maintenance cost so long as the annual assessment change does not exceed the limits identified above.
Example 1) The year four estimated costs are $251,379.26 [a 9% increase over the base year assessment of $230,623.17]. The ceiling on the assessment increase for year four would be $266,975.15 [ceiling = ($230,623.17) (1.05) (4-1)]. The assessment would be set at $251,379.26 or the actual cost of providing the maintenance effort.
Example 2) The year four assessment is estimated at the actual cost of providing the maintenance effort of $260,604.18 [a 7% increase over the previous year assessment and a 13.0% increase over the base year assessment]. The ceiling on the assessment increase for year four would be $266,975.15 [ceiling = ($230,623.17) (1.05) (4-1)]. The assessment would be set at $260,604.18 or the actual cost of providing the maintenance effort because it is less than the ceiling amount and the year-to-year increase is less than the 10% cap on increases in any given year.
Example 3) The year four assessment is $251,379.26 [a 9% increase over the base year assessment of $230,623.17] and damage occurred to the masonry wall raising the year five assessment to $306,682.69 [a 22% increase over the previous year assessment]. The year five assessment will be capped at $276,517.18, a 10% increase over the previous year and under the ceiling of $280,323.90 [ceiling = ($230,623.17) (1.05) (5-1)]. The difference of $30,165.51 will be recognized as a deficit and carried over into future years’ assessment.
